HomeMy WebLinkAboutResolution 2002-09 RESOLUTION NO. 2002-09 A RESOLUTION OF THE CITY OF OCOEE, FLORIDA, SUPPORTING THE PROPOSED ONE-HALF CENT SALES TAX; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the School Board of Orange County, Florida has resolved to call a referendum to be held September 10, 2002, for the purpose of submitting to the duly qualified electors of Orange County, Florida a question regarding the levy by the School Board on all taxable transactions of a discretionary sales surtax of one-half cent for the purpose of funding the costs of fixed capital outlay, land acquisition, technology implementation and retrofitting, including bond indebtedness therefor, and providing for a binding reduction of 0.5 mills in the capital local school property tax for the term of any approved sales surtax; with the foregoing sunsetting in 2015; and WHEREAS, the School District of Orange County, Florida suffers a lack of funding for the costs of construction, reconstruction, and improvement of new and existing school facilities, and for the cost of providing and retrofitting schools for technology implementation; and WHEREAS, this proposed one-half cent sales tax will provide the needed funds to implement the plan adopted by the School Board at its May 2, 2002, meeting; and WHEREAS, the City Commission of the City of Ocoee has in many ways exhibited its willingness to cooperate with the Orange County School Board in furthering the education of the children committed to its care; and 006.106966.1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. The City Commission of the City of Ocoee hereby expresses its support of the one-half cent sales tax. SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
