Background Summary:
Phase I Center Street 100-year retention pond is currently under construction and is scheduled for completion by
May II. 2006. The design of Phase II Center Street stonnwater improvements is now complete and the construction
phase was originally scheduled for in FY 2006-07 due to funding shortfall. Staff has determined that it is in the best
interest of the City to construct as much Phase II improvements as funding allows by issuing a Change Order to tlle
Phase I contract to Gibbs & Register. Inc. This action is necessary to (1) prevent potential erosion and damage caused
by uncontroHed flooding to the pond currently under construction. (2) to realize costs and time savings by advancing a
major portion of the Phase II improvements. and (3) avoid construction of temporary elements which is usually
necessary for multi-phased projects. Contractor has submitted a cost proposal for a net amount of $385.000 after a
$59.694 credit for fill material sold by the City to the contractor from the Phase I pond and for pipes and inlets which
would become unnecessary if this Change Order is approved. The improvements under this Change Order includes all
improvements as designed by PEC from Station 13+10 to Woodson Avenue as described on PEes plans OE-393 with
the exception of the asphalt pavement which will be constructed by City's asphalt contractor.
Issue:
City Commission to approve Change Order #1 for $385,000.00 to Center Street Pond, Bid #B05-12.
Recommendations
Staff respectfully requests that City Commission approve Change Order #1 for $385,000.00 to Gibbs & Register, Inc. to
construct a portion of the Phase II collection system improvements from Station 13+10 to Woodson Avenue as depicted
on PEC's Project Plans OE-393.

ISSUE
Should the City Commission approve Change Order #1 to Gibbs & Register, Inc. for $385,000.00 to construct a
major portion of Phase II, Center Street collection system?
BACKGROUNDIDISCUSSION
Phase I Center Street 100-year retention pond is currently under construction and is scheduled for completion
by Mayll, 2006. The design of Phase II Center Street stormwater improvements is now complete and the
construction phase was originally scheduled for in FY 2006-07 due to funding shortfall. Staff has determined
that it is in the best interest of the City to construct as much Phase II improvements as funding allows by issuing
a Change Order to the Phase I contract to Gibbs & Register, Inc. This action is necessary to (1) prevent potential
erosion and damage caused by uncontrolled flooding to the pond currently under construction, (2) to realize
costs and time savings by advancing a major portion of the Phase II improvements, and (3) avoid construction
of temporary elements which is usually necessary for multi-phased projects. Contractor has submitted a cost
proposal for a net amount of $385,000 after a $59,694 credit for fill material sold by the City to the contractor
from the Phase I pond and for pipes and inlets which would become unnecessary if this Change Order is
approved. The improvements under this Change Order includes all improvements as designed by PEC from
Station 13+10 to Woodson Avenue as described on PEC's plans OE-393 with the exception of the asphalt
pavement which will be constructed by City's asphalt contractor.
An estimated $385,000 can be made available from FY 2005-06 Stormwater Operating Funds and Stormwater R & R
Funds which include a $4,000 savings from purchase of street sweeper, $15,800 from cancelling pole camera purchase
budgeted in the current year, $198,500 from the increase in stormwater utility fees, and $166,700 currently budgeted
(Operating and R&R) for Phase n construction. The paving will be funded by deferring the pavement rehabilitation
project on Blackwood Avenue for $27,000.
RECOMMENDATION
Staff respectfully requests that City Commission to approve Change Order #1 for $385,000 to Gibbs & Register
for the construction of Phase II improvements from Station 13+10 to Woodson Avenue; and direct staff to issue
a Purchase Order to Gibbs & Register, Inc.

SCOPE OF WORK FOR CHANGE ORDER #1
This Change Order #1 is for the purpose of constmction of stonnwater collection system and roadway elements
(curb & gutter, sidewalks, roadway base, sub-base, etc.) as designed by Professional Engineering Consultants, Inc.,
on their Job No. OE-393, from Station 13+10 to Woodson Avenue. Asphalt pavement is excluded from this Change
Order #1 with Gibbs & Register and will be constructed by the owner's contractor under a separate contract.
APPROVAL AND CHANGE AUmORIZATION
This proposed change to the Contract is to be approved by the Ocoee City Commission
Acknowledgements:
The aforementioned change, and work affected thereby, is subject to all provisions of the original contract not
specifically changed by this Change Order; and.
It is expressly understood and agreed that the approval of the Change Order sba1l have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in
contract amount and time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other
claim for increased costs of performance or modifications of time will be granted by the OWNER for the WoIk
covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time
against the OWNER arising from or relating to the matters or Work set forth or contemplated by this Change Order.
