MINUTES OF THE BOARD OF ADJUSTMENT MEETING HELD
NOVEMBER 12, 1990
CALL TO ORDER
The meeting was called to order by Vice - Chairman Colburn at 7:43
p.m.
PRESENT: Vice - Chairman Colburn, Members: Rhodes, Boggs, Alternate:
Foster, Miller (arrived late), Planning Director Behrens, Secretary
King.
ABSENT: Chairman Beatty, Member: Steve Wix
OLD BUSINESS
Board Member Rhodes moved to approve the August 13, 1990 Board of
Adjustment Meeting Minutes. Board Member Boggs seconded and the
motion was approved unanimously.
NEW BUSINESS
CASE NO. 1- 7SE- 90:GOINS
Vice - Chairman Colburn opened the public hearing by reading the
title of the staff report for the continued public hearing from
August 13, 1990, to request a special exception of the proposed
automotive retail tire sales store in Good Homes Plaza.
Bruce Behrens, Director of Planning stated that the owner of the
tire store requested a special exception in a "C -2" zone in Good
Homes Plaza. At the August 13, 1990 Board of Adjustment public
hearing it was determined that the board members did not have
sufficient information on the noise level of the tire store and
such would have to be provided before a recommendation. Upon the
request of the Board of Adjustment, City Staff, Allen Goins (the
developer) and Lynn Skipper (representing the Rose Hill Homeowners
Association), conducted several decibel reading tests both at the
proposed tire store location and at the Allied Discount Tire Store
located on Silver Star Road in Pine Hills. The outcome of the
tests indicated that the decibels did not exceed the permitted 70
decibels (per City Code).
The buffer wall on the north side of the property has been
installed and the developer has agreed to additional landscaping
between the northern boundary wall and the tire shop in order to
further muffle sounds as well as enhance the appearance of the tire
‘Ire shop as viewed by the Rose Hill subdivision residents.

As requested in a motion from the August 13, 1990 Board of
Adjustment meeting, define "closed facility ". Planning Director
Behrens stated that closed facility means that no work should be
conducted outside the building, in the area between the building
itself and the northern buffer wall.
Planning Director Behrens read to the board members Section 4.5
Powers and Duties, from the Zoning Ordinance of the City of Ocoee.
Behrens stated the staff's recommendation was to approve the
special exception. Behrens closed and asked for comments from
Gretchen Jacobs.
Gretchen Jacobs, 9127 Queen Elizabeth Court, Orlando, Florida 32818
(Rose Hill Subdivision Homeowners Association) stated that she
would like to include in the minutes a few safe guards and they are
as follows: (1) the noise; and (2) that the property continue to
look as good as possible - (a) guarantee that business would not be
conducted between the store and the wall, (b) no storage of tires
outside of the buildings, (c) no leaving compressor on and/or put
timer on compressor. Gretchen would like to see in the record that
these safe guards have been given. Then the H.O.A. would feel
better.
Gretchen stated that the H.O.A. loves the way the shopping center
looks and they are excited about the wall.
Another concern of the H.O.A. is the landscaping. Gretchen stated
that there has been some discussion by Allen Goins that if the wall
is not enough of a barrier then he would consider raising the wall
two feet (2'). Gretchen wanted to know what could be done to the
wall since it was not a brick wall.
Lynn Skipper, 9126 Queen Elizabeth Court, Orlando, Florida 32818,
commented about a living wall - that a time frame of the trees
depending on the type of trees may take years. Gretchen commented
that she would like to talk to the landscapers on the design of the
living wall. Rocky Goins did not see any problems in this request.
Rocky Goins stated for the record that they (A.G. Development
Group) are here to stay and they want to do what is right for the
community. Rocky commented that the wall was a very expensive
Norwegian brick wall. He stated that trees will be going behind
the wall and that he would be willing to get Gretchen and the
landscaper together.

Gretchen stated that the H.O.A. appreciated the Goins working with
them and that they look forward to having the shopping center.
Vice - Chairman Colburn called for the question. Board Member Rhodes
moved to recommend to the City Commission that the Special
Exception for an Automotive Retail Tire Sales Store in a "C -2" zone
be granted as long as the request meets the code's standards.
Member Boggs seconded and the motion was approved unanimously.
ADJOURNMENT
Board Member Rhodes moved to adjourn the meeting, it was seconded
by Member Boggs, and the motion was approved unanimously. The
meeting adjourned at 8:00 p.m.
