Background I Discussion: The Steak 'n Shake property is located on the north side of SR 50, east of the Chick-fil-A restaurant. More specifically, the subject property comprises Tract D of the Walmart subdivision and the C-3 zoned property located west of Tract D. The property is currently vacant and contains a mix of mature trees and vegetation. The Steak 'n Shake small-scale site plan proposes a 4,000 square foot fast-food restaurant with 52 parking spaces. The subject property comprises of 0.97 acres and is zoned Community Commercial, C-2 and General Commercial, C-3 and is designated as Commercial on the Future Land Use Map (FLUM). In order to proceed with the current site plan, which is under review by Staff, the applicant has requested six waivers from the Land Development Code (see attached waiver table). Below is a synopsis of the six waivers being requested by the applicant; Staff is in support of all waivers requested. The applicant is requesting a reduction in the side (west) landscape buffer and the rear (south) landscape buffer to allow for adequate vehicular travel lanes and parking. Further, they are requesting to allow the dumpster enclosure to encroach into the southern landscape buffer. Because the restaurant includes a drive-thru facility, a reduction in the building perimeter landscape buffer is being requested at the drive-thru window. Further, the subject property's lot size is less than the required 1-acre (0.97 acres), therefore a waiver request is being proposed by the applicant. Finally, stormwater for the Steak 'n Shake site is being discharged into the Ocoee Commerce Center master retention pond. To allow for this, the applicant is requesting a waiver because the stormwater is not being retained on-site. Recommendation: Staff respectfully recommends that the Mayor and City Commissioners approve all six waivers, subject to the approval of the small-scale site plan. BACKGROUND / DISCUSSION The Steak 'n Shake property is located on the north side ofSR 50, east of the Chick-fil-A restaurant. More specifically, the subject property is a combination of Tract D of the Walmart subdivision and the C-3 zoned property located west of Tract D. The property is currently vacant and contains a mix of mature trees and vegetation. The Steak 'n Shake small-scale site plan proposes a 4,000 square foot fast-food restaurant with 52 parking spaces. The subject property comprises of 0.97 acres and is zoned Community Commercial, C-2 and General Commercial, C-3 and is designated as Commercial on the Future Land Use Map (FLUM). To the north of the subject property is right-of-way associated with SR 50 (Colonial Drive) and further to the north is vacant property and wetlands associated with Lake Bennett. This property is zoned Community Commercial, C-2 and is designated as Conservation/Floodplains and Commercial on the FLUM. East of the subject property is the Chick-fil-A fast-food restaurant zoned Community Commercial, C-2, and designated as Commercial on the FLUM. To the west is the master retention pond for Ocoee Commerce Center in addition to properties associated with the center. These properties are zoned Community Commercial, C-2, and designed as Commercial on the FLUM. South of the property is the Walmart Super center zoned General Commercial, C-3 and designated as Commercial on the FLUM. CRITERIA The City Commission has sole discretion to approve waivers from Code requirements based upon four criteria: 1. If the project is part of an integrated and master planned development; 2. If the project is compatible with surrounding developments; 3. If the project imposes no impacts on City infrastructure greater than that generated by other uses normally permitted in the underlying zoning districts; and lor, 4. If the project provides an offsetting public benefit which is technically sound and measurable. PROCESS Because a small-scale site plan is administratively reviewed, the City Commission will not be acting on the site plan approval. The City Commission will be reviewing the waiver requests only. After the City Commission takes action on the waiver requests, Staff will complete its review of the site plan, ensuring that it is consistent with all Land Development Code requirements except for any waivers that may be approved by the City Commission. ST AFF RECOMMENDATION Staff respectfully recommends that the Mayor and City Commissioners approve all six waivers, subject to the approval of the small-scale site plan.
