HomeMy WebLinkAboutResolution 2005-006 RESOLUTION NO. 2005-006 A RESOLUTION OF THE CITY OF OCOEE, FLORIDA, SUPPORTING ENFORCEMENT OF FLORIDA'S CROSSWALK LAWS IN THE ORLANDO METROPOLITAN AREA; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Orlando Metropolitan Area has one of the highest pedestrian fatality and injury rates in the nation; and WHEREAS, pedestrian safety is the responsibility of motorists as well as the pedestrians themselves; and WHEREAS, pedestrian safety is a component of both good design and enforcement of traffic laws; and WHEREAS, pedestrians must feel confident that motorist will yield to them if crosswalks are to be useful as a safety too; and WHEREAS, based on a survey of Orlando Metropolitan Area residents, over 93% of adults support law enforcement professionals giving tickets to motorist who fail to stop or yield for pedestrians in crosswalks; and WHEREAS, the Florida Statues states that "When traffic controls signals are not in place or in operation, the driver of the vehicle shall yield the right -of way, slowing down or stopping if need be so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: The City Commission now hereby declares its support for the enforcement of Florida Statute 316.130 paragraph 7. 006.106966.1 SECTION 1. Authority. The City Commission of the City ofOcoee has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Severabilitv. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 3. Effective Date. This Resolution shall become effective immediately upon passage and adoption.
