Subject: Code Enforcement Reduction of Two Fine /Liens for Anthony Fairclotfi and Heather Faircloth
re: 1408 Wanda Street. (District 3 Commissioner Rusty Johnson )
Background Summary:
The property located at 1408 Wanda Street has two separate fine /liens from separate code enforcement
actions; they are being presented as a single agenda item so the property owner can be provided a single
solution.
Case 11 -005:
The property was cited on October 27, 2010 by Officer Carmen Delgado for miscellaneous junk and debris and
an untagged /inoperable van on the property. The codes in violation were: 115 -3 for trash and debris; 165 -3 for
an abandoned or junk vehicle. On February 22, 2011, the Code Enforcement Board issued an order to comply
by March 22, 2011 or be fined $100.00 per day per violation. On March 22, 2011 the Code Enforcement Board
imposed the accruing fine and lien as of March 23, 2011 for non - compliance of 115 -3 and 165 -3. The new
property owner, Coughlin Investment Group Inc., purchased the property for $36,600 on October 15, 2012.
Coughlin Investment Group Inc. brought the property into compliance on January 9, 2013. The property is now
being maintained.
Case 11 -282:
The property was cited on November 8, 2011 by Officer Theresa Rodriguez for the installation of a canopy on
the left -side backyard without required permits. The code in violation was: 51 -13, Permit Required. On January
24, 2012, the Code Enforcement Board issued an order to comply by February 10, 2012 or be fined $100.00
per day per violation. On February 29, 2012, the Code Enforcement Board imposed the accruing fine and lien
for non - compliance of 51 -13. The property was found to be in compliance of 51 -13 on March 4, 2013. The new
property owner, Coughlin Investment Group Inc., brought the property into compliance on March 4, 2013. The
canopy structure was removed.
Coughlin Investment Group Inc., the new property owner, appeared before the Code Enforcement Board on
February 25, 2014 and requested a reduction of the fine /lien amount of $204,600.00 for Case No. 11 -005 and
$38,500 for Case No. 11 -282. Both liens were foreclosed, but the city's cost remains, as these are special
assessment liens.
Issue:
Should the City Commission reduce the amount of the fine to be paid to the total cost of these enforcement
actions, which is $3,541.82?
Recommendations:
The Code Enforcement Board recommends the fine /lien be reduced to $1,983.92 for Case 11 -005 and to
$1,557.90 for Case 11 -282, which is the cost to the City for the enforcement actions. The decision by the Board
to reduce the amount was based on testimony and answers from Jack Coughlin, James Thayer, and city staff.
Attachments:
Code Enforcement Board meeting minutes and photo exhibits
Financial Impact:
The city would be paid its costs of $3,541.82, which cover both fines /liens.

Mr. Thayer inquired regarding the difference between the cited violations for both cases. Officer Delgado
explained that they are separate cases for separate violations. This violation is for the permit required for the
temporary structure in the back of the property. Mr. Coughlin inquired regarding the fees charged for the
code enforcement officer in the amount of $100 per hour. Officer Delgado stated that the fee includes the
inspections conducted every two months, and for each time the officer visited the property.

Officer Loeffler presented the case and gave its history. Exhibits (photos) were presented. The officer
stated, as of today, the property is in compliance. The officer explained that the location has been a habitual
code and law enforcement issue. The case is being presented due to the lack of monitoring of the rental
property, which results in a nuisance for the neighborhood. The City wishes to have the findings on record
in order to deter future issues with the property owner, and so the respondent may be treated as a repeat
violator. He continued to say that the respondent was also in violation of LDC Article VI, 6- 4H(6)(b) and
Code 143 -10; however those were brought into compliance prior to the hearing date.
Board Attorney Sneed inquired which violations were included in the Notice of Hearing issued to the
respondent. The officer responded, "108 -24 ". The other violations were brought into compliance prior to the
date the Notice of Hearing was issued. Member Osborne inquired regarding the date of compliance. The
officer responded the compliance date is February 25, 2014; however, the required compliance date was
originally December 15, 2013.
Member Osborne, seconded by Member Blynder, moved that in Case #14 -004 the respondent be found in
violation as cited as ofDeeember 15 2013 and in compliance as ofFebruary 25 2014 and that no fine be
assessed.
Vice - Chairman Lowery requested clarification regarding creating permanent records for repeat violators.
Board Attorney Sneed explained that Chapter 162 of the Florida Statutes states that if the same violator is
found in violation of the same section of the Code within five (5) years, then it is a repeat violation. This
will then allow the imposition of penalties from the date observed, up to $500 per day. Additionally, this is
true for any property in the county that the respondent owns.
Motion carried unanimously.

stated, as of today, the property is in compliance; however, the City wishes to establish a permanent record
and case history to try and deter future issues.
Member Osborne, seconded by Member Carrington moved that in Case #14 -006 the respondent be found
in violation as cited as of December 29, 2013 and in compliance as of February 25 2014 and that no fine
be assessed.
Page 6
Alt. Member Hopper opined that the issue with un- permitted signs is an ongoing battle; not imposing a
fine will not deter the issue. He suggested at least charging for the officer's time.
Board Attorney Sneed stated that there is a motion on the floor, and discussion should be between board
members and not staff. She asked the board to address the motion, and then pursue discussion with staff.
Motion carried unanimously.
Member Amey commented that if the respondent violates the Code again, then the board can assess a fine.
Alt. Member Hopper suggested that the City should at least charge for the officer's time for re- inspection.
