REGULAR CITY COMMISSION MEETING
A. CALL TO OR DE R
Mayor Vandergrift called the regular session to order at 7:15 p.m. in the Commission
Chambers of City Hall, Commissioner Keller gave the invocation, followed by the Pledge of
Allegiance to the Flag, led by Commissioner Grogan. City Clerk Eikenberry called roll and
declared a quorum present.
Roll Call: Commissioner Grogan, Commissioner Wilsen (absent), Mayor Vandergrift,
Commissioner Johnson, and Commissioner Keller.
Also Present: City Attorney Cookson, City Manager Frank, City Clerk Eikenberry
B. PRESENTATI AND P ROCLAMAT IONS
Commissioner Johnson recognized several Fire Union members for their help with the beer
sales at the Founder's Day event. He further presented Fire Union member James Kelley with a
check for $4000.00 which was their share for the help they provided.
C. COMMENTS FROM Cl TIZ /PUBL
Lamar Powers, 1515 Acropolis Circle, shared with the Commission a noise (loud music)
compliant he made to the Ocoee Police Department regarding Frank's Place late Friday night
until 2 a.m. Saturday morning. He inquired if there was an ordinance regarding outside
entertainment and music being allowed or if a permit was even issued. Additionally, he shared
concerns regarding motorcycles racing on Clarke Road after citizens leave Frank's Place as well
as the stench of cigarette smoke in the restaurant which he thought was prohibited. After a brief
discussion and explanation of Special Event Permits being required for such events Mayor
Vandergrift said he would like a warning letter sent to the owner of Frank Place advising of the
City's rules and procedures.

E. COMMISSIONERS ANNOUNCEMENTS
Commissioner Keller -- None
Commissioner Johnson -- announced that the City of Ocoee Fire Department will be holding a
Memorial Dedication Ceremony in honor of Dominic "Donnie" Ungaro. The dedication
ceremony will be held on this Saturday, January 11, at 10:00 a.m., Ocoee Fire Station 25, 563
South Bluford Avenue. The public is invited to attend the dedication ceremony.

Commissioner Keller, seconded by Commissioner Grogan, moved to approve the
Consent Agenda Items #1 through #2. Motion carried 4 -0 with Commissioner
Wilsen absent.
Approval of Minutes for the Regular Commission Meeting Held December 17, 2013.

Approval of Maguire Road Ditch Improvement Project Award. (Public Works Director
Krug)
The Storrnwater Division of the Public Works Department has designed a project to improve drainage and
reduce maintenance of the existing ditch on South Maguire Road. The project will enclose the existing open
ditch by piping the ditch line in front of the Windsor Landing Subdivision from Thornebrooke Drive south to
the Reserve at Belmere Drive. Public Works has continually graded the drainage ditch to ensure proper flow of
storm drainage. Installing the enclosed pipe system will eliminate the constant grading work and erosion of the
ditch slopes which will begin undermining the existing sidewalk in this area. The project will also provide a
more attractive southern entranceway to the City.
Public Works solicited pricing from the contractors on the City's Small Construction Projects "Term Contract.
Six (6) contractors responded with the low bid below the Engineer's estimate. Public Works recommends
awarding the project to the low bidder, Barracuda. Building Corp., in the amount of $125,458.74 based on
pricing solicited through the City's Small Construction Projects Term Contract RFP Al 1 -004. The project has a
sixty (60) calendar day duration and is funded under the Stormwater Division's Miscellaneous Small Projects.
Approved on Consent. Motion carried 4 -0 with Commissioner Wilsen absent.

3. City Property — Future Retention Pond Wurst Road. (Advertised in the Orlando Sentinel on
Thursday, December 26, 2013). (City Planner Rumer)
The City of Ocoee is requesting the annexation of a parcel of land totaling 1.13 t acres and an initial zoning
from Orange County "A -1" to the City of Ocoee "A -1 ". The parcel is vacant and does not contain public access.
The City is anticipating using the parcel as a right -of -way retention pond when future upgrades are made to
Wurst Road.
a. Annexation Ordinance
City Attorney Cookson read the title of the annexation ordinance and rezoning ordinance.
City Planner Rumer explained that the subject property is considered contiguous to the City of
Ocoee since it is an individual enclave located within the City limits. The City of Ocoee is
requesting the annexation of the parcel of land totaling 1.13 ± acres and an initial zoning from
Orange County "A -1" to the City of Ocoee "A -t ". The parcel is vacant and does not contain
public access. The City is anticipating using the parcel as a right -of -way retention pond when
future upgrades are made to Wurst Road. Staff recommends the approval of annexing the subject
parcel.

hearing was closed.
Commissioner Grogan, seconded by Commissioner Johnson, moved to approve
_Annexation Ordinance 2013 -030 per staff's recommendation. Motion carried 4 -0
with Commissioner Wilsen absent.
The ordinance as adopted on second reading carries the following title:

4. Comprehensive Plan Amendment — Capital Improvements Element. (Advertised in the
Orlando Sentinel on Thursday, December 26, 2013). (City Planner Rumer)
The Capital Improvement Element (CIE) of the City of Ocoee Comprehensive Plan is a requirement of Chapter
163, Florida Statutes (FS) and enables implementation of the Plan goals, objectives, and policies needing capital
funding for a 5 -20 year planning horizon. Each year, the table section of the CIE will be updated to ensure that
the adopted list of capital projects in the CIE matches the City's newly adopted fiscal year budget and approved
five year Capital Improvements Program (CIP). The CIE does not propose any new projects not previously
reviewed and approved by the Commission.
The Florida Legislature enacted legislation allowing adoption of the annual amendment to the CIE to be
accomplished with a single public adoption hearing. Additionally, State Statute no longer requires a copy of the
Ordinance to be transmitted to the Florida Department of Economic Opportunity (FKA: Department of
Community Affairs "DCA "). Therefore, adoption of this Ordinance is final in its form and content.
City Planner Rumer explained this is the Capital Improvement Program which this
Commission approved during the budget process. It is a statutory requirement to place it in the
Comprehensive Plan each year which is done through a public hearing. State Statute no longer
requires a- copy of the Ordinance to be transmitted to the Florida Department of Economic
Opportunity (FKA: Department of Community Affairs "DCA''). Therefore, adoption of this
Ordinance is final in its form and content.

I K. COMMENT'S FROM COMMISSIONERS
Commissioner Grogan — inquired if for any event parade that the Commission is involved in if
they could upgrade the transportation for the dignitaries (Commissioners, Mayor, Grand
Marshal, etc.) to a convertible car. Ile is requesting if a vehicle cannot be donated that funds be
taken out of contingency in an amount up to $700.00 for the .rental of such vehicles.
Commissioner Grogan, seconded by Commissioner Keller, moved to have
convertible cars for the Grand Marshal, Mayor, and Commissioners for future
parades, in a rental amount up to $700, to be taken out of the contingency fund if
donated vehicles cannot be obtained. Motion carried 4 -0 with Commissioner
Wilsen absent.
Commissioner Grogan mentioned that he feels City vehicles and equipment fi•om public works,
utilities, etc. should be exhibited in parades as well police and fire.

Mayor Vandergrift — inquired if the light is fixed out at the fountain in front of City Hall.
Public Works Director Krug said they had the vendor that maintains the fountain come out and
everything is working. They believe the timer was just off.
