ISSUE
Should the City Commission approve Change Order #1 to Professional Engineering Consultant's Contract for
$37,207.61 to provide expert assistance services for Maguire Road Phase V?
BACKGROUNDIDISCUSSION
The design phase of the Maguire Road Phase V, which includes roadway widening from Mercantile Court to
Geneva Street, is now substantially complete by Professional Engineering Consultants (PEC). In order to assist
legal staff with the acquisition of the necessary right-of-way, PEC has submitted a proposal for $37,207.61 to
provide analysis and expert assistance for parcels 101, 102, 103, 104, 105, 106, 107, 108, and 109. A copy of
the proposal is attached to this staff report. The scope of work will include the necessary analysis and
investigation to support the legal staff in the eminent domain proceedings.
Funds have been programmed and are available from the road impact fee funds for the services.
RECOMMENDATION
Staff respectfully requests that City Commission to approve the Change Order #1 for $37,207.61 to PEC to
provide services for right-of-way acquisition phase of Maguire Road Phase V project.

CONSULTANT acknowledges, by its execution and acceptance of this Change Order, that the adjustments in Fee
and Time sho'wn hereon constitute full and complete compensation al1d satisfaction for all costs and modifications of
performance time incurred by the CONSULTANT as a result of this Change Order. No other claim for increased
costs of perfonnance or modifications of time will be granted by the OWNER for the Work covered by this Change
Order. The CONSULTANT hereby waives and releases any further claims for cost or time against the OWNER
arising from or relating to the matters or Work set forth or contemplated by this Change Order.

As requested, we are forwarding our scope of services for the referenced assignment in response to
your request for expert assislance on the subject eminent domain issue. The properties are located
on ]\vlaguire Road in Deoce, Florida.
Parcels 101 and 102 - No work.
Parcel 103
We will provide a window survey of the front of the property and before and after exhibits of the
area of acquisition and the remainder. We will identify items within the area of acquisition and
provlde a cure where necessary. We will identify property zoning, allowable uses and any non
conformities, and impacts on ingress and egress. Our final product will be a letter report and
exhibits indicating our findings.
Parcel 104
We will provide a full site survey of the of the property and before and after exhibits of the area
of acquisition and the remainder. We will identify items within the area of acquisition and provide
a cure where necessary: we will pay particular attention to the on site diSpOsal system (OSDS) to
determine if can continued in use or if the property must be connected to the City's central system.
We will identify property zoning, allowable uses, and any non-conformities. We will provide
vehicular turnlng movement exhibits based on the Autoturn software program. We will relocate lost
parking as a part of our cure analysisooOur final product will be a letter report and exhibits indicating
our tindings. We will utilize the services of Point Four Engineering to assist in the OSDS analysis.
Parcel 105
We will provide a window survey of the front of the property and before and after and after exhibits
of the area of acquisition and the remainder. We win identify items within the area of acquisition
and provide a cure where necessary. We will identify property zoning, allowable uses and any non
conformities. W ewill provide vchiculartuming movement exhibits based on the Autoturn software
program to detemline change in circulation. We will evaluate a shared driveway with Parcell 06.
Our tinal product will be a letter report and exhibits indicating our findings.

Attached is a flat fee' proposal from PEe in the amount of $37,201.61. The scope of services is for expert
assistance needed to do the appraisal work on the Maguire Road project. Almost every property we impact on
this road alignment is improved and the appraiser needs to do before and after reports on each parcel. The
services to be provided by PEe are the survey work and cure analysis addressing our impacts. I have reviewed
the proposal and find the fee to be reasonable. Please authorize me to engage PEe to do this work.

ADDENDUM NO. 005 TO
AGREEMENT FOR CONSULTING ENGINEERING SERVICES
INCLUDING
ENGINEERING SERVICES FOR
MAGUIRE ROAD (PHASE Vl - DESIGN PHASE SERVICES AND
CONSTRUCTION ADMINISTRA nON SERVICES
This Addendum No. 005 hereinafter called the Addendum, as of this ~ ~ day
of 1= c' t a It ta.t 2001, shall constitute an Addendum to the Agreement for Consulting
Engineering Services between the City of Ocoee, Florida (the CITY) and Professional
Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Bola Centre,
Orlando, Florida (the CONSULTANT), dated the 21st day of August, 1984, hereinafter
referred to as the AGREEMENT.
WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the
CITY retained the CONSULTANT to provide professional engineering services as
required from time to time, and WHEREAS the CONSULT ANT will perform consulting

engineering services for the CITY as herein defined.
NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter
set forth on the part of both parties to be kept and performed, the parties do mutually
agree as follows:
Section 1 - Services of the Consultant
1..1 The CONSULTANT shall peIform the EngineeIing Services as outlined in the
attached proposal (P-0258) dated January 4, 2001 relative to the provision of
design phase services and construction administration services to the CITY"
Section 2 - Compensation
2.1 Compensation by CITY for engineering services for the Maguire Road (phase V)
- Design Phase Services and Construction Administration Services is provided
under this Addendum shall be computed under Paragraph 6.1.2.3 of the
Agreement, utilizing the Lump Sum Method of Compensation with the
compensation for this authorization not-to-exceed $345,825.00 as outlined in the
attached proposal (P-0258) and man-hour fee.
Section 3 - Time of Completion
3.1 The CONSULT ANT shall provide the design services within a 360 day
period (12 months) from the notice to proceed, and the construction
administration services within a 360 day period (12 months) from the notice to
proceed as outlined in the attached proposal.
IN WITNESS WHEREOF, the parties have executed this Addendum No. 005 the day
the year hereinabove set forth"

Dear Mr. Shira:
Professional Engineering Consultants, Inc. (pEe) is pleased to present the enclosed
proposal for' professional engineering design, permitting and construction phase services
concexning the widening of Maguire Road (phase V) from Mercantile Court to Story
Road.
PEC proposes to provide roadway design, permitting and construction phase services for
a total amount not to exceed $345,825. This includes survey, roadway, drainage and
traffic design ($155,487), utility relocation design ($67,817), construction
administration services ($115,021) and direct reimbursables ($7,500)..
As a component of the construction adminisuation services, we have included
subconsultant fees for PSI, Inc. (materials testing services). PEe will provide project
management, shop drawing review/approval, contract administration and construction
inspection management services. The on-site resident project r'epresentative (inspector)
will be provided by the City (Rod Wmfrey) and will be supervised by PEC's Project
Manager (Bob Rudd, P.E.) similar to the existing construction management services
cun'ently underway on Maguire Road south of S. R. 50. This proposed combination of
City staff and consultant will save' substantial expense fOl' the City and provide
professional inspection services.
The construction administration services of this proposal is based on the assumption that
the proposed Maguire Road (phase V) improvements will be added to the existing
Maguu'e Road construction project as a change order to the existing consuuction
contract. Our proposal does not provide for a stand-alone construction project with
bidding phase services.
