MAY 27, 2014
CALL TO ORDER
Chairman Robert Godek called the regular meeting of the Ocoee Code Enforcement Board to order at
7 :01 p.m. in the Commission Chambers at City Hall. Member Carrington gave the invocation, and Vice -
Chairman Lowery led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared
present.
PRESENT: Chairman Godek, Vice- Chairman Lowery, Members Blynder, Carrington, Kelley, and
Osborne. Also present were Asst. Support Services Director - Code Enforcement Manager
Doug Gaines, Code Enforcement Officers Edward Loeffler and Robert Siegrist;
Administrative Assistant Bridgett Coffey, Board Attorney Mary Sneed, and Recording Clerk
Diana Turner.
ABSENT: Member Amey was absent /excused. Alt. Member Hopper was absent,
GUESTS: None.
Administrative Assistant Coffey administered the oath to the code enforcement officers and to anyone
intending to speak regarding a case.

Officer Siegrist presented the case and gave its history. Photos were presented as exhibits. The officer
stated the property was re- inspected today, May 27, 2014, and was observed to be in non - compliance. "The
City is recommending a 10 -day compliance window and $25 per day fine for non - compliance after the 10
days.
The respondent, Charles Porter, addressed the board. He explained that his lawnmower is currently being
serviced; however, the lawn was mowed today [May 27, 20141. Chairman Godek inquired from the
respondent if he called the officer for re- inspection of the property. Mr. Porter replied that he had not.
Member Blynder, seconded by Member Kelley, moved that in Case 414 - 033, the respondents be found in
violation as cited as ofNlay 9, 2014, and be g 31, 2014, to come into compliance, and that no
fine be assessed at this time.

Board Attorney Mary Sneed explained that the Board is not required to impose a fine, but does have the
authority to do so. She asked the Board to take into consideration if the property is found in non - compliance
upon re- inspection. Also for the Board's consideration is if the property is not in compliance, would the
Board want to allow the respondent more time to bring the property into compliance.
Member Blynder remarked that the respondent gave testimony that the issue has been corrected. Ms.
Sneed explained that re- inspection of the property may result in non - compliance, Member Kelley stated
that if the re- inspection concludes that the property is in non - compliance, then the respondent would be
considered a repeat offender. Board discussion ensued regarding imposing a fine.
Motion failed by roll -call vote of 3 to 3, with Chairman Godek, Vice - Chairman Lowery and Member
Carrin -ton dissenting.
Member Osborne, seconded by Member Carrington, moved that in Case 414 -033, the respondents be found

Officer Loeffler presented the case and gave its history. Photos and the City's cost sheet were presented as
exhibits. He continued by saying that this case involved a vacant structure that contributed to a blighted
effect on the neighborhood; however, the property is now in compliance.
Ted Eckbreth, representative of the listing agent, explained to the Board that the violations occurred when
the previous owner had possession of the property. He continued by saying that he was assigned to the
property on March 30, 2014. Shortly after the new owner, Fannie Mae took over ownership of the property.
He continued by saying that after possession of the property, it was quickly brought into compliance.
Member Carrington asked if the neighbors had complained. The officer explained that the property
generated multiple citizen complaints. Member Osborne inquired the City's cost. The officer responded,
"$703.50." Member Kelley inquired from Mr. Eckbreth the timeframe from when Fannie Mae took
possession of the property to when he was assigned to the property. Mr. Eckbreth responded that it was
only a few days. Board discussion ensued regarding the timeframe that the property remained in violation of
City Codes, and the length of time from the new ownership to the date of compliance.
Member Osborne, seconded by Member Blynder, moved that in Case 412 -067, that the Code Enforcement
Board recommend to the City Cornrnission to reduce the fine to the City's cost of $703.50. Motion failed by
roll -call vote of 3 to 3, with Chairman Godek, and Members Carrington and Kellen dissenting.
Member Blynder, seconded by Member Kelley, moved that in Case 412 -067, that the Code Enforcement
Board recornmends to the City Commission that the fine be reduced to the City's cost of'$703.50 and a tine
of $5, 000 for a total of $5, 703.50. Motion failed by roll -call vote o13 to 3, with Chairman Godek, and Vice -
Chairman Lowery and Member Osborne dissenting
Vice - Chairman Lowery, seconded by Member Osborne, moved that in Case 912 -067, that the Code
Enforcement Board recommend to the City Co mmission to reduce the fine to the City's cost of $703.50 and
a fine of $2.500.00 for a total of $3203.50.
Member Kelley asked for Board discussion regarding imposing a fair fine; Board discussion ensued
regarding past practice. Member Carrington stated the minimum fine he feels is acceptable is $5,000, plus
the City's cost. He continued by saying this case was brought forward through citizen complaints and it
lingered for some time. Member Kelley agreed with Member Carrington. Member Osborne stated she felt
that in the past, the City's cost was imposed.
Motion carried by roll -call vote of 4 to 2, wish Members Carrington and Kelley diss entin r.
Chairman Godek advised that the Code Enforcement Board can only recommend the reduction of the fine,
and the respondent will need to appear before the City Commission for the final determination.

the property is vacant and the City wishes to abate the property. He suggested a shorter compliance
timeframe. Officer Siegrist responded the 10 -day window is only a recommendation. Member Kelley
opined that once the property is abated, and in compliance, the fine no longer stands.

Officer Loeffler informed the Board that the respondents are in full compliance with the Code Enforcement
Board's orders.

COMMENTS
Assistant Support Services Director Doug Gaines — stated that the City Commission goes through the
same trials and tribulations as the Code Enforcement Board regarding fine reduction cases. They take in
account if the violations caused a public nuisance; were a danger to the public; how long neighbors had to
deal with the issues; citizen complaint; and how much cooperation the City received from the past /current
owner.
Officer Loeffler - showed before /after photos of a property.
Member Kelley — requested that City Staff use more concern and consideration when recommending
compliance windows and fines, and to request realistic fines and timelines. Mr. Gaines responded that if the
impact on the public's health /safety is not high, then the City recommends 10 -day compliance and $25 per
day fine; however, it is only a recommendation to the board. The board may use discretion in determining a
compliance timeframe and fine amount.
Vice- Chairman Lowery -- stated that the information the Board receives is not the full picture, and feels the
Board is pulling strings to get the full picture. He also commented that the City is doing a great job.
Member Carrington — keep up the good work!
Chairman Godek —commended staff for a job well done.
