ACTING AS THE LOCAL PLANNING AGENCY
MEETING HELD TUESDAY, OCTOBER 14, 2014
CALL TO ORDER
Chairman Campbell called the meeting to order at 7:03 p.m. Following a moment of silent
meditation and the Pledge of Allegiance to the Flag, a quorum was declared present.
PRESENT: Vice - Chairman McKey, Members de la Portilla, Dillard, Dunn, Marcotte, Sills,
and West. Also present were City Planner Rumer, Principal Planner Fabre,
City Attorney Cookson and Recording Clerk Turner,
ABSENT: Chairman Campbell and Member Keethler were absent excused.
CONSENT AGENDA
Minutes of the Planning and Zoning Commission Meeting held on Tuesday, September 9,
2014.
Member Sills, seconded by Member West moved to accept the minutes of the
September 9, 2014, Planning and Zoning Commission meeting. Motion carried
unanimously.
OLD BUSINESS - none
NEW BUSINESS
City Planner Rumer explained that properties subjected to public hearings must be
posted for 12 days, however, some of the agenda items were not sufficiently posted as
many items were brought on at the last minute. They will, however, be sufficiently posted
prior to the City Commission meeting.
City Attorney Cookson advised that the public hearings for each agenda item will still
need to be opened and closed.
Ocoee Pines — Amendment to the PUD /Land Use Plan
Principal Planner Fabre gave a brief presentation with exhibits of the proposed project.
The Ocoee Pines PUD property includes approximately 101 acres of land and is generally
located northwest of Clarcona -Ocoee Road and southeast of Forest Lake Golf Course.
The property is currently vacant, wooded and undeveloped. The future land use
designation is Low Density Residential and the requested initial zoning classification is
Planned Unit Development (PUD).
On July 17, 2007, the Ocoee Pines PUD was officially approved by the City Commission
with a mixture of single - family residence (SFR) and a Townhome (TH) component. On
November 4, 2008, the Final Subdivision Plan (FSP) was approved by the City
Commission with 189 SFR and 154 TH units. The site is partially cleared but never
finished due to the previous owner /developer defaulting on the FSP project. The Land Use

Plan originally indicated townhomes on the northeast portion of the PUD; however, due to
the current market conditions, the applicant has modified the plan to include only single -
family as the primary residential use. As a result, the overall density has been reduced (62
units less) to a total of 281 SFR.
Accordingly, the Land Use Plan and Conditions of Approval were amended to reflect the
Applicant's request. The following modifications are proposed with this amendment
submittal;
• No townhome component;
• Maximum number of dwelling units 281;
• The amended residential lots indicate: Lot Type 1 = 109 (75'x 115') with a minimum
living area of 2,000 square feet, and Lot Type II = 172 (50' x 120') with a minimum
living area of 1,800 square feet.
On October 8, 2014, the DRC met and voted unanimously to recommend approval of the
Amendment to the Ocoee Pines PUD, subject to resolution of the remaining staff
comments.

Member Marcotte, seconded by Member Dunn, moved that the Plannin_g and Zonin_g
Commission recommend to the Ocoee City Commission approval of the
Amendment to the PUD Land Use Plan for Ocoee Pines, subject to resolvinq the
remainin_g staff comments before the City Commission meeting. Motion carried
unanimously.
Ocoee Pines Parcels A -D — Annexation and Rezoning to PUD
Principal Planner Fabre gave a brief presentation with exhibits of the proposed project.
The subject parcels ( +/ -.84 acres) are vacant and undeveloped. In 2006, the surrounding
property was re- platted as "Ocoee Pines" and annexed into the City of Ocoee. The subject
parcels were not included as part of the Ocoee Pines annexation completed in 2006
because of lack of ownership at that time. The subject parcels are now owned by the
Ocoee Pines (JTD Land at Ocoee, LLC) developers and are being requested be part of
the existing Ocoee Pines PUD. The parcels are considered contiguous to the City.

The Applicant /Owner has requested a City of Ocoee zoning designation of PUD, which is
consistent with the zoning of adjacent properties. The PUD designation is consistent with
the adopted future land use designation of Low Density Residential.
Mr. Fabre continued by explaining that parcel A is a remnant of a right -of -way of the
former row of South Park Row; parcel B is a remnant of a right -of -way of the former row of
Jay Street; parcels C and D were old historic lots.

Member Marcotte inquired if parcels A & B were vacated City right -of -ways. Mr. Fabre
explained that the right -of -ways were part of the original plat and never developed. City
Attorney Cookson explained that the parcels were public right -of -ways that were vacated
after the adjacent property was annexed into the City. Further discussion ensued.

Member Dunn, seconded by Member Marcotte, moved that the Planning and Zoninq
Commission, actin_g as the Local Planning Agency, recommend to the Ocoee City
Commission approval of the Annexation of the parcels of land known as Ocoee
Pines Parcel A -D with an initial zoning classification of "PUD ". Motion carried
unanimously.
Ocoee Pines Parcels E -F — Annexation and Rezoning to PUD
The two subject parcels ( +/ -.22 acres) are now owned by the City of Ocoee through
eminent domain. The parcels are planned to be incorporated into the Ocoee Pines PUD
with the stipulation to be used (right -of -way, recreation, public facility, et. al.) for a public
purpose. The future land use designation is Low Density Residential and the requested
initial zoning classification is PUD.

Vice - Chairman McKey inquired if the City sold parcels E & F to Ocoee Pines PUD. City
Attorney Cookson explained the City charged the developer for the cost incurred to
acquire the parcels, approximately $30,000 per lot.

Commission, actin_g as the Local Planninq A_gency, recommend to the Ocoee City
Commission approval of the Annexation of the parcels of land known as Ocoee
Pines Parcel E & F with an initial Zoning classification of "PUD ". Motion carried
unanimously.
McCormick Reserve — Annexation, Rezoning to PUD and Land Use Plan
Principal Planner Fabre gave a brief presentation with exhibits of the proposed project.
The subject property is located on the south side of McCormick Road, east of Ingram
Road and west of N. Clarke Road. The City abuts the property from the south, east and
west. The subject site is approximately 45.09 acres in size of which 43.57 acres are
uplands and 1.52 acres are designated as wetlands. The site is currently undeveloped
with planted pine trees, a SFR with accessory buildings (programmed to be removed when
the property develops), wetlands and 100 -year floodplain areas.
The Future Land Use designation for the subject site is "Low Density Residential" which
allows up to 4 dwelling units per acre. To the east there is a "Conservation /Floodplains"
future land use designation that is associated with the Trout Lake basin. The requested
rezoning would be from Orange County Agriculture (A -1) to City of Ocoee Planned Unit
Development (PUD) with a corresponding Land Use Plan (LUP).
The McCormick Reserve PUD /Land Use Plan is a planned residential subdivision that
proposes a total of 133 single - family detached residential lots with a requested density of
2.95 units per acre. The residential streets (50' wide) are planned to be designated as
public right -of -ways. The residential lots will be approximately (106) 50 feet by 120 feet
and (27) 60 feet by 120 feet.
The subject subdivision will have two (2) access points.. The main access will be on N.
Clarke Road. This main entrance will be aligned with the existing Kensington Manor
Subdivision access across the street. The second access is proposed through an internal
street providing cross - access to the (Brynmar Subdivision) west. The Plan also shows a 6-
foot high brick wall with landscaping will be installed along McCormick Road and Clarke
Road. Landscaping, columns and aluminum railings are proposed along the open space
portions of the site.
It should be mentioned, that there is a wetland area (1.366 acres) that is programed to be
impacted. This wetland area is of little or no environmental value. It is presumed that it
was an old barrow pit which overtime has accumulated wetland characteristics. The
subject area has transitional and exotic species and wetland understory vegetation and
extremely weak hydric characteristics. Moreover, the impact area is mostly cause for the
right -of -way and construction of the Clarke Road extension. The Developers' Agreement
will address the Clarke Road extension. The Applicant has proposed an onsite mitigation

program which includes providing additional buffer area "Tract E" (2.6 acres) conveyed to
the City.
The DRC met on October 8, 2014, and voted to recommend approval of the Annexation,
PUD Rezoning and Land Use Plan, subject to resolution of the remaining staff comments.
City Planner Rumer explained that the property is raw land. He continued by saying that
the City is within the Wekiva Study Area, and this property exhibits features of the Wekiva
Protection Area ( "A" grade soil). As this is so, and as required by the City's
Comprehensive Plan, 35% of the project must remain open space,
Discussion
The applicant, Richard Wohlfarth, stated his concurrence with city staff's
recommendation of the project and entertained comments and questions from the Board.
Vice - Chairman McKey requested the applicant clarify the boundaries of the brick wall and
railing. The applicant satisfied the vice - chairman's request.

Member de la Portilla, seconded bV Member Dunn, moved that the Planninq and
Zoning Commission recommend to the Ocoee City Commission approval of the
Annexation, PUD Rezonin_g and Land Use Plan for McCormick Reserve, subject to
resolving the remainin-g staff comments before the City Commission meeting.
Vice - Chairman McKey inquired if there are any major outstanding issues that need to be
resolved. Mr. Fabre stated that the Developers' Agreement must be finalized.
After discussion, the motion carried unanimously.
Homes in Partnership (2 Street) — Annexation and Rezoning to PUD
City Planner Rumer gave a brief presentation with exhibits of the proposed project. He
explained that Homes in Partnership is a corporation from Apopka that purchases land
and develops homes for families that qualify for USDA grants.
The two subject parcels ( +/- .31 acres) are vacant and are located on the west side of 2nd
Street and approximately 250 feet north of the intersection of Nay Avenue and 2nd Street.
The subject property is located within the Ocoee - Orange County Joint Planning Area
(JPA) and is being considered for annexation as outlined in the JPA Agreement. City staff
is concurrently requesting rezoning of the property to R -1 (Single - Family Dwelling). City

staff has requested a City of Ocoee zoning designation of R -1 (Single - Family Dwelling),
which is consistent with the zoning of the adjacent Orange County properties. The R -1
zoning designation is consistent with the adopted future land use designation of Low
Density Residential.
The property is not serviced by sewer; however, the two lots will connect to City water.
Discussion
Member Sills inquired if the properties will be on septic tanks. Mr. Rumer explained that
there is not sewer connection in the area so they will need to be on septic. Further
discussion ensued regarding septic tanks.

Member Dillard, seconded by Member Dunn, moved that the Planning and Zonin_g
Commission, actin_g as the Local Plannin_g A_gency, recommend to the Ocoee City
Commission approval of the Annexation of the +/- 0.31 acres known as the Homes
in Partnership 2 "' Street, with an initial Zoning classification of "R -1 ". Motion
carried unanimously.
Homes in Partnership (2 and Whittier Avenue) — Annexation
City Planner Rumer gave a brief presentation with exhibits of the proposed project. The
six vacant subject properties ( +/ -.93 acres) are located on the west side of 2 nd Street and
east side of Whittier Avenue, approximately 150 feet north of Silver Star Road. The
subject property is considered contiguous to the City of Ocoee since it is bordered by
property located within the City limits on the east.
Currently, in the JPA, the City designated the lots as "Professional Office "; therefore, the
case is to only annex the property and will not be rezoned as it does not meet the City's
conventional zoning classification.

Ocoee City Commission approval of the Annexation of the +/- 0.93 acres parcel of
land known as the Homes in Partnership 2 nd and Whittier Avenue Parcels. Motion
carried unanimously.
MISCELLANEOUS
Project Status Report
City Planner Rumer informed the Board of the following:
• Development for Popeye's Restaurant is on hold as their corporate office is looking
at a development site in a neighboring city.
• The City Commission recently approved the Kids Community College project and
the final site plan for Arden Parke
• Currently reviewing a few site plans: one on the east side of Clarke Road, across
from the Dollar General, and one on Tomyn Boulevard.
• The All Sports Memory Care facility will not be developed; however, an application
has been received for an independent senior living facility near that site.
• There will not be a Planning and Zoning Commission meeting in November.
Member West inquired regarding the Nemours Children's Hospital. Mr. Rumer explained
the hospital has purchased two lots in the Meadow Ridge commercial plaza for a pediatric
and rehabilitation center.
Vice - Chairman McKey announced:
• The CRA Budget meeting is October 21
• The CACOPD meeting is October 23
• The Haunted House will be open on the 18 24 ", and 25th
