HomeMy WebLinkAboutPZ 01-09-1990 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON TUESDAY, JANUARY 9, 1990 CALL TO ORDER The meeting was called to order at 7:30 p.m. by Chairman Swickerath. PRESENT: Chairman Swickerath, Vice Chairman Linebarier, Commission members Weeks, Carroll (Alternate), and Sims, Director of Planning Behrens, and Deputy Clerk Resnik. ABSENT: Commission members Pat Bond, Harold Switzer, Mickey Shiver, and Darlene Rhodus (Alternate). APPROVAL OF MINUTES Commission member Sims moved to approve the Planning and Zoning Commission minutes of December 12, 1989, Vice Chairman Linebarier seconded, and approval was unanimous. Chairman Swickerath noted that there would be election of new officers under "Other Business" later in the evening as it was the kmiwe first meeting of the calendar year and the new Planning and Zoning Commission bylaws stipulated that is when elections are to take place for Chairman and Vice Chairman. NEW BUSINESS Good Homes Road Plaza - Preliminary Engineering Director of Planning Behrens read the staff report. Director Behrens said that since this was the largest commercial project to date, the city's reviewing engineers were at the meeting to answer any questions. He said the developer and the developer's planner were also in the audience to answer any questions. Allen Goins, President of A.G. Development Group, introduced himself to the Commission and said he was available to answer any questions. Chairman Swickerath asked Director of Planning Behrens if he had a copy of the Highway 50 Study and Director Behrens said he did not have one with him. Director Behrens explained that staff had been in close contact with Ed Williams from Orange County and that Orange County approved of the plan. Vice Chairman Linebarier said he recalled that the Highway 50 study that the city had done said there would only be curb cuts allowed every 1000 feet. Chairman Swickerath agreed and said that this was to keep east -west traffic Page 2 Planning and Zoning Commission Meeting January 9, 1990 moving and to keep State Road 50 from turning into another Route 436. He said he also remembered that cuts were only to be made every 1000 feet. Chairman Swickerath said on the plan before them that there was only about half that distance from the intersection of Good Homes Road and Route 50 to the first cut to the west. Director of Planning Behrens said staff had worked closely with everyone on this including Orange County, the city's engineers, the developer and his engineer. He said a lot of effort went into getting everyone to agree on the Preliminary Plan in front of the Planning and Zoning Commission tonight. Vice Chairman Linebarier said a lot of time and effort also went into the Highway 50 study. Commission member Sims said he was not involved at the time the Highway 50 Study was developed and wanted to know a little bit about how it came about and whether or not it was formally adopted. Chairman Swickerath explained that the study was an effort on the part of the City Commission, the Planning and Zoning Commission, and staff and that it developed guidelines that were approved by the City Commission. Chairman Swickerath said that pending the outcome and adoption of the Traffic Circulation Element, the Highway 50 Study was a gentlemen's agreement to maintain the criteria outlined within it. Chairman Swickerath said in looking at the figures on the plan, 300 feet may seem like a long way but going 35 miles per hour or so in a car, it is not. He said he thought there would be problems with that short of distance and with the East -West Expressway extension also coming into the picture. Vice Chairman Linebarier said he thought this might be a good place for an access road otherwise it will contradict everything done in the Highway 50 Study by the City Commission, the Planning and Zoning Commission, Orange County representatives, etc.. Chairman Swickerath said this property was designated as high intensity commercial but that that specific turn is against what the study intended for Highway 50. John Wojtyna of GAI Consultants, the city's consulting engineers on this project, explained that the left turn was acceptable because the lights at the intersection of Good Homes Road and State Road 50 would be timed in such a way that it would allow the left turn in for enough cars, even in the peak traffic periods. Bob Zaitooni also with GAI Consultants, said that the firm Professional Engineering Consultants did a traffic generation study for the city Page 3 Planning and Zoning Commission Meeting January 9, 1990 for this project and found that the traffic generated by the left turn in, even during peak traffic times, would not be enough to disrupt the traffic flow because the traffic light at the intersection of Good Homes and Route 50 would allow sufficient time for the traffic to turn left. Bob Zaitooni said it was important to look at the traffic generation, not just the number of feet the cuts are apart from each other. He also said that all acceleration and deceleration lanes met the desirable lengths, etc. Chairman Swickerath asked what "peak time" was for this study and Bob Zaitooni said either 4:45 p.m. - 5:45 p.m. or 5 p.m. -6 p.m.. Chairman Swickerath asked about doing away with the left turn lane to the west and making them turn at the intersection at Good Homes Road. Commission member Weeks said he did remember the Highway 50 Study and the 1000 feet between curb cuts but he had a concern with doing away with the left turn in because it would force all the traffic to Good Homes Road and he did not want a left turn in off of Good Homes Road. He said he had seen a similar circumstance with the Walmart Plaza and people trying to turn left off of Maguire Road and he did not want to see traffic backing up on Good Homes Road. Commission member Sims agreed. Director of Planning ■,,,, Behrens said for that reason, they had kept the turn lane on State Road 50. Patrick Bruce King, Planner with Glace & Radcliffe, 800 S. Orlando Ave., Maitland, Florida, asked to speak on behalf of the developer. Mr. King said the developer had worked with the city on the space between the access points from the time they started with the conceptual stage. He also pointed out that in the Developers Agreement, Exhibit "D ", Paragraph 2, Section 2.2, the developer and the city had agreed to certain distances and they had kept within those agreements. Mr. King said the developer had gone to great efforts to ensure the public safety and had designed the project above the minimum standards accepted by the City of Ocoee. Chairman Swickerath asked when the City Commission entered into this Developers Agreement with the developer and Bruce King pointed out that the agreement was approved by the City Commission on November 22, 1988. Chairman Swickerath said Exhibit D clearly stated that they could have such cuts onto Route 50 even though earlier, the City had completed the State Road 50 Study that included provisions to keep cuts further apart. Gretchen Jacobs, 9127 Queen Elizabeth Court, Orlando, was at the meeting to speak on behalf of the homeowners of Rose Hill subdivision. Ms. Jacobs wanted to express to the Planning and Zoning Commission that City staff and the developer and its Now Page 4 Planning and Zoning Commission Meeting January 9, 1990 representatives had done a very good job with planning and design of the proposed shopping center and that Rose Hill was overall pleased with the results. She said they were especially excited about the brick and the two story restaurant. Ms. Jacobs said their only concern was with the wall on the north side of the project which would be visable from the Rose Hill homes until such time as the professional services property in between the shopping center and Rose Hill subdivision was developed. She said they would be looking at the wall and want it to be nice. Commission member Sims asked if there was a wall boardering the south side of Rose Hill and Ms. Jacobs said there was not. She said some of the homeowners had put up fences but some did not and the wall for the shopping center would be visable. Chairman Swickerath asked what the City regulations were on when the wall had to be constructed. Director of Planning Behrens said that the November 1988 staff report to the City Commission on this project included a letter from Ms. Jacobs requesting a wall. Chairman Swickerath said his question was not what type of wall but when the wall had to be constructed. Chairman Swickerath said he did not know if it was the purview of the Planning and Zoning *lbw Commission to recommend the materials to be used in construction of a wall. Ms. Jacobs said it was going to be a "high class" shopping center and they also wanted to make sure it was going to have a "high class" wall. Vice Chairman Linebarier said the City Commission had dictated that walls be brick in the past and gave the example of the Food Lion shopping center. Commission member Sims said the plans for this shopping center showed the wall having a stucco finish. He said he agreed with Chairman Swickerath that the Planning and Zoning Commission could not dictate what the wall would be made of. Allen Goins thanked Ms. Jacobs for her positive comments regarding the development of this project and said at a minimum, the developer would build a wall similar to what had been built by the developer in other communities. He said right now they planned on having a concrete wall with a brick -look appearance. He said, however, if that was not satisfactory to the community, or if the professional services would not be built for some time, then he was willing to consider a brick wall. Chairman Swickerath asked if the wall was temporary and if it was going to come down once the professional services area was developed. Mr. Goins said it would be there permanently. R.P. Mohnacky, 1820 Prairie Lake Boulevard, Ocoee, asked if the state had reviewed and approved these plans as far as State Road 50 was concerned. Director of Planning Behrens explained that Now Page 5 Planning and Zoning Commission Meeting January 9, 1990 these were Preliminary Plans and that the state would not become involved until the Final Engineering stage but that they would review the plan at that time. Mr. Mohnacky said he could not see where anything more could be built along State Road 50 until the road was widened because of the traffic situation. Director Behrens said that the Department of Transportation would review the plan to determine whether or not there was sufficient infrastructure to handle the traffic generated and that the new "concurrency" regulations would not allow anything to be built unless the infrastructure could handle it. Director Behrens also explained that three different engineering firms - as well as Orange County - had looked at these plans and the traffic generations and all agreed that the roadways could handle the additional traffic. R.P. Mohnacky said he was hearing a lot of statistics but that when he actually drives out there, the traffic is always backed up and it appears obvious to him that additional lanes are needed. Mr. Mohnacky asked if the City was trying in any way to get the state to widen State Road 50. He said he would like to see the City formally request something to the state. He said the City did not need any more studies but it did need more lanes, or at the very least it needed to be acquiring the land needed for additional lanes. Chairman Swickerath asked if there were any other comments. Vice Chairman Linebarier asked Director of Planning Behrens how close the drainage area was to Lake Lotta. Engineering Consultant Bob Zaitooni said the outfall of the pond was shown on the plans. He said the shopping center itself had a closed system and that the drainage calculations show sufficient retention so it will not impact Lake Lotta. Mr. Zaitooni said the drainage provisions fully meet the criteria of the City of Ocoee and the St. Johns River Water Management District. Vice Chairman Linebarier commented that he liked the layout of the landscaping. Director of Planning Behrens reported for the record that Commission member Switzer had telephoned him to say that although he would not be able to attend the meeting, this project had his support, too} a ressetk coylcern alow1 p lcct 2V1+YZV►ce 2X1 StGwi ' 14W'' SO saw 4 • Commission member Sims moved to recommend approval of the Preliminary Plan for Good Homes Road Plaza given that PEC had done a traffic study and that the Developer's Agreement allowed for the two access points and that he would rather see the left turn on State Road 50 than have all the traffic be routed to Good Homes Road. Commission member Carroll seconded the motion. Vice Page 6 Planning and Zoning Commission Meeting January 9, 1990 Chairman Linebarier moved to ammend the motion to make the approval subject to a wall being constructed that would meet the approval of the Rose Hill homeowners. After some discussion, Mr. Goins, as representative for the developer, said they would "satisfy to a reasonable extent" those wishes of the nearby homeowners. Commission member Sims said the amendment was not acceptable to him because it was unclear as to what would be acceptable to the homeowners and as he said before, he did not think it was the City's prerogative to dictate materials to be used in the construction of walls. He said the fact that the developer had said for the record that he was willing to work with the homeowners was good enough for him. There being no second to the motion to amend the original motion, Chairman Swickerath asked for the vote on the original motion. The vote was 4 -1 in favor of approving the Preliminary Plan for Good Homes Road Plaza with Vice Chairman Linebarier casting the opposing vote. RECESS: 8:25 p.m. CALL TO ORDER: 8:40 p.m. Plantation Grove PUD - Land Use Plan Amendment Director of Planning Behrens read the staff report and pointed out that the developer and his engineer were in the audience if the Planning and Zoning Commission wished to discuss any issues. Chairman Swickerath said he had not had time to review the current draft of the Comprehensive Plan's Housing Element and asked if it addressed the multi- family that was originally planned to go on this property. Director of Planning Behrens said he did not think the Housing Element addressed any of these developments specifically. Vice Chairman Linebarier asked staff how the City was doing on multi - family units in relation to what it needed to have in order to satisfy the requirements of the Comprehensive Plan. Director Behrens said the only newly constructed multi- family project in the City was Oak Forest Apartments on Old Winter Garden Road and he did not know of any other projects planned for multi - family at this time. Vice Chairman Linebarier asked Director Behrens how the City would meet its requirements for multi - family if all the projects were changing to single family. Director Behrens said right now all the developers were building single family subdivisions because that is what the market is dictating but Director Behrens predicted within the next few years the City would see some activity in multi - family developments because he Page 7 Planning and Zoning Commission Meeting January 9, 1990 knew of a couple of developers who were thinking along those lines. Director Behrens said his main concern was not so much the availability of multi - family housing, but the availability of affordable housing. Vice Chairman Linebarier asked if the City was in favor of dropping the park. Director of Planning Behrens explained that under the new ordinance, the developer has a choice of whether to keep the plans already formulated or to go with the new recreational impact fees. Lou Roeder, representing the developer, said they had taken the opportunity to pay the new recreational impact fee but that they were going to keep the land for the fire station as part of the plan. Mr. Roeder said the payback on that land would go towards the City purchasing a recreational area south of the Turnpike within the next three years. He said that the previously planned park was no longer part of the development but that the development would have a three acre private park and the developer would still pay 100% of the recreational impact fee. Vice Chairman Linebarier asked how many single family lots were added by taking out all the multi - family. Mr. Roeder said there were originally 322 single family lots and 450 multi- family units planned and now there were just 322 single family lots with a minimum lot size of 80 X 115 feet. Commission member Weeks said he liked the new concept and that it made good sense, especially from a traffic standpoint. Dr. Robert Ferdinand, owner /developer of this property, said for the Planning and Zoning Commission's information that there was land along State Road 50 that was designated as multi - family. Dr. Ferdinand said that multi - family has been hard to promote in West Orange County because it is usually located near where people work. He said more commercial development in the area should have a bearing on the multi - family market in the future. Vice Chairman Linebarier moved to recommend approval of the Land Use Plan Amendment for Plantation Grove PUD, Commission member Carroll seconded, and approval was unanimous. Plantation Grove PUD - Preliminary Engineering Director of Planning Behrens read the staff report. Vice Chairman Linebarier asked if the four - laning of Maguire Road would affect the project and Director Behrens said that it would not because 100 Page 8 Planning and Zoning Commission Meeting January 9, 1990 feet of right -of -way was being dedicated. Lou Roeder also mentioned that the curb cuts on Maguire Road are per the Maguire Road Traffic Study. Commission member Sims asked where the drainage went for this tract. Steve Mellich of CCL Consultants, the engineering consultant for the developer, said the drainage was being handled across the street along with the Arvida and M/I Homes developments. Lou Roeder said the drainage provisions were a result of the drainage study that was done for the Maguire Road area. Mr. Mellich said there was sufficient drainage provisions also for the commercial tract that was not proposed for development at this time. Vice Chairman Linebarier asked what the price of homes would be for this subdivision and Mr. Roeder said probably $125,000 - $150,000. He said they were trying hard to keep the price below $180,000 and it would definitely be below $200,000. Commission member Sims asked about walls and fencing and Lou Roeder said they have a conceptual screening plan. He said they ripw to keep the streets private and that the entrance to the subdivision would either be a gated entrance or there would be a guard at the entrance. Mr. Roeder also explained where the walls and fences would be located and that there would be rod iron (actually aluminum with appearance of rod iron), wood fencing, brick, and masonary in different locations throughout the subdivision. He reminded the Planning and Zoning Commission that this was a conceptual plan and that it was subject to change. R.P. Mohnacky asked whether Florida Power had committed themselves to this project and said he had some concern in this area, especially because of the latest black out /brown out the state had experienced over the Christmas holiday. Steve Mellich said that Florida Power was obligated by law to serve the subdivision. Commission member Carroll moved to recommend approval of the Preliminary Plan for Plantation Grove PUD, Vice Chairman Linebarier seconded, and approval was unanimous. OTHER BUSINESS Chairman Swickerath said that according to the Planning and Zoning Commission bylaws, election of officers needed to be held tonight because it was the first regular meeting of the new year. Chairman Swickerath said he had enjoyed being Chairman but that he had been Page 9 Planning and Zoning Commission Meeting January 9, 1990 Chairman for a long, long time. He said he would like to think that the City Commission would reappoint him in June but that was not set in stone. Chairman Swickerath then opened up the floor for nominations. Commission member Carroll nominated Commission member Sims for Chairman. After waiting for a second to the nomination, Chairman Swickerath said he would second the nomination. Vice Chairman Linebarier said he wanted to make sure that Chairman Swickerath did not want to hold the Chairmanship again before he voted to elect someone else. Chairman Swickerath said he thought it was time for someone else to take over. There being no other nominations, Chairman Swickerath asked Commission member Sims if he would accept the nomination and Commission member Sims said he would. A vote was taken on the nomination for Commission member Sims and his nomination was approved unanimously. Chairman Swickerath then asked for nominations for Vice Chairman. Chairman Swickerath nominated Vice Chairman Linebarier if he would agree to continue to serve (Linebarier nodded that he would) and Commission member Sims seconded. There being no other nominations, a vote was taken on the nomination of Vice Chairman Linebarier to continue as Vice Chairman for another year and the vote was unanimous. Chairman Swickerath mentioned that he had told Mr. Mohnacky that he could continue his discussion of Florida Power under "Other Business" and asked Mr. Mohnacky if he wanted to do so now. Chairman Swickerath suggested that Mr. Mohnacky attend the Citizen Advisory Committee meetings on Infrastructure. He said if it pertained to infrastructure or utilities that the City was to provide then the City would have to ensure that the services were available to serve the subdivision. He said Mr. Mohnacky may want to contact other sources as well on the issue of providing electricity. Commission member Weeks said that he served on the Infrastructure Citizen Advisory Committee and that the committee discussed City roads and City utilities but not electric power. Director of Planning Behrens said it may be a good item to bring up for discussion at one of those meetings. R.P. Mohnacky said one other issue he wanted to address was affordable housing and he suggested that one way to approach this was to have spec houses built that would include all the things that a professional should do but leave the finish work to the homeowner. He said this way rather than compromise on the size of the lots or size of the homes, the homeowner could compromise by doing some of the work himself. fir.• Page 10 Planning and Zoning Commission Meeting January 9, 1990 There being no other items for discussion, Vice Chairman Linebarier moved to adjourn the meeting, Commission member Weeks seconded, and approval was unanimous.
