Hager, Cook, Rodgers; City Manager Burgess; City Attorney Rhodes; and Deputy Clerk Poling ABSENT: Comm. Lyle CALL TO ORDER Mayor Goff called the August 2, 1983 meeting to order at 7:30 P.M. in commission chambers and led those present in the Pledge of Allegiance. MINUTES CLARIFIED AND APPROVED Upon hearing the reading of the July 19, 1983 minutes, Comm. Hager noted that his ~ vote to the motion for the Appreciation Celebration for Mr. Freeman and Mr. Vignetti was in compliance with Mr. Vignetti's wishes. Motion was made by Comm. Cook, seconded by Comm. Hager to approve minutes. 26 JULY 83 WORK SESSION MINUTES Motion was made by Comm. Rodgers, seconded by Comm. Cook to dispense with the reading of the 26 July 83 Work Session Minutes. Vote was unanimous. ORDINANCE - ANNEXATION - JOHNNIE LOTT PROPERTY ON PINE STREET - 1st. Reading Motion was made by Comm. Hager, seconded by Comm. Cook to read by title only for 1st reading the Ordinance annexing Johnnie Lott's property located on Pine St. Vote was unanimous in favor. City Manager pointed out the property on the map and read the title of the ordinance. ORDINANCE - ANNEXATION OF PROPERTY OWNED BY WILLIAM HAILE - Bordered by Old Winter Garden Rd., Twin Lake Dr., Seminole and Blackwood St. - 1st Reading Motion was made by Comm. Cook, seconded by Comm. Hager to read by title only for the 1st Reading of the Ordinance annexing William Haile's property bordered by Old Winter Garden Rd., Twin Lake Dr., Seminole and Blackwood St. Vote was unanimous in favor. City Manager pointed out the property on the map and read the title of the ordinance. City Attorney Rhodes explained to the audience that notices showing this to be the public hearing for the above annexations were sent out prematurely and that new notices showing the correct date for public hearing will be sent out. ORDINANCE - REZONING FROM Rl to C3, CARTER PROPERTY AT 137 TAYLOR ST - Final reading Public Hearing Motion was made by Comm. Hager, seconded by Comm. Cook to read by title only for the Final Reading and Public Hearing the ordinance rezoning from Rl to C3 the Carter property at 137 Taylor St. Vote was unanimous in favor. City Manager pointed out the property on the map and read the title of the ordinance. There was no audience response. Motion was made by Comm. Rodgers, seconded by Comm. Cook to approve the ordinance. Vote was unanimous in favor. City Commission 8/2/83 Page 2 ORDINANCE - REZONING FROM R1A to R2, COOK PROPERTY AT 15 S. CUMBERLAND - Final Reading Public Hearing Motion was made by Comm. Hager, seconded by Comm. Rodgers to read by title only for the Final Reading and Public Hearing the ordinance rezoning from R1A to R2 the Cook property at 15 S. Cumberland. Comm. Cook declared a conflict of interest and abstained from voting throughout this item. City Manager pointed out the property on the map and read the title of the Ordinance. Building Official Cecil Hurst defined the requested change in zoning to be from single family dwelling to accomodate a child care center. As this was a Public Hearing, the discussion was opened to the audience. Among those present were Mildred Phillips and Martha Johnson who objected to the passage of this ordinance because they felt a child care center would generate noise and traffic. Comm. Rodgers suggested the Petitioner might want to request a variance rather than a change of zoning. Mr. Hurst pointed out that this zoning change would be considered "spot zoning" and this would not be acceptable. Motion was made by Comm. Rodgers, seconded by Comm. Hager to deny the ordinance. Vote was unanimous in favor. ORDINANCE - DEANNEXING THE RODGERS PROPERTY ON OCOEE-APOPKA RD. - Final Reading Public Hearing Motion was made by Comm. Hager, seconded by Comm. Cook to read by title only for Final Reading and Public Hearing the ordinance de-annexing the Rodgers property on Ocoee-Apopka Rd. City Manager pointed out the property on the map and read the title of the ordinance. There was no audience participation. Motion was made by Comm. Rodgers, seconded by Comm. Cook to approve ordinance. Vote was unanimous in favor. PETITION FOR A FENCE ALONG PETERS AVE.- Residents of the Meadows Residents of the Meadows Subdivision appeared before the Commission to present a petition requesting the installation of a fence along Peters Ave. in order to alleviate the problem of vandalism and destruction made by bicycles, motorcycles and horses. City Attorney explained that the City cannot build a fence on private property. Comm. Rodgers told the residents that he would check with the County and RCA regarding this problem and give an update at the next regular meeting. REPLACEMENT ON BOARD OF ADJUSTMENTS - Mr. Jerry A. Kennedy Resigned Motion was made by Comm. Rodgers, seconded by Comm. Cook to appoint Vern Combs as an alternate on the Board of Adjustments. Vote was unanimous. MR. RANDY FREEMAN - RE: POSSIBLE ANNEXATION OF PROPERTY - A.D.MIMS RD. AND ANOTHER ON S.R. 50 - Randy Freeman appeared before the Commission regarding the annexation of certain property off A.D. Mims Rd. Comm. Hager suggested that he appear before the Planning and Zoning Board. Mr. Freeman also requested a work session to establish an ordinance allowing a mobile home park - on the style of Zellwood Station - to be built on S.R. 50. No action was taken on this matter. City Commission 8/2/83 Page 3 REPORTS/INFORMATION (a) Water Well #3 Improvements progressing well. (b) Reports of dogs being shampooed in lakes - suggested possibly posting signs prohibiting dogs. (c) Copy machine needs replaced at City Hall. (d) Copies of the Holly Hill Resolution Re: Consolidation/Annexation was provided for the Commission1s review. (e) RCA/City Sewer Agreement Meeting to be held 12:00 noon August 3, 1983. (f) Residents of Lake Moxie requested that the City install pump and begin draw-down operation on Lake Moxie. Comm. Rodgers made a motion that subject to City Engineer Kuhrt's concurrence that (1) the level of Peach Lake is severe enough to be an emergency situation, (2) Does the drain in front of 1238 Russell Dr. directly connect to Lake Moxie. If so and DER will permit pumping, pursue pumping as soon as possible. Motion was seconded by Comm. Cook and vote was unanimous in favor. (g) Higginson property was found not to be contiguous. (h) Freeman-Vignetti Appreciation Celebration to be held September 10, 1983. (i) Three garbage collection permits have been issued. (j) Action should be taken regarding Federal Revenue Sharing 81/82 $93,326 allotted for Fire Station at the meeting to discuss Federal Revenue Sharing for FY83-84 on August 29, 1983, Public Hearing. (k) PSC Rate setting hearing - Prima Vista Utilities to be held at the Community Center September 2, 1983 at 10 A.M. (1) Proposed ordinance/water deposit from $25.00 to $50.00 will be on the August 16 Agenda. Motion was made by Comm. Rodgers, seconded by Comm. Cook to have the contract between Mike Menton, Maintenance Engineer for the West Oralndo Utilities Sewage Treatment Plant, and the City of Ocoee drawn up and signed. Vote was" unanimous in favor. Comm. Hager suggested that RCA be reminded that the holding pond at Peach Lake is full. Comm. Rodgers instructed that the junk yard at DJ's Auto be eliminated. Cumberl and Ave. II However, as the rezoning of this property would have resulted in my personal gain, I declared a conflict of interest and abstained from voting.
