AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
PROVIDING FOR MINIMUM SETBACKS FOR DEVELOP-
MENT IN GENERAL, AND BUILDINGS SPECIFICALLY
FROM ALL BODIES OF WATER WITHIN THE CITY
BOUNDARIES; PROVIDING FOR SEVERABILITY; AND,
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA:
Section 1. Homes and other primary buildings shall
not be constructed closer than thirty five (35) feet to the
normal high water elevation of a natural surface water body.
Section 2. Homes and other primary buildings shall
have a minimum building pad elevation of twelve (12) inches
above the elevation of the base one hundred (100) year flood
as determined by the National Flood Insurance Progam of the
United States Government.
Section 3. Before any building permit is issued for
a home or other primary building where the builder proposes
development and intends to place fill material within the limits
of the one hundred (100) year flood plain, the builder shall
present a site plan prepared by a Registered Professional En-
gineer which provides for compensating storage for all flood
water displaced by the fill material or site development work
below the one hundred (100) year flood elevation. Such plan
shall be approved by the City Engineer prior to issuance of a
building permit and the builder shall conform to such approved
plan.
Section 4. Septic tanks and drainfields shall be lo-
cated in front yard for all buildings and other primary struc-
tures, except where specifically approved by the City Engineer,
and shall be located at lease one hundred (100) feet from the
normal high water elevation of all natural water bodies and
seventy five (75) feet from all other surface waters.
Section 5. Those structures that exist as of the
effective date of this Ordinance will be allowed to remain in
the position that they are currently constructed on. There will
not, however, be any additional building allowed upon those
structures already in existance, if that said additional con-
struction is in violation of this Ordinance, despite the fact
that the original structure is being "grandfathered" in.
If such a structure is "grandfathered" as of the ef-
fective date of this Ordinance, and then the building is sub-
sequently torn down for some other reason, no other structure
shall be placed upon the property that is in contravention to
this Ordinance.
Section 6. In disputes of interpretation over this
Ordinance, the rulings of the Ocoee City Board of Commissioners
shall be final; there is no appeal to the National Flood Insur-
ance Program nor any other agency.
Section 7. If any portion of this Ordinance is deemed
to be unconstitutional or otherwise void by a Court of Law, the
remainder of the Ordinance will retain its effectiveness.
Section 8. Any previous City Ordinances that conflict
with this in total, or in part, shall have that portion In con-
flict superseded by this Ordinance.
Section 9. This Ordinance shall be considered an
expansion of the City's Zoning Ordinances and Subdivision Regu-
lations, as currently described in Appendix A, and Appendix B,
respectively to the City Charter.
Section 10. This Ordinance shall take effect immed-
iately upon passage by the City Board of Commissioners. Those
homes/structures that are in violation of this Ordinance but
have already been permitted and have had work initiated on same
will be considered to be "grandfathered".
