(District 4 Commissioner Joel Keller) Background Summary: This property was cited on January 9, 2013 by Officer Edward Loeffler as a nuisance to the public health, safety and welfare regarding a vacant wooded lot with illegal dumping, juvenile and criminal egress, two instances of arson, occupancy by homeless persons and overgrown tall weeds and grass. The codes in violation were: 108- 35, 115 -3 and 115 -5. On March 26, 2013, the Code Enforcement Board issued an order to comply by May 1, 2013 or be fined $250.00 per day per violation. On May 23, 2013 the Code Enforcement Board imposed the accruing fine and lien for non - compliance. The property owner originally cited continued to neglect the property and failed to respond to any city actions. Recently, the property had successive ownership changes, with Charlie Vickers of Central Florida Land Brokers taking ownership on December 31, 2013. During the quick ownership changes, the property was swiftly brought into compliance with the codes, as cited. Contact and communication was maintained and the physical property was monitored and maintained. Issue: Charlie Vickers, the new property owner, appeared before the code enforcement board on January 28, 2014 and requested a reduction of the fine /lien amount of $100,500.00 to the city's cost of $852.22 to enable beneficial development of the property. Recommendations The Code Enforcement Board is recommending the fine /lien be reduced to the city's cost of $852.22. The discussion by the Board to reduce the amount was based on testimony and answers from Mr. Charlie Vickers and city staff. He reminded the board that this case involves a large wooded lot that had a lot of nuisances involved. The property had also been posted by the Marshall's Office for other legal trouble, which is the same time this board made a finding on the case. Officer Loeffler advised there has been a new ownership for the property, and almost immediately upon their ownership transferring, compliance was initiated. The property was swiftly brought into compliance. There is a City cost associated with this case in the amount of $852.22. Mr. Charlie Vickers, MiJax Silver Star, LLC, said they recently purchased the property from the bank. There were a lot of legal issues from the previous owner that caused the bank to move slowly with the purchase. He briefly explained they have cleaned the property; however, have experienced issues with a person living on the property, as well as, someone dumping onto the property. An application for fencing to secure the property has been submitted and once issued, they can go back in to clean up the property again. Officer Loeffler interjected that the property did come into compliance with the board's order prior to the new issues the owner is experiencing. Alt. Member Hopper inquired from Mr. Vickers if he purchased the property, or if these issues are holding him back from purchasing the property. Mr. Vickers shared some of the issues he had with the property and federal liens that where associated with the property. He advised those were waived. He realized the City liens would require a process which is why he before them tonight. Chairman Godek asked for staff's recommendation. The officer replied that they are recommending for the City's cost of $852.22 to be reimbursed. Vice - Chairman Lowery, seconded by Member Carrington moved that in Case 913 -021 that the Code Enforcement Board recommend to the City Commission to reduce the fine to the City's cost of.$8S2 22 Alt. Member Hopper questioned if the lien was kind of light. He envisioned a reduction of more along the line of 10% of the original fine. After brief discussion motion was taken. Officer Delgado advised that Joseph Marra has passed away and his daughter brought the property up to compliance once she took over the property. The total lien amount due on the property is $70,250.00. The property has been in compliance since August 15, 2013, and the City's cost is $467.50. Vice - Chairman Lowery asked for clarification on 115 -7. Officer Delgado advised that 115 -7 was removed as a violation cited at the notice of hearing. JoAnn Tenhoeve, 10 Bracken Road, West Milford, New Jersey, testified that as soon as her father passed she changed the mailing address of his residence to hers and received the notice of code violation. She quickly had the property cleaned up to compliance. She further advised that she does not know what they will be doing with the property (vacant lot) and is considering putting it on the market for sale. Ms. Tenhoeve shared that the lien amount of $70,000 was a total shock to her, and is requesting the help of the Code Enforcement Board to point her in the right direction. Vice - Chairman Lowery asked if she contracted someone to maintain the property since she lives out of Page 4 state. She answered "yes ". Member Hopper expressed appreciation to Ms. Tenhoeve for her efforts since he knows this is not easy for her. Member Blynder asked if this was the lot across from the shopping center on Silver Star Road and Bluford Avenue. The exact location of the property was explained by the officer. Member Blyner asked if the fallen tree was the only problem. Officer Delgado answered that there was overgrown grass, trash and debris. Member Osborne, seconded by Vice - Chairman Lowery, moved that in Case #12-179, that the Code En orcement Board recommend to the City Commission to reduce the fine to the CitT's cost of$467 50 Chairman Godek said that he did not think that was enough. Alt. Member Hopper agreed. Discussion ensued as to the consistency of the board's actions with similar cases. After brief discussion, a motion was taken.
