Exhibit A of the attached Stormwater Fee Increase Resolution includes the monthly as well as the annual fees. The sliding-scale model considers a scaled fee distribution for the residential category based on the gross square footage of the impervious areas. Both the "flat-fee" and the "sliding-scale" models are projected to produce an equal sum of revenues in the target years. The recent amendment to Chapter 150 of the City Code modified and expanded the properties subject to a stormwater fee to include Category A-residential with four (4) distinct classes based upon the gross square footage, Category B- residential condominiums, Category C- developed non-residential properties, and Category D- vacant land. Issue: Should the City Commission adopt the Stormwater Utility Fee Increase Resolution based on a sliding scale model? Recommendations Staff respectfully requests that City Commission approve and adopt the Resolution. Attachments: Stormwater program presentation. Financial Impact: If implemented, the stormwater utility fees will fund a $12.2 million dollar 5-year program to include the operating as well as the capital improvement projects. The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Section 150-6 of Article II of the Code of Ordinances of the City of Ocoee, Florida; Article VIII of the Constitution of the State of Florida; and Chapter 166, Florida Statutes. SECTION 2. Stormwater Utility Fees. The City Commission of the City of Ocoee hereby adopts and approves the STORMW A TER UTILITY FEES as set forth in Exhibit "A" attached hereto and by this reference made a part hereof. The rates established in Exhibit "A" of this Resolution shall apply to all bills issued on or after April 1, 2006. SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
