HELD ON TUESDAY, NOVEMBER 13, 1990
CALL TO ORDER: The meeting was called to order by Vice Chairman
Linebarier at 7:35 p.m. followed by the pledge of
allegiance to the flag and a moment of silence.
PRESENT: Vice Chairman Linebarier; Planning and Zoning
Commission members Swickerath and Switzer;
Alternate members Carroll and Rhodus; Director of

Shira, Associate Planner Claman, and Deputy Clerk

NEW BUSINESS
Approval of South Water Plant Site - Public Hearing
Director of Planning Behrens read the staff report. Vice Chairman
Linebarier asked what was planned for the area between the plant
site and the lake and City Engineer Shira said it was zoned
Commercial but that the City owned the property and had no
intention of developing anything there other than the plant.

City Engineer Shira was asked how deep the wells would be and he
said they were not sure yet but that it would probably be 12,000-
14,000 feet.
Vice Chairman Linebarier opened the public hearing. R.P. Mohnacky,
1820 Prairie Lake Boulevard, asked how the project would be funded
and was concerned that new growth should pay for itself. City
Engineer Shira said the City is taking money from a loan it
received from Barnett Bank a little less than a year ago. He said
no tax money would be expended and that new growth would pay for
itself.
Mr. Mohnacky asked how much water the new well would produce and
City Engineer Shira said a maximum of 3,000 gallons per minute.
City Engineer Shira said the main purpose of the plant is for
storage and that it would not be an elevated tank which is used for
pressure.
Commission member Swickerath said he just wanted to make sure the
plant would provide an adequate source of water for the area and
City Engineer Shira said it would be more than adequate.
There being no other public comments, Vice Chairman Linebarier
closed the public hearing. Commission member Switzer asked if
there was any septic tanks in the area and City Engineer Shira said
no. Alternate member Carroll moved to recommend approval of the
proposed plant site, Commission member Swickerath seconded, and
approval was unanimous.
Preliminary Submittal Document for the 1991 City of Ocoee
Comprehensive Plan - Public Hearing
Director of Planning Behrens said it had taken two years to get to
this point with the Comprehensive Plan. Director Behrens said it
started back when the City mailed a newsletter to all residences
asking for citizens who would be interested in taking part in
Citizen Advisory Committees and the City received 80 responses.
He said after a full year of committee meetings each element of the
Plan was devised and has gone before the Planning and Zoning
Commission and the City Commission in Workshop Sessions. Director
Behrens said the City Commission will hold its public hearing to
vote on transmitting the document to the Department of Community
Affairs (DCA) on December 4, 1990 and the State must receive the
document by January 1, 1991.
Once the Plan is transmitted to DCA, the State has 90 days to
review it and return it (by April 10 at the latest) to the City
with a report of what needs to be changed /revised /etc. The City
then gets 60 days to make the necessary changes and get the

document back to DCA. The City must formally adopt the Plan by
June 10, 1991. The final adopted Plan then gets sent back to DCA
and the state has until August 1, 1991 to make a determination of
whether it is in compliance or not. If it meets the State's
approval, it becomes the City's new Comprehensive Plan. The State
has the option of not accepting the document and citizens of Ocoee
have the right to file objections to the Plan and both these cases
would most likely result in court proceedings. The City must
incorporate all the necessary provisions of the new Comprehensive
Plan into new Land Use Regulations by January 1, 1992.
Director of Planning Behrens said the Future Land Use map that the
Planning and Zoning Commission and City Commission developed
several years ago was very similar to the one that staff would be
asking the City Commission to adopt. He said one change is that
the City's planning area had expanded and is now officially
extended south to Gotha Road and staff was hoping to extend it
north to McCormick Road. Director Behrens said in December staff
would bring a new map back to the Planning and Zoning Commission
and show the differences between it and the old map and make sure
that everyone was satisfied with it before the City has to formally
err, adopt it June 10, 1991. He said it has been three or four years
since this map was done so there are a lot of new annexations and
rezonings that are being incorporated on the new map. Director
Behrens also said there were a few changes to the existing Future
Land Use map along Maguire Road where some multi- family was changed
to single family and commercial and at the proposed intersection
of Clark Road and State Road 50 where it has been changed from
multi - family to commercial. He also said north of that
intersection would be some multi - family and that a large area
around Spring Lake that was shown on the existing map as multi-
family has now received Final Engineering approval for single -
family.
Director Behrens said that Associate Planner Claman had worked very
hard on the Comp Plan and that she had almost singlehandedly put
the document together with the help of the citizen advisory
committees and Professional Engineering Consultants.
Associate Planner Claman explained that she had previously reviewed
each of the elements of the Comp Plan with the Planning and Zoning
Commission but that they had yet to see the maps so she had
overheads of each of the maps to share with them. Associate
Planner Claman reviewed the following maps with the Planning and
Zoning Commission:

Land Associations Map (sand, hills, and isolated wetlands)
100 Year Flood Plain Areas Map (for the most part they are
conservation areas where development will be limited or
restricted)
Commission member Swickerath asked if these areas were indicative
of land - locked drainage areas or if there are routes for the water.
Associate Planner Claman said they are mostly all land - locked
basins but that there is a man -made ditch by Lake Apopka that
provided for a majority of this drainage.
Associate Planner Claman said with the new land use regulations,
the City will have to adopt an ordinance specifically addressing
these areas and restricting developments in and around them.
Director of Planning Behrens said the Prairie Lake area is a prime
example and that Clark Road is slated to go directly through some
of these areas and that the Planning staff will watch this very
carefully. Director Behrens said another example was the Heavener
property just south of the Hammocks and that the City and County
*/*. were working closely together to ensure that development of this
site took into consideration the wetlands.

back 10 -20" to the aquifer and the City falls mostly within
those areas)
Vice Chairman Linebarier asked how much water would be put back
into the aquifer with the spraying of treated effluent. Associate
Planner Claman said it was difficult to estimate that but that the
City would be required to put out 1/2 million gallons per day at
the north sprayfields site and that it was possible that maybe 3/4
to 1 million gallons per day could be sprayed along Clark Road.
Director of Planning Behrens said there was the possibility of
having a golf course community off of Maguire Road and that would
be another possibility for using the treated effluent.

Interchange Impact Areas Map (The discussion was centered on the
proposed repositioning of the Turnpike's Exit 80 from its current
location to Maguire Road. Associate Planner Claman said the plan
is definitely to move the exit but that it is a matter of when the
state can financially afford to do it.)
Downtown Redevelopment Area Map (It was explained that the City
may provide incentives to developers or create a Community
Redevelopment Agency (CRA) to try to revive the downtown area.)
Commission member Swickerath said one problem with the downtown was
that it was located on a state road and he wondered if the City
could ask the state to relocate the state road to make Bowness Road
the state road and keep the local streets local. Associate Planner
Claman said this is an ongoing discussion with the state.
Director of Planning Behrens said the biggest problem for
development of the downtown area is the lack of sewer and that once
they overcome that problem they will be in better shape. Associate
Planner Claman said there may be ways of getting funding for the
installation of sewer lines.

explained that staff does not yet have the Water Service Area map
but that it is very similar.)
Commission member Swickerath asked if the wastewater service area
meant that the City was going to provide service to that entire
area. Associate Planner Claman said that this did not mean that
areas on septic would be switched to sewer but that any new
development within this area would be able to be served by the
City.

at areas where flooding and runoff is a problem and see where
adjustments need to be made. There are also some drainage
structures already in place that may not be functioning properly.
The City is considering implementing a stormwater utility to fund
the study and the resulting work.)

Associate Planner Claman said within a week, staff would have the
new zoning maps and that each of the Planning and Zoning Commission
members would be receiving a copy of the Zoning Map and the new
Future Land Use Map.

CALL TO ORDER: 9 p.m.
Vice Chairman Linebarier opened the public hearing. R.P. Mohnacky,
1820 Prairie Lake Boulevard asked about traffic conditions and
whether this was discussed in the Comp Plan. Associate Planner
Claman said that it was and that traffic would have to be
considered as part of concurrency management.
There being no further questions, Vice Chairman Linebarier closed
the public hearing.
Alternate member Rhodus said that Associate Planner Claman had done
a wonderful job and that Director Behrens was lucky to have her as
part of his staff. Commission member Swickerath agreed and said
he would like to propose that Associate Planner Claman be formally
recognized for her efforts in the form of a Resolution. Alternate
member Rhodus moved to recommend that the City Commission adopt a
resolution on behalf of the efforts made by Associate Planner
Claman in putting together the City's Comprehensive Plan,
Commission member Swickerath seconded, and approval was unanimous.
Commission member Swickerath moved to recommend to the City
Commission that it approve this Comprehensive Plan as the submittal
document to the Department of Community Affairs after holding its
public hearing, Alternate member Carroll seconded, and approval was

OTHER BUSINESS
Vice Chairman Linebarier pointed out that the City Commission had
denied the Planning and Zoning Commission's request for additional
time to review the Lake Whitney plan. He suggested that the
Planning and Zoning Commission members attend the November 20 City
Commission meeting if they wished to make any comments.
Vice Chairman Linebarier also told the Commission members that
there was a meeting scheduled for Saturday, November 17, from 4 -7
p.m. at the Holiday Inn to discuss the City's future planning
areas. Director of Planning Behrens said the City Commission and
several staff members would be present and that discussion would
most likely center around the letter from the Clarcona Landowners
Association that he had handed out earlier in the meeting.
Director Behrens said the Association had 1,700 acres in the
McCormick Road - Keene Road area that it was asking both the City
of Ocoee and Apopka to consider annexing in since the Association
was frustrated with Orange County. Director Behrens said City
Manager Shapiro also wanted to discuss the area on State Road 50
towards Hiawassee Road and get a consensus from the City Commission
and the Planning and Zoning Commission as to how far east they
would like to see the City's boundary.
Director of Planning Behrens said City Manager Shapiro set up this
meeting in order to address these issues and get everyone's
feelings on the City's future planning area.
Commission member Swickerath asked if staff had invited anyone from
Winter Garden or Apopka to the meeting and Director Behrens said
he had not invited anyone since it was the City Manager who
scheduled the meeting.
Vice Chairman Linebarier said he understood that Apopka was not
interested in extending its boundary any further south. Director
of Planning Behrens said Apopka had at one point said it did not
want to go further south than Keene Road but may now be interested
in extending to McCormick Road to take in the Clarcona Landowners
Association land. Director Behrens reminded the Planning and
Zoning Commission members that the Ocoee City Commission had
recently voted 4 -1 to extend the City's Planning Area north to
McCormick Road.
Director of Planning Behrens said he had a meeting scheduled for
Friday with Ed Williams, Planning Director for Orange County, to
discuss the various annexation and rezoning petitions and to get
*kw the County's formal opinions on them. Director Behrens said he

will let everyone know the outcome of that meeting at the meeting
on Saturday and then staff has a meeting with staff from Apopka on
the following Monday.
Director of Planning Behrens said Linda Chapin had mentioned the
possibility of putting together a council of planners to provide
a forum for this sort of thing to keep everyone aware of what
different cities are doing. Commission member Swickerath said that
appeared to be a duplication of the role of the East Central
Florida Regional Planning Council. Director Behrens said he would
need to hear more from Linda Chapin before he could say what the
difference between the two would be.
Commission member Swickerath said the City should also invite
Windermere to the meeting. He moved that the Planning and Zoning
Commission recommend to the City Manager that the Planning
Directors from Apopka, Winter Garden, and Windermere be invited to
sit in on the Saturday Joint Workshop. Director Behrens said City
Manager Shapiro invited Ed Washburn (Planning Consultant for Winter
Garden) but that Mr. Washburn said he would have to get approval
from the City of Winter Garden before he could attend since Winter
Garden would have to pay for him to attend the meeting. Director
Behrens said Ray Creech, the City Manager of Winter Garden may
attend. Vice Chairman Linebarier seconded Commission member
Swickerath's motion and said he would especially like to hear
Apopka's views. Upon a vote, the motion passed unanimously.
Director of Planning Behrens wanted to share several things with
the Planning and Zoning Commission:
1. The new Redi Market is now open.
2. Good Homes Plaza is 91% leased.
3. Oak Forest Apartments, Phase II, is going to start finalizing
buildings for occupancy.
4. The recreation area at Arvida broke ground today and will have
four tennis courts, a basketball court, and a swimming pool.
The developer has sold 10 homes to date.
5. It looks like the proposed shopping center on Maguire Road
will have Publix as the anchor tenant. They hope to close on
the deal December 8.
6. The new park at Silver Glen is open and has a small parking
area and has been completely sodded. There is talk about
,,. having a dedication in January.

7. The southeast corner of State Road 50 and Old Winter Garden
Road which is currently still in the County is apparently
going to have an Exxon station and some other small shops
located on it. The City has let the County know of its
concern to save as many trees as possible but since
development will occur under the County's regulations, the
City does not have any formal say in the matter.
Alternate Commission member Carroll let everyone know that Dr.
Young's office in the new West Orange Commercial Park is opening
this week and that the building will house four doctors' offices.
8. Director Behrens said the hospital's large retention pond
slated to be built along State Road 50 will have to be a dry
pond according to St. Johns but that he has been working with
the hospital and its engineers and that the smaller pond on
the corner of Blackwood and State Road 50 that was also
planned as a dry pond may be changed to wet. The hospital has
agreed to work with Director Behrens to make it a wet pond as
long as St. Johns approves it.
Commission member Swickerath moved to adjourn, Commission member
Switzer seconded, and approval was unanimous.
