The storage structure will encroach ±14 feet into a 25 foot Upland Buffer, Conservation & Drainage Easement. The house was originally constructed in 2003 with 4,183 sq. ft. under roof. In 2011/2012, a rear addition was done by the applicant increasing the square footage to 7,603 sq. ft. With the rear addition, a deck was permitted to extend 12 feet off of the rear of the addition. The applicant constructed an accessory storage structure under the deck and extended the deck an extra ± eight (8) feet. The property is on Lake Johio and contains wetlands and 100 year flood plain. A 25' conservation easement is dedicated from the 100 year flood plain per code. The accessory structure is located within the 25' buffer easement. The subject property is located on Lot 25 of the Willows on the Lake plat. Lot 25 contains "C" drainage, which is from front to rear. According to Subsection 4 -9 A., the variance application /applicant must demonstrate: (1) That special conditions and circumstances exist which are peculiar to the land, structures, or required subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision improvements. A single - family dwelling was constructed with adequate room for detached accessory structures. A rear addition to the structure was done by the applicant creating the current conditions. (2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties with similar conditions. The Comprehensive Plan and Land Development Code require a 25 foot conservation easement from the 100 Year Flood Plain and wetlands. No development other than a public infrastructure has encroached into the buffer area. Therefore, the applicant will not be deprived rights commonly enjoyed by other properties with similar conditions. (3) That the special conditions and circumstances do not result from the actions of the applicant. The applicant constructed a rear addition creating the conditions. (4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied by these regulations to other lands, structures, or required subdivision improvements under similar conditions. The granting of this variance will confer special privileges. Board of Adjustment Recommendation: The proposed variance request by Bonnell Patrick for an encroachment into the 25 foot Upland Buffer, Conservation & Drainage Easement was reviewed at a Public Hearing by the Board of Adjustment on May 14, 2014. The Board of Adjustment voted 3 -0 to recommend denial of the variance request. Issue: Should the Honorable Mayor and City Commission approve a variance request to permit an accessory structure in a 25 foot Upland Buffer, Conservation & Drainage Easement dedicated to the City of Ocoee? Recommendations Based on the recommendation of the Board of Adjustment and the evidence provided in the staff report, staff does not support the variance requested. Should the City Commission make a finding of approval, staff recommends that any approval be conditioned on factual interpretation of code requirements and public testimony related to such provisions.
