Resolution No. 2004-01 - Professional Parkway/Old Winter Garden Road Improvement Project (Parcel
126). (Assistant City Attorney Doty)
City Attorney Rosenthal read the title only of the Resolution. Assistant City Attorney Doty gave the staff
report and background, advising there still may be a chance to purchase at a new appraised price (not yet
received); however, in the event a voluntary sale cannot be negotiated it will then be necessary to acquire the
Express Care right-of-way by filing a condemnation action. Ms. Doty recommended adoption of Resolution
2004-01, which authorizes the filing of a condemnation action, and rescinding the Commission's September 16,
2003, approval of the Express Care acquisition agreement.
Mayor Vandergrift. seconded by Commissioner Parker. moved to approve Resolution No. 2004-01,
authorizing execution thereof by the Mayor and City Clerk and further authorizing all necessary actions in order
10 proceed to acquire the property by quick take proceeding: and further expressing this Commission's
displeasure in the outcome of the circumstances surrounding this situation with all that the City has given the
hospital and donations made in kind worth millions of dollars and in waiving funds for them to get started,_
Motion carried.4-0. Commissioner Johnson was away from the dais.
Mayor Vandergrift asked for a report on all the impact fees waived and other monies given to Health Central.
Commissioner Anderson, seconded by Commissioner Howell, moved to rescind the September 16. 2003..,
Express Car~ acquisition agreement. Motion c(lrried 4-0. Mayor Vandergrift was away from the dais.
City Manager Gleason asked for direction to bring back to the February meeting a proposal to do away with
the exemptions to the traffic impact fees for the hospital. Without objection this direction was given.

Human Resources Director Diedrich gave the staff report. No action was taken on this item.
Approval and Authorization of a New Job Description for the Position of Multimedia/Community Ev:ents

Human Resources Director Diedrich gave the staff report, explaining the change in the job description.
Mayor Vandergrift, seconded by Commissioner Anderson. moved to approve the new job description for the
position of Multimedia/Community Events Manager. Motion carried 5-0.

ORDINANCE NO. 2003-60
AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
AMENDING CHAPTER 78 OF THE CODE OF
ORDINANCES OF THE CITY OF DC DEE RELATING TO
FIRE PREVENTION; AMENDING SECTION 78-20
RELATING TO PLAN REVIEWS; INCREASING
COMMERCIAL PLAN REVIEW FEES; ESTABLISHING
MULTI-FAMILY AND SINGLE-FAMILY RESIDENTIAL
PLAN REVIEW FEES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee desires to increase the fee for
plan reviews performed by the Ocoee Fire Department as it relates to commercial
establishments; and
WHEREAS, the City Commission of the City of Ocoee desires to establish a fee for
plan reviews performed by the Ocoee Fire Department as it relates to single and multi-family
residential units.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of Ocoee has the authority to
adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and
Chapter 166, Florida Statutes.
SECTION 2. Ampnclmpnt to ~pdion 7R-20. Section 78-20 of Article III of
Chapter 78 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to
read as follows (with deletions stricken and additions underlined):

~ 78-20. Plan review; permits.
A. The Fire Department shall perform a review of all pertinent building plans and
specifications submitted to the Building Department in order to determine whether
such plans and specifications comply with the Florida Fire Prevention Code and this
chapter. Separate permits will be required for fire protection systems.
B. In addition to any fees paid at the time of application for a building permit pursuant
to Chapter 51 of the Code of Ordinances of the City of Ocoee, at the time of such
application, the applicant shall also pay the following nonrefundable plan review fee
for review by the Fire Department, to be collected by the Building Department:

2) Value of construction for purposes of calculating the above fee
shall be determined in accordance with S 51-128 of the Code of
Ordinances of the City of Ocoee.
3) There shall be no additional charge for initial inspection
conducted by the Fire Department.
4) Plan review fees shall not be charged for construction projects
when construction or plans or drawings are not required.
SECTION 3. Spvprahility. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion hereto.
SECTION 4. Coclifil'ation. It is the intention of the City Commission of the City
that the provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City; and that sections of this Ordinance may be renumbered or
relettered and the word "ordinance" may be changed to "chapter," "section," "article," or
such other appropriate word or phrase in order to accomplish such intentions; and
regardless of whether such inclusion in the Code is accomplished, sections of this
Ordinance may be renumbered or relettered and the correction of typographical errors
which do not affect the intent may be authorized by the City Manager, without need of
public hearing, by filing a corrected or recodified copy of same with the City Clerk.
SECTION 5. Effective Date. This Ordinance shall become effective immediately
upon passage and adoption.
