MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON MARCH 11, 2014 AFT MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, MARCH 11, 2014 CALL TO ORDER Chairman Campbell called the meeting to order at 7:00 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman Campbell, Vice- Chairman McKey, Members de la Portilla, Dunn, Marcotte, Sills, and West. Also present were City Planner Rumer, Assistant City Attorney Drage and Recording Clerk Turner ABSENT: Member(s): Dillard (A/E) and Keethler (A/E) ELECTION The board election for chairman and vice - chairman was held at the February 11, 2014, Planning and Zoning Commission meeting. CONSENT AGENDA Minutes of the Planning and Zoning Commission Meeting held on Tuesday, February 11, 2014. Vice - Chairman McKey, seconded by Member West, moved to accept the amended minutes of the February 11, 2014, Planning and Zoning Commission meeting. Motion carried unanimously. OLD BUSINESS - none NEW BUSINESS Park Place PUD — Preliminary /Final Subdivision Plan & Preliminary /Final Site Plan — Public Hearing City Planner Rumer gave a brief presentation with exhibits of the proposed project. The subject property is located on the northeast corner of Maguire Road and Tomyn Boulevard. The parcel is 14.11 acres. The Park Place Planned Unit Development (PUD) is comprised of 242 multi - family units and a 2 % acre commercial outparcel. The subject property consists of a vacant and undeveloped land. The Future Land Use designation for the subject site is "Commercial ". The preliminary/final subdivision plan is to create the three lots. Lot 1 will consist of the 242 multi - family units and Lots 2 and 3 are commercial out - parcels. The preliminary/final site plan is for the construction of Lot 1. The Preliminary /Final Large Scale Site Plan will consist of 242 multi- family units on 11.35 acres. The parcel is adjacent to the Florida Turnpike on the north, R -3 multi - family to the south, vacant C -3 on the west, and a stormwater pond on the east. The minimum front setback to Maguire Road is 50 feet. The closest unit is setback more than 90 feet from Maguire Road. The site will be accessed via a right in /out on Maguire Road, and an additional access on Tomyn Boulevard is provided. All entrances will be gated. A 25 foot landscape buffer provided along Maguire Road, and Tomyn Boulevard will consist of a Planning and Zoning Commission Meeting March 11, 2014 brick wall with landscaping. The overall development will include a clubhouse, fitness center, pool, and other recreation and open space amenities. The Preliminary/Final Subdivision Plan will consist of three Tots. No stormwater ponds are proposed as there is an existing master stormwater facility. The final development of all three Tots is scheduled to be under the maximum impervious allotted to the overall property, so no issues are expected with the water management district. The subdivision has received school capacity and concurrency approval and the applicant has already pre- paid some of the school impact fees ($94,880). This payment reserves the development's capacity. Several off -site improvements will be constructed or mitigated through payments based on the proposed development and previous development agreement commitments. The first improvement is a right turn lane northbound on Maguire Road to eastbound on Old Winter Garden Road. The applicant will either construct the improvement or pay the City 400,000 to construct the improvement. The second improvement is a mitigation payment of $20,000 toward landscaping the medians on Maguire Road. The third improvement is a 50 -foot extension of the left turn lane from Maguire Road on to Tomyn Boulevard. The last improvement is the construction of a right turn lane on Tomyn Boulevard to northbound on Maguire Road; however, this improvement is proposed to be removed. Upon review of the final subdivision plan, the City's Engineer and Public Works Director found conflict associated with widening the road to accommodate the turn lane. There is a mast arm and two storm inlets in that location that cannot be moved due to settling issues in the area. The applicant was instructed to conduct an updated traffic analysis to see if the turn lane was warranted. The updated traffic count concluded that the right turn lane is not warranted. At the time the original project, Lake Butler Professional Campus, was approved, staff was not interested in revising all the conditions. The only concurrency issue at the time was dealing with traffic flow on State Road 50; however, that was mitigated through the improvement of the right turn lane northbound on Maguire Road to eastbound on Old Winter Garden Road. Staff is agreeable to removing the requirement for the right turn lane on Tomyn Boulevard to northbound on Maguire Road. The next step of the project is to present the Preliminary and Final Subdivision Plan, and the Preliminary and Final Site Plan to the City Commission for approval. Discussion Member de la Portilla inquired which high school the development will be zoned for. Mr. Rumer answered, "West Orange ". 2 Planning and Zoning Commission Meeting March 11, 2014 Member Marcotte inquired the distance of the right turn lane onto Old Winter Garden Road. Mr. Rumer explained that the lane is the maximum size that will fit in order to be considered safe; however, he did not have the exact distance of the turn lane. Vice - Chairman McKey inquired if the waiver is to reduce the setback between the buildings was from 15 feet to 5 feet, and if the waiver was approved by the fire department. Mr. Rumer stated that all waivers were approved under the original PD and there are no new waivers requested. He confirmed that the fire department did approve the waiver. Vice - Chairman McKey inquired if garages are included in the development. Mr. Rumer confirmed that they are. Member Dunn inquired if the right turn lane on Tomyn Boulevard to northbound on Maguire Road is removed from consideration, if needed in the future, how will that be addressed. Mr. Rumer responded that the updated study provided for the maximum development and assumes all traveled trips; the study concluded that there is not a need for that lane. Member Sills asked if traffic volume is dictated by the type of commercial businesses in the development. Mr. Rumer stated the analysis was conducted based on the two highest commercial uses, a restaurant and daycare. The public hearing was opened. Kelly Morphy, Safe Streets West Orange, Inc., attended the meeting to speak on behalf of the coalition. She spoke of the benefits of mixed -use developments, and offered suggestions and site plan changes that would benefit the community. Create a strong pedestrian connectivity throughout the entire area Reduce the crossing distance for pedestrians by making the ingress /egress as tight and narrow as possible (12 -14 feet). Internal pedestrian connectivity should be maximized to get from point A to point B Add additional pedestrian gates Provide sidewalks that are at least 6 feet wide Install pedestrian gates without the need for physical manipulation Ms. Morphy expressed her concern regarding the crosswalk from the southeast side of the development towards the residential area as there is no pedestrian signal for the school children to use. To mitigate, she suggested the installation of an elliptical shaped, single- lane roundabout that would connect the ingress /egress of the proposed development to the existing residential development. If the roundabout is not an option, she suggested to either extend the median so that the crosswalk goes through the median, or to install a pedestrian signal. 3 Planning and Zoning Commission Meeting March 11, 2014 The public hearing was closed. Vice - Chairman McKey asked the developer and City Staff to address Ms. Morphy's suggestions and concerns. Mark Stelli, engineer for the Park Place development, addressed the internal connectivity concern by saying that sidewalks were placed internal to the subdivision to keep pedestrians away from traffic, and therefore safe. The width of the driveway on Maguire Road is 17 feet; this allows emergency vehicles to get through even if there is a vehicle obstructing the driveway. Additionally, the width of the driveway is the minimum width requirement set by the fire department. The width of the ingresses /egresses is 25 feet; this is the minimum requirement by City code and the Florida Department of Transportation (FDOT). Regarding the crosswalk on Tomyn Boulevard, he opined that extending the median will not work because of the minimum traffic radius for the outbound turning movement from the Wesmere development. Adding a traffic signal will cause potential stacking issues. He suggested to direct children to cross at Tomyn Boulevard and Maguire Road intersection where there is a pedestrian signal. Mr. Stelli addressed the waiver for the reduction in the setback by explaining that the setback reduction is in front of the buildings. There still is a separation between the buildings that allows access. Board discussion ensued regarding the access points into the development and pedestrian crossings. Vice - Chairman McKey inquired about the crosswalk on the southeast corner of the development. Mr. Rumer explained that the students would most likely use the gate to the back of the development, and then cross on Maguire Road. Permission has been granted to allow the students to enter through a rear gate of the school. Vice - Chairman McKey suggested adding a raised table at the crosswalk to slow down traffic. Member Marcotte inquired if the crosswalk shown on the site plan is currently non- existent. Mr. Rumer confirmed, and explained that the developer will provide a sidewalk. Member Marcotte inquired regarding the restriction on the north side of Tomyn Boulevard. Mr. Rumer explained that there is an existing stormwater pond; therefore, there is not enough room to provide a sidewalk. Board discussion ensued regarding the physical limitations of that area. Chairman Campbell inquired if the City owns the stormwater pond. Mr. Rumer answered that it is a private pond. Member West, seconded by Member Sills, moved that the Plannin_q and Zonin_q Commission, acting as the Local Planning Agency, recommend to the Ocoee City Commission approval of the Preliminary /Final Large Scale Site Plan and Preliminary /Final Subdivision Plan for Park Place at Maguire located in the Park Place PUD (Project No. LS -2013 -004). Motion carried unanimously. 4 Planning and Zoning Commission Meeting March 11, 2014 MISCELLANEOUS Attorney Review Of The Sunshine Law For Board Members Assistant City Attorney Drage provided the Planning and Zoning Commission with a review of the Florida Sunshine Law, ex parte communications, and voting conflicts. Exhibit A) Discussion Member West inquired if members of the Planning and Zoning Commission can communicate with members of the City Commission regarding upcoming projects. Ms. Drage explained that if the Planning and Zoning Commission voted on the project, and the City Commission will vote on the project, then discussion should not ensue. She further explained that projects will come before each commission for the different phases of development. She continued by saying that such a discussion is not subject to the Sunshine Law as the members serve on two different commissions; however, it is subject to the ex parte communication laws. Vice - Chairman McKey inquired which "parties" are included in ex parte communications. Ms. Drage responded that a "party" is anyone that has an interest in the project; therefore, anyone that lives within the City of Ocoee. She continued by saying that communication regarding a project prior to the hearing should be disclosed on the record at the hearing. This allows the developer the opportunity to address the concerns. She continued by saying that discussions and conversations should be disclosed; however, it does pertain to general comments or opinions made in the member's presence. Member Marcotte inquired if ex parte communications can be disclosed in summary, or must all persons involved in the discussion be named. Ms. Drage responded that a disclosure in summary form is acceptable. The cure to ex parte communication is to base one's vote upon consideration of all the information provided at the hearing. Chairman Campbell thanked Ms. Drage for the informative review. Project Status Report Mr. Rumer informed the board that there are no upcoming projects to warrant a Planning and Zoning Commission meeting in April. Vice - Chairman McKey inquired regarding the status of the Colony Plaza area. Mr. Rumer explained that air -right issues remain; however, he has seen documentation to dissolve the condominium. He continued by stating that recent legislation should help facilitate the dissolution. Board discussion ensued regarding the proposed plans for the area. 5 I Planning and Zoning Commission Meeting March 11, 2014 Member Marcotte inquired if a meeting or workshop could be scheduled with the board members to learn their way of thinking. Mr. Rumer informed the board that there will be Comprehensive Plan Amendments that will allow for creativity for community design. This offers the opportunity to listen to and express different thoughts on development. He also invited the Planning and Zoning Commission members to the Strategic Plan Meeting on April 12, 2014. Member de la Portilla stated that Orange County Public Schools (OCPS) recently rejected two Capacity Enhancement Agreements (CEA) for students at West Orange High School. He inquired if there are pending projects that potentially could be impacted if the relief site issue is prolonged. Mr. Rumer stated that the development of the additional 60 units at Casa Mirella at Belmere PD is on hold because of this issue. ADJOURNMENT The meeting adjourned at 8:18 p.m. ATTEST:APPROVED: Diana Turner, Recording Clerk Bradley Campbell, Chairman 6 Exhibit A The Sunshine Law, Ex Parte Communications, and Voting Conflicts Review GOVERNMENT IN THE SUNSHINE Chapter 286, Florida Statutes What is the Sunshine Law? Florida Statutes Section 286.011 (1) provides that: All meetings of any board or commission of any state agency or authority or of any agency or authority of any county, municipal corporation, or political subdivision, except as otherwise provided in the Constitution, at which official acts are to be taken are declared to be public meetings open to the public at all times, and no resolution, rule, or formal action shall be considered binding except as taken or made at such meeting." What constitutes a "board or commission "? A. All governing bodies and decision making committees. B.Advisory boards that are more than mere fact - finders. A public body cannot escape the application of the Sunsine Law by delegating a job to an alter ego ". Advisory boards with "decision- making" functions (Le. screening applicants for an appointed position) are subject to the Sunshine Law. The courts focus on the nature of the act performed in determining whether a board is decision - making or merely fact - finding. What constitutes a "meeting "? C. An occasion where two or more members of the same board are present (includes presence physically, by telephone, by e-mail, by text, or even when conferring by written documents, including documents transmitted by FAX), and D.Discussion ensues on a matter on which "foreseeable action" will be taken (encompasses entire decision- making process, including briefings, workshops, seminars, etc.). E.Board members may not use e-mail or telephone to conduct a private discussion about board business. Board members may send a "one -way" communication to each other as long as the communication is kept as a public record and there is no response to the communication except at an open public meeting. Accordingly, any "one -way" communications (for example, one board member wants to forward an article to the board members for information) should be distributed by the Board Clerk so that they can be preserved as public records and ensure that any response to the communication is made only at a public meeting. F.While a board member is not prohibited from discussing board business with staff or a non -board member, these individuals cannot be used as a liaison to communicate information between board members. For example, a board member cannot ask staff to poll the other board members to determine their views on a board issue. What are the requirements for a public meeting? G. Location 1.No public meetings may be held at any facility that discriminates on the basis of sex, age, creed, color, origin, or economic status. 2.Accommodations to be made, upon written request received at least 48 hours in advance, for physically handicapped individuals. H.Notice 1.The Statute does not contain any particular notice requirements. 2.The courts have interpreted the intent of the statutes to require reasonable notice ". 3.Except in cases of emergency, special meetings should have at least 24 hours reasonable notice, 4.The notice must include the advice that if a person(s) decides to appeal any decision, he may need to ensure that a verbatim record of the proceedings is made. Minutes 1.Minutes be kept of each public meeting and that they be open to public inspection. 2.Meetings may be tape recorded or video taped, but minutes must still be kept in addition to the recordings. J.Voting 1.All members present at a meeting vote on official actions or decisions unless they comply with the conflict of interest provisions of Chapter 112, Florida Statutes. 2.Roll call votes on all matters are not necessary. 3.Secret ballots are prohibited. What is the effect of a Sunshine Law Violation? K. Sanctions 1.Criminal — Knowing violation of the Sunshine Law is a second degree misdemeanor, with penalties of up to $500 in fines and up to 60 days in jail or both. 2.Civil — Inadvertent violations are civil infractions with penalties not to exceed a $500 fine. L.Validity of actions taken in violation of the Sunshine Law. 1.Actions which have been taken are void ab initio. 2.Members of the general public have standing to sue. 3.Initial action taken in violation of the Sunshine Law can be cured by an independent final action taken in the Sunshine; in other words, start over but in the Sunshine. EX PARTE COMMUNICATIONS What are ex parte communications? Ex parte is a Latin term for "from one party" or "by one party ". It's a legal term generally used when the trier of fact (examples: the Judge, City Commission, Code Enforcement Board, Violations Board) hears from only one side of a matter. What types of communications constitute ex parte communications? In practice, ex parte communications occur when one of the parties contacts or "lobbies" a member of a Board outside of the quasi-judicial hearing where the matter will be heard. It may be in the form of a letter or an e-mail. It may be a face -to -face meeting or a phone call. Ex parte communications violate due process requirements. The opposing party is not aware of the content of the communication and is unable to rebut it or present counterbalancing evidence. Ex parte communications are deemed prejudicial and are inherently improper. All information to be considered should be presented only at the hearing, out in the "Sunshine" where all parties can hear and see the information at the same time. What is your responsibility when it comes to ex parte communications? Seek to avoid them. "Avoid the appearance of evil." If you have engaged in an ex parte communication, disclose it. The party involved, the circumstances surrounding and the substance of the communication should be disclosed on the record at the hearing. Upon disclosure, the opposing party should have an opportunity to respond, What are the potential consequences? Decision may be overturned on a failure to afford due process basis. Willful violation of the Sunshine Law is a second degree misdemeanor (60 days in jail and a fine of up to $500). Removal from office. Noncriminal infraction ($500 fine). Attorney's fees. VOTING CONFLICTS What is a voting conflict? A voting conflict arises when the public official is called upon to vote on: Any measure which would inure to the public officer's special private gain or loss; which he or she knows would inure to the special private gain or loss of any principal by whom the officer is retained or to the parent organization or subsidiary of a corporate principal by which the officer is retained; or which the officer knows would inure to the special private gain or loss of a relative or business associate of the public officer. Section 112.3143, Florida Statutes Who are "public officers "? Any person elected or appointed to hold office in an agency, including persons serving on an advisory body. What constitutes "special private gain or Toss "? Depends on the size of the class who stand to benefit. Bigger - less likely. Smaller — more likely. Consideration is made as to whether the potential gain or loss is remote or speculative. Consideration is made as to whether the matter is procedural or a preliminary issue What constitutes a "principal by whom the officer is retained "? Yes: The employer of the officer. A client of the officer. The corporation on which the officer serves as a paid director. No: The officer's church. The officers landlord. The officer's homeowner's association. A non- profit corporation on which the officer serves as a non -paid director. A customer of an officer's retail store. Which relatives constitute "relatives" under the statute? The officer's father, mother, son, daughter, husband, wife, brother, sister, father -in -law, mother -in -law, son -in -law, and daughter - in-law. What constitutes a "business associate "? Any person or entity engaged in or carrying on a business enterprise with a public officer as a partner, joint venturer, corporate shareholder where shares are not listed on any national or regional stock exchange, or a co- owner of property. What are the voting conflict duties of public officers? Elected officers: Abstain from voting on the measure. Before the vote, publicly state the nature of his or her interest in the matter. Within 15 days file a memorandum of voting conflict (Commission Form 8B) with the clerk of the body. Elected officers may participate in the discussion of the matter. Appointed officers: If an officer chooses not to participate, they must abstain from voting, publicly state the nature of his or her interest in the matter and follow -up with the filing of the memorandum of voting conflict Commission Form 8B) with the clerk of the body within 15 days. If an officer chooses to participate, they must still abstain but must make the disclosure before they participate (as opposed to before the vote). The officer can file the memorandum of voting conflict before the meeting or after the meeting. li ITEM NUMBER IV. A. PUBLIC HEARING SPRING LAKE RESERVE PRELIMINARY /FINAL SUBDIVISION PLAN Mayor Commissioners S. Keller, District 4 florida STAFF REPORT TO:The Planning and Zoning Commission FROM:J. Antonio Fabre, AICP, Principal Planner or. DATE:June 5, 2014 SUBJECT: Spring Lake Reserve PUD Preliminary/Final Subdivision Plan - Project # LS- 2014 -001 ISSUE: Should the Planning & Zoning Commission recommend approval of the Preliminary/Final Subdivision Plan for Spring Lake Reserve? BACKGROUND: The subject property is located on the south side of A.D. Mims Road directly across from the City's Beech Recreation Center. The subject site is approximately 43.21 acres in size of which 17.56 acres are uplands and 25.65 acres are wetlands /surface water. The subject site is currently undeveloped with a variety of trees, wetlands and 100 -year floodplain areas. The subject site is comprised by two (2) parcels identified as Parcel ID numbers 09-22-28- 0000 -00- 038 and 09- 22 -28- 0000 -00 -001. The table below references the future land uses, jurisdiction, existing land uses and zoning classifications of the surrounding parcels: DIRECTION: JPA FUTURE LAND USE / JURISDICTION EXISTING LAND USE / ZONING North Recreation & Open Space / City of Ocoee Beech Recreation Center / "City Park" East High Density Residential / City of Ocoee SFR(s) (Reflections Subdivision) / "R -3" South Conservation - Floodplains / City of Ocoee Spring Lake West Low Density Residential / Orange County Vacant, Undeveloped / "A -1" The Future Land Use designation for the subject site is "High Density Residential" which allows up to 16 dwelling units per acre. To the south there is a "Conservation /Floodplains" future land use designation that is associated with the Spring Lake basin. On February 18, 2014, the City Commission reviewed and approved the PUD Rezoning and Land Use Plan for Spring Lake Reserve. The Planning and Zoning Commission Meeting Date June 10, 2014 Page 2of3 DISCUSSION: The Spring Lake Reserve Preliminary/Final Subdivision Plan (PSP /FSP) is a residential subdivision that proposes a total of 79 single - family detached residential Tots with a requested net density of 4.52 units per acre. It should be noted that the PUD was approved for 99 lots; therefore, the net density and overall development impact is less than what was anticipated in the PUD Land Use Plan. The PSP /FSP is proposed to have a neo- traditional neighborhood design concept similar to The Villages of Wesmere. These include on- street parallel parking, park muse, reduced setback requirements and residential lots with rear loading alleys. The subdivision is proposed to be gated with the residential streets and alleyways been owned and maintained by the homeowners association. The minimum residential lot standards are (24) 50 feet by 110 feet and (55) 40 feet by 78 feet. This residential development is proposed to be constructed in one (1) phase. As shown on the PSP /FSP, the subject subdivision will have one main access from AD Mims Road with a designated left -turn lane. This main entrance will be aligned with the existing Beech Recreation Center access across the street. There is a proposed internal street stub -out for the potential future cross - access of the property to the west. The Plan also shows a 6 -foot high privacy wall with landscaping that will be installed along AD Mims Road. Columns and decorative railings are proposed along the open space portions of the site. Along the eastern and western portion of the site there will be PVC privacy fences. Consistent with City policies, no residential home lots will be on the 100 -year flood plains. Approximately 6.01 acres of wetlands will not be developed and will be designated as conservation areas. It should be mentioned that there is a small wetland area (.009 acre) that is programed to be disturbed. The Applicant has proposed an onsite mitigation program which includes providing additional "Protected Buffer Areas" (1.06 acre). School capacity for the subject development has been determined to be available by Orange County Public Schools. The City's Transportation Planners (Renaissance Planning Group) have agreed with the conclusion that the proposed development will not adversely impact the City of Ocoee's roadway network or intersections. Water & wastewater, reclaimed water, solid waste, police and fire protection will all be provided by City of Ocoee. During the PUD public hearings the Applicant/Developer was agreeable in extending the eastern PVC fence south along the adjacent subdivision recreational area, and a flashing pedestrian crossing sign on A.D. Mims Road both of which are now shown on the plans. The PUD Land Use Plan allowed for an internal roadway along the eastern border. This internal roadway has become significantly shorter. There were also three (3) home Tots that encroached on the wetlands; these lots were removed from the plans. Finally, environmental and wildlife concerns were raised during the PUD public hearings. The Applicant/Developer was agreeable to order a re- inspection of the site. On May 6, 2014, an environmental re- inspection of the site was conducted by Bio -Tech and SJRWMD. During this inspection no endangered species were noted. As a result, the Preliminary/Final Subdivision Plan as proposed is consistent with the approved PUD. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on June 2, 2014 and reviewed the Preliminary/Final Subdivision Plan for Spring Lake Reserve. There were several minor technical issues to be addressed from the City's Planning Division and Engineering Department that were identified in written staff comments and /or presented verbally. There was some discussion on the size width of streets & alleyways, usage of no parking signage and placement The Planning and Zoning Commission Meeting Date June 10, 2014 Page 3 of 3 of the flashing pedestrian crosswalk signage. All of these items were discussed and agreed upon. When the discussion was finished, the DRC voted unanimously to recommend approval of the Preliminary/Final Subdivision Plan, subject to the resolution of the remaining staff comments. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff recommends that the Planning and Zoning Commission recommend approval of the Preliminary/Final Subdivision Plan for Spring Lake Reserve PUD, subject to resolving the remaining staff comments before the City Commission meeting. BACKGROUND: The subject property is located on the southwest corner of Crown Point Parkway and Ocoee Apopka Road. The parcel is identified as parcel number 06- 22 -28- 0000 -00 -067. The parcel is 20.85 acres. The Westyn Bay Commercial Planned Unit Development (PUD) is comprised of 44 single - family units and 6.59 acres of commercial and stormwater /open space. The subject property consists of vacant and undeveloped land. The Future Land Use designation for the subject site is "Commercial ". The rezoning to PUD is required to introduce the residential density. The residential portion of the project is proposed at a maximum of 44 dwelling units. The lot size proposed is 50' x 100' (5,000 sq. ft.) The minimum living area is 1,500 sq. ft. The subdivision will be gated with private streets. The commercial will consist of 6.59 acres of C -2 (Community Commercial) uses. Access to the commercial out parcels will be via an existing curb cut on Crown Point Parkway and right -in /outs on Ocoee Apopka Road. The Westyn Bay Commercial PUD Land Use Plan is a bubble plan indicating uses by tract and access locations. The next step in the development process will be a preliminary subdivision and site plan. This process requires public hearings before the Planning and Zoning Commission and City Commission. The applicant is proposing two waivers with the requested PUD Land Use Plan. The first waiver is from the requirement in the Comprehensive Plan that allows lands with a commercial land use to provide medium and high residential density in a mixed use development. The applicant is requesting a waiver to allow a minimum of 4 dwelling units an acre. The second waiver is from Table 5 -1 Permitted Use Regulations to allow drive in restaurants within two hundred (200) feet from a residential property. The reason for the waiver is because of the mixed use requirement of the PUD, the residential lots will be less than 200 feet from the commercial out parcels. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on June 2, 2014, and reviewed the PUD Land Use Plan for Westyn Bay Commercial PUD. The Development Review Committee voted unanimously to recommend approval of the rezoning to PUD and associated PUD Land Use Plan, subject to completing any outstanding DRC comments. STAFF RECOMMENDATION: Based on the recommendation of the DRC, and the PUD Land Use Plan, Staff respectfully recommends that the Planning and Zoning Commission acting as the Land Planning Agency recommend approval of the rezoning from C -2 (Community Commercial) to PUD (Planned Unit Development) on 20.85 acres of land and approve the associated Westyn Bay Commercial PUD Land Use plan. General The City of Ocoee, Florida (the "City") is subject to the terms, provisions and restrictions of Florida Statutes, Chapter 163, concerning moratoria on the issuance of building permits under certain circumstances. The City has no lawful authority to exempt any private entity or itself from the application of such state legislation and nothing herein shall be construed as such an exemption. This project shall be developed ink) phases. Each phase of the project will stand on its own with respect to public services (sewer, water, stormwater management, access and other related services). Except as specifically noted on this plan, development of the property shall be consistent with the requirements of the City of Ocoee Code of Ordinances (the "Code "), which Code includes Chapter 180, the City of Ocoee Land Development Code (the "land Development Code "). Nothing herein shall be construed to waive any provision of the Land Development Code except to the extent expressly set forth on a waiver table or explicitly set out on the plan. Any damage caused to any public streets as a result of the construction activities related to the project shall be promptly repaired by the Owner to the applicable governmental standards at the Owner's sole cost and expense. There shall be no access from the property to any public streets except at the approved locations shown on the approved Final Subdivision Plan /Final Site Plan. All existing structures (including buildings, power lines, existing aerial and utility facilities) will be removed and /or terminated prior to or during construction of the development replacing those uses. Development of this property is subject to that certain Development Agreement dated as recorded in Official Records Book , Page Public Records of Orange County, Florida. All legal instruments including, but not limited to (i) declarations of covenants, easements and restrictions for the property; (ii) articles of incorporation and bylaws of the property owners' association (the "Association "); and (iii) warranty deeds, easements and bill of sale documents to the Association, the City, the County and /or the St. Johns River Water Management District ( "SJRWMD ") shall be provided to the City for review and approval prior to platting all or a portion of the property. Parking for individual lots shall be provided in accordance with the Land Development Code Each fire hydrant shall be painted OSHA yellow in color and a blue reflective marker shall be affixed to the street in the center of the lane closest to each hydrant. The Owner of each tract shall be responsible for installing reuse lines along with the other subdivision infrastructure. At such time as reuse water is available to the property, the Owner shall be responsible for connection to the reuse system lines. Pursuant to the Land Development Code, all subdivision signage must be consistent with the legally assigned name of the subdivision. Any subsequent change to the name of the subdivision must be approved by the City Commission of the City. To the extent the Land Use Plan and these Conditions of Approval conflict with the Land Development Code, the provisions of the land Use Plan and these Conditions of Approval shall control. Such lift stations shall also be screened with hedge -type shrubbery, such as viburnum or ligustrum. Section B. Trees 1. Existing trees eight feet (8') or larger (other than citrus trees or "trash" trees) located along proposed locations of buffer walls or road right -of -way lines will be preserved if at all possible; the buffer walls and roads will be designed around those trees to incorporate them into required landscape buffers and as street trees. The existing grades on individual lots containing protected trees will be maintained as much as possible to preserve existing protected trees. For lots or tracts containing protected trees, there will be no grading or other construction on the same except as specified in the approved Final Subdivision Plan /Final Site Plan, until building permits are issued for those lots /tracts. Removal of existing protected trees will be limited to clearing road right -of -way and retention areas as detailed in the Final Subdivision Plan /Final Site Plan. All existing protected treason individual lots and tracts will be evaluated at the time of site plan review for that lot or tract, to determine whether or not each tree needs to be removed. In order to ensure that as many existing trees as possible will be preserved, all road rights -of -way and retention areas will be flagged for review by the City prior to any tree removal. No clearing permits will be issued for site work or building construction until the trees to be preserved have been clearly marked with tree protection barriers. No person shall undertake land clearing or the removal of any protected trees without first obtaining a permit from the Building Department. The removal of protected trees shall be minimized to the maximum extent possible and no authorization shall be granted to remove a tree if the Owner has failed to take reasonable measures to preserve the trees on site. The final grading plan will preserve existing grades on individual lots and tracts containing protected trees as much as possible. All landscape areas will be irrigated and have an automatic rain sensor. Section C. Easements /Utilities 2. All cross access, utility and drainage easements shall be provided prior to or at the time of platting. All utilities to be placed within the ten foot (10') easement along the front of each lot will be placed around existing protected trees to be preserved. All utilities including electrical, cable, TV, and telephone and including on -site existing overhead wires shall be placed underground. Unless otherwise noted, a five foot (5') utility and drainage easement will be platted along all side lot lines and ten foot (10') utility, drainage and sidewalk easement adjacent to the street right -of -ways. Sidewalks will only be placed in this easement if necessary o run them around existing protected trees to be preserved. rY nd All drainage, utility and maintenance easements shall be for the benefit of the Association. The land burdened by such easements shall be owned by the individual lot or tract owners. Drainage easements between lots and tracts are shown for location only. Final easement dimensions will be shown on the Final Subdivision Plan /Final Site Plan and will be sized to meet City requirements. A perpetual, non - exclusive access easement over all internal roadways and other paved areas is hereby granted in favor of the City and other applicable authorities for law enforcement, fire and other emergency services. The City may require that the owner execute an easement in recordable form with respect to the foregoing. An emergency access easement to the retention ponds and over all drainage easements shown hereon is hereby granted to the City for emergency maintenance purposes. The emergency access easement will not impose any obligation, burden, responsibility of liability upon the Citytoenteruponthepropertyitdoesnotownortakeanyactiontorepairormaintainthedrainagesystemontheproperty. Section D. Association 3. The Association shall own and maintain all common areas. 4. All declaration of covenants and restrictions affecting the property shall include the following provisions: L Provision allowing the City to levy, collect, and enforce assessments for maintenance of common areas if the Association fails to do so or fails to maintain assessments at a level allowing for adequate maintenance. ii. Provision granting the City the right, but not the obligation, to maintain all common areas should the Association fail to do so after notice from the City. To the extent that the City undertakes such action, the City shall be entitled to reimbursement from the Association and shall be entitled to require the Association to levy assessments for the purposes of paying such reimbursement. iii. Provisions granting the City the right, but not the obligation, to maintain /repair the stormwater management system for the property (the "SWMS ") and obtain reimbursement from the Association, or from the Owner if (a) turnover of control of the members has not occurred; or (b) if the Owner is still responsible for maintenance of the SWMS. iv. Provision providing that the SWMS will be transferred to a responsible operation /maintenance entity acceptable to the City in the event of dissolution and that if dissolution occurs without such approval then the City may continue to levy and collect assessments and impose liens with respect thereto notwithstanding the dissolution of the Association. V. Provision that the Association shall at all times be in good standing with the Florida Secretary of State. Vi. Provision that at the time of turnover of control of the Association to the members, the declarant shall deliver to the new board of directors the maintenance plan for the SWMS accompanied by an engineer's certification that the SWMS is functioning in accordance with all approved plans and permits. To the extent that any such engineer's report indicates any corrective action is required, that declarant shall be required to diligently undertake such corrective action at the declarant's expense and to post a cash bond with the Association for the estimated costsofsuchcorrectiveaction. Vii. Provision that no property owned by the City or any other governmental entity shall be subject to assessments levied by the Association. Viii. Provision that any amendment to any provision affecting the City or SWMS requires the consent of the City in an instrument recorded with the amendment. All tracts that are to be owned and maintained by the Association shall be conveyed to the Association by warranty deed at the time of platting. A special warranty deed is permissible if accompanied by a title insurance policy to the Association. Section E. Streets 5. Final street naming will be coordinated through the City Building Department at the time of final plat submittal. If public streets] All internal roads within the project will be dedicated to the public at the time of platting unless otherwise noted. If private streets] Tract , access road(s) through the property, is a private road which will be owned and maintained by the Association, with access and utility easements granted to the City. Such roads will be conveyed to the Association at the time of platting. If public roads] Street lights, security lights and lighting for common areas meeting current Land Development Code requirements shall be installed by the Owner prior to Certificate of Completion at the Owner's expense. If upgraded street lights are installed, the Owner and the Association will be required to complete and execute a City of Ocoee Owners and Homeowners Association Agreement for Upgraded Street Lights with the Owner and the Association being responsible for operating costs for the difference between standard street lights and the upgradedstreetlights. If private roads] Street lights, security lights and lighting for common areas meeting current Land Development Code requirements shall be installed by the Owner prior to Certificate of Completion at the Owner's expense. The Owner and the Association will be responsible for alloperatingcostsrelatingtosuchlighting. Private Roads] In the event gates are installed on the private roads the gates and subdivision shall comply with Article VIII, Chapter 34 of the Orange County Code for gated communities as well as any amendments to that Article that may be enacted prior to approval of the Final Subdivision Plan. Further, in the event Orange County rescinds or ceases to have regulations for gated communities, then the regulations in effect at the time of Final Subdivision Plan approval shall control. All references in said County Code Chapter to the "County" shall be deemed to refertothe "City" for purposes of this requirement. The Owner shall construct appropriate curbs cuts to enable construction of ramps at all rights -of -way intersections (and other areas as reasonably required) in order to accommodate access to sidewalks and streets for persons who are in wheelchairs and other persons who are physically challenged. Sidewalks abutting each platted lot or tract shall be constructed at the time of development of the lot or tract. When sidewalks are constructed on comer lots at certain locations, the sidewalks will be extended to the curb and the appropriate ramps will then beconstructed. Sidewalks adjacent to common areas shall be constructed at the time of permanent construction of adjacent common areas. Section F. Stormwater Management System 1. All retention ponds will be unfenced with maximum 5:1 side slopes into the pond. The development of this project will incorporate the stormwater needs of all public roads within the project. All building setbacks from all retention areas shall be fifteen feet (16) feet from the top of the bank. Unless otherwise specifically provided for, the SWMS, including all pipes, inlets, manholes, structures and retention ponds, will be owned, operated and maintained by the Association. Notwithstanding the conveyance of the retention ponds to the Association or any provision to the contrary contained in these Conditions of Approval, the Owner shall remain responsible for the maintenance of the SWMS, including all retention ponds, until such time as: i. the entire SWMS for the project is constructed and the appropriate Certificate of Completion is issued by both the City and the SJRWMD; ii. the retention ponds intended to be conveyed to the Association have in fact been conveyed to the Association; iii. the Association is designated as the maintenance entity on the records of the SJRWMD and all transfer records required by the SJRWMD have been executed and accepted by SJRWMD; iv. the City has been provided with a copy of the Owner's proposed maintenance plan with respect to the SWMS; and V. the City has been provided with a written statement from the Association acknowledging receipt of the Owner's proposed maintenance Ian with respect to thePp SWMS and that the Association is responsible for the maintenance of the SWMS. phases. The Owner shall comply with all requirements of the City and other governmental entities with jurisdiction to protect the wetlands being preserved and to prevent any disturbance, siltation, or other construction below the natural wetland lines. Further, the areas below the naturwetlandlinesshallbefencedoff (and silt fences shall be installed) during construction activities immediately adjacent to the wetlands, in order to minimize disturbances of the wetlands during construction. al 9. Wetland and existing surface water impact for this property is regulated by SJRWMD and the Florida Department of Environmental Protection. At the time of submittal of the first Preliminary Subdivision Plan or Site Plan review for the property, the Owner will map the jurisdictional wetland line on the site and establish a twenty-five foot (25') upland buffer from that line. BACKGROUND: General Location: The property is located on the east side of Ocoee Apopka Road, 350 feet north of the intersection of Silver Star Road and Ocoee Apopka Road. Parcel Identification Number: 18- 22 -28- 0000 -00 -057 Physical Address: 325 Ocoee Apopka Road Property Size: Land area for the existing church property is 2.25 acres. Actual land use, proposed land use and unique features of the subject property: The Iglesia Cristiana Sendero De Luz Church consists of a sanctuary and three detached classrooms on 2.25 acres. The Future Land Use classification for this entire property is Commercial" and the current zoning classification is "C -2" Community Commercial. The master plan included three phases. Phase one included a sanctuary, associated parking, and stormwater improvements. Phase two includes a future sanctuary addition and classroom space. Phase three provided for additional parking. The application for Special Exception is to amend the existing church master plan. The church obtained three portables for additional classroom space. Per the special exception plan, the applicant is requesting to phase the development. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on June 2, 2014, and reviewed the Special Exception Plan for Iglesia Cristiana Sendero De Luz. There were several technical issues to be addressed from the City's Planning Division, Engineering Department and Fire Department that were identified in written staff comments and /or presented verbally. All of these items were discussed and changes to the plans were agreed upon. When the discussion was finished, the Development Review Committee voted unanimously to recommend approval of the Special Exception Plan with a condition that the portables are permitted for a period of seven years with an option for a three year extension. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff respectfully recommends that the Planning and Zoning Commission recommend approval of the Special Exception for Iglesia Cristiana Sendero De Luz, for a period of seven years with an option for a three year extension and subject to resolving the outstanding staff comments before the City Commission meeting. BACKGROUND: The Joint Planning Area agreement (JPA) was established with Orange County on February 11, 1994. The agreement provides for annexation boundaries, Land Use designations, and notification requirements. Orange County currently has a JPA with the City of Ocoee and City of Winter Garden. The JPA amendment requested by the applicant includes changes to the JPA Future Land Use designations of lands. The existing approved Land Use Map in the agreement has the two subject parcels identified as Low Density Residential (LDR). The request is to change the parcels to High Density Residential (HDR). The subject parcel is located on the north side of Orlando Avenue and east of South Lakewood Avenue. A portion of the original property is where the new Ocoee Elementary School is being constructed. The subject property is currently used as a blueberry farm with the original residence still located on site. There is not a proposed development proposal before the City at this time. If the JPA Land Use Map is amended as requested, the property is not given any zoning or land use entitlements. In order to propose any development other than what is permitted under the LDR land use, the following steps must take place: a) The property must first be annexed into the City. Annexation is done by a process that requires two public hearings and an additional hearing for the reading of the ordinance, b) An application for a Large Scale Land Use Amendment and rezoning must be made. The process for a Large Scale Land Use Amendment and rezoning requires two public hearings before transmitting the case to the State of Florida Planning Agency, Florida Department of Transportation, Orange County, East Central Florida Regional Planning Council, Winter Garden, Windermere, and Apopka for review and comment, P &Z Meeting Date: June 10, 2014 Project: 19 JPA Amendment c) After the review period of 90 -120 days, the land use can be adopted or denied in a third and final public hearing. DISCUSSION: The proposed JPA amendment requested by the applicant consists of changing the JPA Future Land Use designation on 2.7 acres from Low Density Residential (Four DU /Acre) to High Density Residential (8 -16 DU /Acre). DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION: The Development Review Committee (DRC) met on June 2, 2014, and reviewed the applicant's request. The DRC voted unanimously to recommend approval of the JPA Land Use designation of High Density Residential. STAFF RECOMMENDATION: Staff is supportive of the requested 19 Amendment to the Joint Planning Area Agreement between the City of Ocoee and Orange County providing for an amendment to the JPA Future Land Use Map to change the future land use designation on 16 ± acres from Low Density Residential (LDR) to High Density Residential (HDR).
