HomeMy WebLinkAboutPZ 03-13-1990 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON TUESDAY, MARCH 13, 1990 kirev PRESENT: Chairman Sims, Vice Chairman Linebarier, Commission members Swickerath, Bond, and Switzer, Alternate Commission members Carroll and Rhodus, Planning Director Behrens, and Deputy Clerk Resnik. ABSENT: Commission members Shiver and Weeks. CALL TO ORDER Chairman Sims called the Workshop meeting to order at 6:42 p.m.. He stated for the record that the Planning and Zoning Commission was meeting an hour earlier than usual in order to discuss the West State Road 50 Area Study. Chairman Sims stated that this was for discussion purposes only and that any votes or decisions would have to be made under the regular meeting agenda. He then asked Director of Planning Behrens to discuss the materials that were included in the agenda packets. Director of Planning Behrens said after researching through minutes of past City Commission meetings he found that the last time this item was discussed was before the Orange County Commission when former Mayor Ison and former Planning Director Russ Wagner went before the Board to discuss the study. Vice Chairman Linebarier said he could not find anything in any of this material that mentioned the 1000 foot intervals between cuts but he knew they had discussed it. Commission member Switzer agreed. Commission member Swickerath said the real concern at the time was not to have State Road 50 become like State Road 436. He said they wanted traffic to move smoothly through the City and to allow people to turn off the road to shop but not to disrupt traffic flow. Commission member Swickerath said it disturbed him that there was no real clear direction given at the time as to how this would be accomplished. He said it was obvious that the Planning and Zoning Commission had recommended this to the City Commission but it was not clear whether or not the City Commission had accepted the Planning and Zoning Commission recommendation. Vice Chairman Linebarier said he remembered having a very lengthy meeting with the City Commission about this issue but that the minutes from that meeting were not included in the material before them. There was some discussion as to whether this joint meeting was recorded and that perhaps no minutes were available. Chairman Sims asked Director of Planning Behrens whether or not he was aware of any recommendations or discussions that the City Commission may have had. Chairman Sims said the point of having the workshop tonight was to find out what had happened in the past and whether or not this issue was ever formally voted on by the Page 2 Planning and Zoning Commission Meeting March 13, 1990 City Commission. Commission members Switzer and Swickerath both commented that there was a lot of turn over in staff during that time. Chairman Sims said this issue was raised because the Planning and Zoning Commission wanted to find out why staff was bringing things before them that seemed to contradict with things they had recommended in the past. Director of Planning Behrens said the staff used the West State Road 50 Area Study as a guide in planning and gave the example of the design of the new hospital where they were trying to minimize curb cuts on S.R. 50. Director Behrens also used Good Homes Road Plaza as another example and said that Orange County agrees with Ocoee staff that the cuts for this project should be limited to two (2) rather than the requested three (3). Director Behrens pointed out that this issue was going to be discussed at the DRC meeting later in the week. He also pointed out that the Good Homes Road Plaza developer had also requested to discuss an addition to the impact fees that the City said the project would now be required ,, to pay. The developer did not feel the project should be subject to the newly instituted (higher) transportation impact fees but according to Director Behrens, the developer's request to have these fees reduced was denied, as was his request to place it on the DRC agenda for further discussion. Chairman Sims asked how the City Commission had previously voted on the curb cut item for Good Homes Road Plaza and Director of Planning Behrens said the City Commission approved only two cuts. Chairman Sims asked Director Behrens if the issue would go back before the Planning and Zoning Commission and then City Commission after the DRC votes on it and Director Behrens said it would. Commission member Switzer asked how the developer could request another review once it had already gone through the Planning and Zoning Commission and the City Commission and Director of Planning Behrens said there was nothing that prevented the developer from asking for a change to his existing plan but that this would be considered a substantial change. Director of Planning Behrens said another example of curb cuts onto S.R. 50 was the Scotty's expansion project. Director Behrens said Scotty's representatives were requesting a curb cut onto S.R. 50 in between the existing cut on S.R. 50 and the Hardees' cut on S.R. 50. Director Behrens said he was the one who noticed this on the plans that were submitted and that under the square footage requirements, this plan was not required to come through the Page 3 Olhow Planning and Zoning Commission Meeting March 13, 1990 Planning and Zoning Commission. Director Behrens said he met with Bob Campbell of PEC to discuss this issue and that the curb cuts requested are not even within the DOT standards. Director Behrens said the City is holding up the developer's permits until they resubmit a plan with stacking distances indicated. Director of Planning Behrens stressed that the City can not deny a property owner access to S.R. 50 if there is no other roadway for access. He said the Planning Department will do everything possible to minimize curb cuts on S.R. 50 and that the south side of S.R. 50 would probably end up in pretty good shape as far as keeping traffic moving smoothly; however, he could not be so sure about the north side since there are several pieces currently in the County that are starting to take an interest in wanting to come into the City. Vice Chairman Linebarier said he was worried about S.R. 50 in Ocoee turning into what Silver Star Road looks like in Pine Hills. He said he did not want to see every individual business have its own access. Chairman Sims asked Planning Director Behrens what his policy or strategy is to minimize curb cuts on S.R. 50 east of Bluford Avenue. Director Behrens said he has talked with the hospital representatives about using Blackwood Avenue and that the City would advocate that Blackwood Avenue be punched through to White Road. Commission member Carroll asked if the Grover Voss property that was west of the hospital site (zoned professional services) would get a curb cut and Director Behrens said he thought a curb cut for that property could be justified, especially since the hospital has said they do not need a cut onto S.R. 50. Director Behrens said it may make sense since they do not want to overload Old Winter Garden Road. Director of Planning Behrens said the hospital does not want to share a service road because of the emergency vehicles having to compete for access with other vehicles. Commission member Switzer asked about using service roads to help with curb cuts in some of the other areas on S.R. 50 . Chairman Sims said with the current development already in place and with the amount of wetlands, it is not realistic to believe that service roads will present a viable alternative. %r► Page 4 `lbw Planning and Zoning Commission Meeting March 13, 1990 Commission member Swickerath said it seemed to him that the Planning Department was much more sensitive to the traffic flow on S.R. 50 than he thought it was. Chairman Sims asked Director Behrens if the City had a choice of allowing curb cuts on S.R. 50 or if the City was obligated to provide access to property owners. Director of Planning Behrens said the City had to allow the property owners access to their property and that if S.R. 50 was the only alternative, then the City could not really say no to a curb cut. Commission member Swickerath said when a developer buys land on a roadway like S.R. 50, they are buying the land because of the roadway and that that has to be considered as well. Vice Chairman Linebarier said that government has to give a man access to his property. Commission member Swickerath said he was not so concerned with where specific cuts were going to occur but moreso that a trigger or "red flag" be instituted that would alert the developers that the City of Ocoee is trying to minimize the curb cuts along S.R. 50. He suggested that maybe the City could keep the distance between cuts at 1000' for purposes of discussion or reduce it to 500 -600'; he said the issue was not so much the exact distance but that the City would look at these cuts closely. Chairman Sims said this issue was scheduled for discussion again during the regular meeting and that the Commission members could think about what kind of motion they may want to make and do it at that time. He said they could either vote to try to minimize the curb cuts by placing stringent guidelines for distances between them or they could attempt to keep curb cuts to a minimum without the stringent criteria, or they could propose something else. Chairman Sims said he also wanted to mention the public hearing that was held the previous night on the widening of Silver Star Road. He and Commission member Swickerath both mentioned that it was not too late to minimize cuts along this roadway. Director of Planning Behrens said the State Department of Transportation held the public hearing from 4p.m. -6 p.m. and then showed the overview from Hiawassee Road to Dillard Street in Winter Garden. He said the DOT was currently proposing six (6) lanes from Hiawassee Road to Apopka - Vineland Road and then five (5) lanes to Dillard Street. Director Behrens said he spent a day with Greg Caro of the DOT discussing this issue. He said the DOT discussed the impact this widening would have on the downtown areas of Winter Garden and Ocoee. The DOT proposed three alternatives to eliminating the current 90 degree turn by the Ocoee Post Office. They plan on presenting these alternatives before the Ocoee City Commission but Page 5 Planning and Zoning Commission Meeting March 13, 1990 wanted first to get public input on the issue. Director Behrens said the DOT also wants to straighten out the "Temple Grove" curve on Silver Star by Johio Shores Road and that there were several citizens who gave input on that at the meeting. Chairman Sims asked for examples of the alignments. Director of Planning Behrens said one would be to take the vacant land west of Food Lion and that the curve by Johio Shores Road could probably be handled without taking any homes. Commission member Swickerath requested that Ocoee work closely with the Winter Garden Planning Department on this realignment of Silver Star Road. Director of Planning Behrens said he wanted to share with the Planning and Zoning Commission that his "gut feeling" is that four (4) lanes would be enough and that the study done for this roadway in the next 20 -25 years showed that a four lane roadway would be heavily traveled but that six lanes would be more than enough. Commission member Bond said that she had attended the Silver Star n Road public meeting and that she was very concerned with the issue of backfilling. She said the DOT had talked about doing this and that she was quite upset with their attitude about it. Commission member Bond also said that an engineer representing the DOT told her that they would not be responsible for handling any of the runoff from the hill section (Orange Ave., Center St., etc.) in their construction, but only that which was generated by the roadway itself. Commission member Bond said that the City has a chance to keep Starke Lake nice and she said she hoped that they would all stand together to keep it that way. Chairman Sims said from a permitting standpoint the DOT does only have to handle the runoff that their project creates and, he said, the runoff from the hill is currently going directly into the lake. Commission member Switzer asked if in their widening of Silver Star Road they disrupt some lines, etc., whether the City can require them not only to fix it, but to bring it up to current regulations where stormwater now has to be handled? Chairman Sims said he thought the DOT would cooperate with the City in handling protection of the lake. ADJOURNMENT: 7:30 p.m. �I�r` Page 6 Planning and Zoning Commission Meeting March 13, 1990 CALL TO ORDER OF REGULAR MEETING Chairman Sims called the regular Planning and Zoning Commission meeting to order at 7:40 p.m.. APPROVAL OF MINUTES The Planning and Zoning Commission made two corrections to the meeting minutes of February 13, 1990: 1. Under the "PRESENT" section, Vice President Linebarier should be changed to read Vice Chairman Linebarier. 2. Under "OLD BUSINESS ", Silver Bend Subdivision discussion, the beginning of the fourth paragraph should read Commission member Shiver and not Chairman Shiver. Commission member Swickerath moved to approve the minutes with the two corrections above, Commission member Switzer seconded, and approval was unanimous. NEW BUSINESS Johio Bay - Preliminary Engineering Plans Director of Planning Behrens read the staff report and Vice Chairman Linebarier asked what the recreational requirement was. Director of Planning Behrens said the developer will pay the recreational impact fee in lieu of donating land. Director Behrens said this was a new project that came in after the recreational impact fee was established. Chairman Sims asked Director Behrens whether the developer can plat below the normal high water level. Director Behrens said they can not build below the high water level. Chairman Sims asked if they can plat below it and Director Behrens said he would have to look into it and would find out before Final Engineering. R.P. Mohnacky, 1820 Prairie Lake Boulevard, said after attending the Silver Star Road meeting he thinks the curve in Silver Star Road near where this project is located needs to be handled before many more projects begin to develop around that area. He said this was an 80 degree turn and that there were emergency personnel at the Silver Star Road meeting who claimed that 10 people had already been killed at that location in the road. Page 7 Planning and Zoning Commission Meeting March 13, 1990 Ted Bolin, developer for Johio Bay, pointed out that the house plots for the lots near the lake were shown by the dotted line. Commission member Carroll asked Mr. Bolin if there was 8,000 square feet above that dotted line. Chairman Sims said it looked adequate after looking at it more closely. Vice Chairman Linebarier asked Director Behrens to confirm this issue with the City's consulting engineers. Vice Chairman Linebarier also questioned how many trees were on the site. Director Behrens said he was not sure since that plan was back in his office but that the Planning Department worked very closely with the developers on marking and saving trees. Chairman Sims asked if the City Commission was concerned with rear yard swales. Director Behrens said he had not heard it mentioned as a concern in the last 10 subdivision reviews. Chairman Sims asked the developer how the swales would work and Ted Bolin said they were designed to pop off into the lake although that was not a concern of Preliminary Engineering. Chairman Sims said he understood that it was not a condition of approval for Preliminary Engineering but that he suggested that the developer use some sort of mechanicals when designing the Final Engineering Plans. Commission member Switzer moved to recommend approval of the Preliminary Subdivision Plan for Johio Bay and Commission member Carroll seconded. It was recommended that the motion be amended to be contingent upon the areas above the normal high water mark being in accordance with the City's zoning and subdivision regulations. The motion passed unanimously. At this point in the meeting, Director of Planning Behrens explained that he had inadvertently left off the agenda the Plantation Grove PUD Final Engineering Plans. He apologized for not disseminating the plans to the Commission members before the meeting but asked the Commission members to vote on the plans tonight to keep the developer on schedule, especially since there were no outstanding issues. Director Behrens said there were no changes to the development since the Commission members had seen the Preliminary Plan. Director Behrens read the staff report that was handed out to the Commission members on the Final Engineering Plans for Plantation Grove PUD. Vice Chairman Linebarier asked what type of screening was going to be used along Street "A" and Tract C. Lou Roeder, of Phoenix Development Group, the developer, said there would be many different types of screening used within the tilt► development including brick walls, rod iron -type fencing, and wooden fencing. Mr. Roeder said that the main road through the Page 8 Planning and Zoning Commission Meeting March 13, 1990 subdivision would have a median and landscaping on both sides. He said Lots 35 and 36 in Phase III would have brick walls on the south side and that Lots 14 and 15 to the north would have brick walls and then there would be wooden fencing after that. Commission member Swickerath asked if there were any plans to connect Street "A" with the outparcel of commercial. Lou Roeder referred to Sheet 13 and said there would be three islands but that the only curb cut going into the shopping center would be between the first and second islands, going north or south. Mr. Roeder said there would be three cuts all together on Maguire Road and referenced the Maguire Road Study. Commission member Swickerath said he was concerned with having adequate stacking space and Director of Planning Behrens said that was covered in the Maguire Road Study. Commission member Swickerath said he did not want to see this development do what the US Home development did on Silver Star Road with asking for an additional curb cut late in the development process. He said three cuts did not seem unreasonable to him but that he would like to know that that would be all there would be and he would like them to be indicated as to where they are going to be. Director of Planning Behrens said he would get a copy of the Study to the Planning and Zoning Commission members. Lou Roeder said the shopping center developer knows they will only have the two curb cuts in addition to the one made for the Fire Station site. Vice Chairman Linebarier asked where the park area was and Mr. Roeder said it was designated as Tract A on the plans. He said it would be a private park area of about three (3) acres and would be equipped with three tennis courts, a gazebo, volleyball, and a parking lot. Commission member Bond moved to recommend approval of the Final Engineering Plans for Plantation Grove PUD, Vice Chairman Linebarier seconded, and approval was unanimous. RECESS: 8:10 p.m. CALL TO ORDER: 8:30 p.m. Page 9 Planning and Zoning Commission Meeting March 13, 1990 OLD BUSINESS Discussion of West State Road 50 Area Study Chairman Sims said the Planning and Zoning Commission had a workshop on this item earlier in the evening to review the study and the minutes to determine the status of the study. Chairman Sims said the Planning and Zoning Commission had clearly recommended approval of this study in the past and recommended adopting this study as policy, but that as it turns out, the recommendation was probably never acted upon by the City Commission and therefore never made into policy. He said the Planning and Zoning Commission was now revisiting the subject and whether or not to recommend something again to the City Commission. Chairman Sims said the Planning and Zoning Commission could handle this in several ways insofar as giving the City Commission an idea of what the Planning and Zoning Commission members' feelings are about curb cuts. He said his feeling was that the members wanted to minimize curb cuts along S.R. 50 as much as possible and that it was more a matter of what policy could best do that. He said in the past 1000 feet was the amount of space recommended by the Planning and Zoning Commission in between curb cuts along S.R. 50 but that it did not necessarily have to be the same distance now. He said, in fact, that the Planning and Zoning Commission members may wish not to use a specific number but that they needed a policy and /or a standard that would trigger or "red flag" the issue. Vice Chairman Linebarier said he was one of the reasons that this issue was brought up again for discussion. He said if the other members felt that 1000 feet was too far in between cuts, he would compromise, but he felt strongly that some standard was necessary. Vice Chairman Linebarier said it was not just the curb cut issue, but also the future land uses along this corridor that were of interest to him. Director of Planning Behrens said the Future Land Use Map that the City Commission and Planning and Zoning Commission had drawn up was never officially adopted, although it will be the basis for the Land Use Map currently being done for the Comprehensive Plan. Director Behrens said there had been some changes to this map, namely that some R -3 designations were changed to R -1 -A. Vice Chairman Linebarier recommended that the Land Use Map be brought before the Planning and Zoning Commission for this S.R. 50 corridor. Commission member Swickerath said he thought that the intent of the land use map was to keep the level of service on S.R. Page 10 Planning and Zoning Commission Meeting March 13, 1990 50 relatively smooth traffic -wise. He said he felt the City had done this and he thought by keeping the 1000 foot mark for purposes of discussion the City would be able to keep a handle on things. Commission member Swickerath said the issue was not so much curb cuts as it was median cuts or median crossings. He said he felt the property owners should be able to have a "right in" and "right out" of their property but that the median crossings were what needed to be kept to a minimum. Commission member Switzer agreed that the 1000 feet should refer to the crossing of the median because that is what really interrupts and disturbs the flow of traffic. Commission member Bond said she still was not sure whether or not she wanted to see a specific number put on anything. She said her concern was that the number may get misinterpreted or misread in the future and that it would be taken as a hard and fast rule. Commission member Switzer asked whether the state had requirements for median crossings and Chairman Sims said the property owners „.. would have to apply for a DOT permit if they wanted a cut in a median but the problem with stating "median cut” was that S.R. 50 in Ocoee does not have a median. Commission member Swickerath said the state DOT had standards for curb cuts as well. Director of Planning Behrens said the DOT's standards were 220 feet apart in a 40 m.p.h. zone and 330 feet apart in a 50 m.p.h. zone. Vice Chairman Linebarier said if the policy was left vague and unwritten, it would be too interpretive and subjective. Chairman Sims said that it could also be seen as beneficial because it would allow for the Planning and Zoning Commission and City Commission to be more flexible if need be. Vice Chairman Linebarier agreed that they should have some sort of standard but that they should also be willing to listen in the event there was justification for less distance between cuts. Alternate Commission member Rhodus said she liked the idea of a minimum standard, but was not sure about using 1000 feet. Commission member Swickerath said he liked the idea of a standard that would be high enough to "red flag" the fact that a left turn was being made that would entail crossing the median. Alternate Commission member Carroll said he did not have a problem i with using the 1000 feet for a standard but wanted to look at each case individually. Page 11 Planning and Zoning Commission Meeting March 13, 1990 Director of Planning Behrens said as a point of reference that 300 feet was the length of a football field if they found that easier to envision. Commission member Bond said that 1000 feet seemed too spread out. Director of Planning Behrens said that he was not convinced that an arbitrary standard was the way to go. Director Behrens said he would like to sit down with the Planning and Zoning Commission members with a map of the area under discussion and determine what can go in what areas. He said it would be easier for him to visualize in that manner. Commission member Switzer said that personally, he would drive 1/2 mile to a mile to turn around to head back in the other direction before he would stop in 50 m.p.h. traffic to make a left hand turn through 50 m.p.h. traffic coming the other way. Commission member Swickerath said that 1/5 of a mile is a pretty short distance to go when the speed is 40 -50 m.p.h. although he said he would be willing to consider left hand turns at that distance on an individual, case by case basis. He also said access roads would have been nice but he feels that alternative is pretty much a dead issue for that part of S.R. 50. Vice Chairman Linebarier said he would like to see 1000 feet kept as a means of discussion and to make a policy that anything less than 1000 feet in between cuts would have to come before both the Planning and Zoning Commission and the City Commission for approval. R.P. Mohnacky, 1820 Prairie Lake Blvd., Ocoee, said he telephoned the DOT and was told that the state planned to six (6) lane S.R. 50 from Kirkman Road to the Orange County line sometime in the future. Mr. Mohnacky asked why the right -of -way for this six laning could not be reserved now rather than allowing it to be built upon and then having to take the land at a much higher price later on. Allen Goins of A.G. Development Group, developer for the proposed Good Homes Plaza, thanked the Planning and Zoning Commission for allowing this issue to be discussed. Mr. Goins said he was glad to hear that the word "median" rather than "curb cut" was what was really of concern to the City. He said he was originally very concerned when he heard that the Planning and Zoning Commission wanted to recommend limiting curb cuts to 1000 feet apart because it would cause his proposed shopping center major problems. Mr. Goins said fortunately he had received the Planning and Zoning Commission's approval for the one cut through the median (left hand turn in) and that the other two cuts he was seeking were right in- right out cuts. He said he felt that it was hard to place an exact Page 12 Planning and Zoning Commission Meeting March 13, 1990 number on the distance that should be between cuts and he suggested that the Planning and Zoning Commission really examine exactly what was behind the curb cut or median crossing and that that should be weighed in their decision to either approve or disapprove the cut. Mr. Goins discussed the differences between a shopping center and an office complex to illustrate his point. He said, for instance, that a shopping center - in order to be feasible - needs to be easy to get in and out of as well as safe to get in and out of, thus it needs more access points. On the other hand, Mr. Goins noted, in an office complex the traffic is more controlled (he cited the example of the mother with fighting children in the car as being more representative of the "shopping center" traffic and an office worker on his or her way to work as being representative of "office complex" traffic) and therefore the office complex needs less cuts. Mr. Goins stressed that he felt in order to decide on the amount of distance between two cuts, the City needed to look at what was behind the curb cut (shopping, office, etc.) before the City made any decisions. Mr. Goins also said that he felt it was the small parcels each being allowed to get individual cuts onto main `..- roadways that were much more of a problem than the shopping centers. He also pointed out an example of a shopping center site in Longwood that was only allowed one access point and that although it was a nice shopping center, Publix was no longer there because of the access problem for its customers. Mr. Goins stressed to the Planning and Zoning Commission that in order for them to have success with a developer such as Good Homes Plaza developers, the developer also has to be successful or else the facility itself becomes a hardship and a detriment on the City in the long run. He said in order for the City to ensure that the developer was successful, they needed to provide enough support so that the shopping center could remain competitive with other centers in the neighboring communities. Director of Planning Behrens suggested that staff put together an aerial of this section of S.R. 50 and outline the major projects proposed for the area. Director Behrens said then they can study it and arrive at standards. Commission member Swickerath asked how long it would take staff to get the map put together and Director Behrens said about six weeks. Commission member Swickerath moved to recommend that the City Commission not approve any curb cuts from Good Homes Road to Bluford Avenue until both the Planning and Zoning Commission and City Commission see the map put together by staff and determine what the City's policy will be on curb cuts in fir,, this area. Commission member Swickerath said he was recommending Page 13 Planning and Zoning Commission Meeting March 13, 1990 a moratorium on all curb cuts and median cuts (left hand turn movements) until the City had an opportunity to study this and determine standards. Vice Chairman Linebarier seconded the motion. Allen Goins stressed that as the developer of Good Homes Plaza, he had worked closely with City staff and consulting engineers and had proposed a plan originally with one curb cut and two full median cuts and at that time there was no objections to that. Mr. Goins said that the objections came when the Orange County Planning Director suggested that the shopping center be limited to two cuts. He said then that the right in, right out curb cut for the southeast parcel was no longer supported by staff. Mr. Goins said he has been working on getting a developer for this parcel and is having problems because there is no access from S.R. 50. He said he does not feel there are any safety hazards created by putting a right in, right out cut there. Mr. Goins said he was going before the Development Review Committee on Thursday to have staff take another look at this issue. He said there is currently a developer with interest in the southeast parcel if an access cut is allowed but that this interested party would probably revoke its ..• offer if the six week period that the Planning and Zoning Commission was discussing was to take affect. Chairman Sims said he had made some observations of this area of S.R. 50. He said the site specific details would have to be dealt with on a case by case basis and that they had a lot of constraints to work within. Chairman Sims said, for example, that the City only had a limited amount of S.R. 50 to work with and that the City had been given certain circumstances to work with that it did not really have any say in (he cited the East -West Expressway extension as an example and the Turnpike situation). He also said there were developments occurring to the west on or near S.R. 50 that had definite effects on this section of S.R. 50, although no funds had to be contributed for this impact. Chairman Sims also said that there were wetland area constraints that they had to work around that would limit the service roads that could be developed. Chairman Sims said because of all of these constraints, there were only minimal planning alternatives available. He said he did not think the City could come up with a policy that could work with all of these constraints. Chairman Sims said that there was also a constraint in that the City had to work through the state DOT on this. Chairman Sims summarized his points by stating that he agrees that there should be a policy that the City try to minimize cuts along S.R. 50 in this area, and that perhaps the City could put a Page 14 Planning and Zoning Commission Meeting '161' March 13, 1990 distance between cuts, however arbitrary, to trigger the issue, although he did not really like the idea of a specific distance. Chairman Sims said besides S.R. 50, the Planning and Zoning Commission had also briefly discussed Silver Star Road. He said he did not want Silver Star Road in Ocoee to turn into Silver Star Road as it looks going through Pine Hills. Chairman Sims said the City of Ocoee has a chance to do some planning along this road since it is not all built up as yet and he feels the City needs to develop a policy for that roadway as well, before too much longer. Commission member Bond said she recognized the motion and second on the floor but that Good Homes Plaza had already been granted approval and they had already set up a meeting with the City for this week and she wanted to amend the motion to allow that developer to go ahead with the project since they were already on the Development Review Committee's agenda for Thursday. Commission member Swickerath said he was not willing to amend his motion because the Commission could do that by defeating the motion if they wanted something different. He said the developer was having trouble getting a business to locate in one of the outparcel locations but that the developer had accepted that plan approval and that he had the option of asking for something new at this time as he was doing with the additional curb cut, but that this would be considered a substantial change and would take time to go through the process anyway. Commission member Swickerath said if the developer was to go ahead with the substantial change it would have to come back before the Planning and Zoning Commission and that would be a minimum of four weeks anyway, so a six week moratorium will not set the developer back very much. Commission member Swickerath said he felt this was an important enough issue to get things straightened out before any development was allowed to get underway. Commission member Bond said she did not want to see a specific number placed in a policy regarding the distance between curb cuts because she felt it would be too easy for that number to be interpreted as a hard and fast rule. Alternate Commission member Carroll said he did not think the motion on the floor would affect the Development Review Committee meeting being held on Thursday. There being no further discussion, the .vote was taken on the motion and it passed by a vote of 5 -2 with Vice Chairman Linebarier and S, Commission members Switzer, Swickerath, Carroll, and Rhodus voting Page 15 Planning and Zoning Commission Meeting March 13, 1990 for the motion and Chairman Sims and Commission member Bond voting against the motion. Vice Chairman Linebarier said he would also like staff to do a similar aerial of Silver Star Road and Director of Planning Behrens said they already had a map of Silver Star Road and that he would bring it to the next Planning and Zoning Commission meeting. Commission member Swickerath asked if they could schedule another workshop for discussing these curb cuts on S.R. 50 and Silver Star Road. Vice Chairman Linebarier said he did not think they should handle both of the roadways at the same time because he felt it would take the full hour of the workshop just to handle the S.R. 50 issue. Chairman Sims said the Planning and Zoning Commission would hold a workshop at 6:30 p.m. before the next regular meeting on April 10 to discuss the S.R. 50 corridor between Good Homes Road and Bluford Avenue. Commission member Swickerath said in reference to the memorandum from Chairman Sims regarding Final Engineering Plans going on a r consent agenda, he would still request that they receive these plans at least three or four days ahead of time. Commission member Swickerath also wanted to know if the City Commission and City Manager receive a copy of the Planning and Zoning Commission meeting minutes since he was wondering if they read the comments made about the planning consultants the City hired who had given the presentation at the Colony Plaza on concurrency and other matters related to the Comprehensive Plan. Chairman Sims said he had spoken with the City Manager about this issue and that City Manager Shapiro apologized for not notifying the Planning and Zoning Commission members of the scope of the meeting. City Manager Shapiro said he told the consultants that there would be a lot of lay people in the audience and that was why the presentation was very basic.
