CALL TO ORDER
Chairman Robert Godek called the regular meeting of the Ocoee Code Enforcement Board to order at
7:02 p.m. in the Commission Chambers at City Hall. Member Carrington gave the invocation, and Vice -
Chairman Lowery led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared
present.
PRESENT: Chairman Godek, Vice - Chairman Lowery, Members Carrington, Hopper, and Osborne. Also
present were Asst. Support Services Director - Code Enforcement Manager Doug Gaines,
Code Enforcement Officers Carmen Delgado, Edward Loeffler and Bob Siegrist;
Administrative Assistant Bridgett Coffey, Board Attorney Mary Sneed, and Recording Clerk
Diana Turner.
ABSENT: Members Blynder and Kelley were absent excused.
GUESTS: Police Lieutenant Mike Bryant and Police Detective Michelle Grogan
Administrative Assistant Coffey administered the oath to the code enforcement officers and to anyone
intending to speak regarding a case.

Officer Delgado presented the case and gave its history. The officer explained the property came into
compliance on August 16, 2010; the accrued fine is $15,000.00, plus the City's cost of $1273.64, for a grand
total of $16,273.64.
Annisa Bolton, of Choice Legal Group, attended the meeting on behalf of Federal National Mortgage
Association. Ms. Bolton explained Federal National Mortgage Association obtained the property by virtue
of a foreclosure action. The mortgage company is in the process of trying to sell the property. The fine was
recorded after the Lis Pendens; therefore, it would be subject to the foreclosure action. She asked the fine to
be reduced to the City's cost. She continued that upon possession of the property, it was brought into
compliance within 100 days.
Member Osborne inquired if this case was brought forward by citizen complaints. The officer responded in
the affirmative.
Member Osborne, seconded by Member Carrington, moved that in Case #10 -049, that the Code
Enforcement Board recommend to the City Commission 10 reduce the fine to $3,273.64. Motion carried, 4-
1, with Member Hopper dissenting.
Vice- Chairman Lowery, seconded by Member Hopper, moved that Case #15 -008 be heard as the seventh
agenda item, and then revert hack to the original agenda. Motion carried unanimously.
Member Osborne, seconded by Member Carrington, moved to re -hear Case #07 -106, for request of

Officer Delgado presented the case and gave its history. The officer explained the property came into
compliance on November 17, 2007; the accrued fine is $8,900.00, plus the City's cost of $970.59, for a
grand total of $9,870.59.
Annisa Bolton, of Choice Legal Group, attended the meeting on behalf of Federal National Mortgage
Association. Ms. Bolton explained the vehicle in question was owned by the previous property owner. The
foreclosure action began in 2009; therefore, and the property carne into compliance prior to the foreclosure
action.
Vice - Chairman Lowery, seconded by Member Carrington, moved that in Case #07 -106, that the Code
Enforcement Board recommend 10 the City Commission to reduce the fine to the City's cost of $970.59.
Motion carried, 4 -1, with Member Osborne dissenting.

Officer Delgado presented the case and gave its history. Photos were presented as exhibits. The officer
explained that the case was brought forward by citizen complaints. A re- inspection of the property was
conducted today [January 27, 2015], and resulted in non - compliance.
Scott Brassart, resident of the property, explained that the dryer was removed 45 minutes after placing it
outside. He continued by saying that the new recycle schedule allows for the receptacle to pile up, and his
grandchildren disseminate the contents onto the lawn. As for the remaining trailer, he is not financially able
to install a fence.
Member Hopper inquired what debris remains on the yard. The officer responded one trailer,
miscellaneous debris, and wood is in the back yard. Member Hopper inquired if there is anywhere within
the City that Mr. Brassart may park his trailer. The officer responded the ordinance requires the trailer to be
screened from view.
Member Osborne inquired if the trailer could be moved to the backyard. Mr. Brassart responded that
there is not enough space in the backyard to accommodate the trailer.
Board discussion ensued regarding allowing the respondent enough time to speak with the City's Building
Department in order to apply for a fence permit.
Member Hopper, seconded by Member Osborne, moved that in Case #15 -018, the respondents be found in
violation as cited as of January 13, 2015, and be given until March 23, 2015, to come in to compliance, or
be lined 850 per day, for each day the violations remain in non - compliance. Motion carried unanimously.

Officer Delgado presented the case and gave its history. Photos were presented as exhibits. The officer
explained that the case was brought forward by citizen complaints. A re- inspection of the property was
conducted today [January 27, 2015], and resulted in non - compliance.
Charles Jakulewicz, owner of the property, offered the board a brief history of the property. He presented
his property survey as an exhibit. He purchased the property in 1992 with the understating that the unpaved
area in the front of the building was authorized parking; however, he was not provided documentation
guaranteeing this. He continued by saying he requested information from the City for all records of the
approval by the Development Review Committee (DRC) for the utilization of unpaved parking areas at any

property in the Industrial Zoned and Commercial Zoned areas within the City. The request resulted in a
response letter from City Planner Mike Rumer explaining the DRC does not meet to discuss small scale
review projects, and the request to approve the parking reduction would be on a staff -level basis.
Mr. Jakulewicz continued by saying that Mr. Rumer also offered phone conversations to discuss the
request, and that he personally met with Mr. Rumer in January [2015]. The respondent stated Mr. Rumer
advised that he found the initial building permit for his property, but no other records. Mr. Jakulewicz
stated his property is in an industrial area; however, he is being asked to meet commercial and residential
parking standards. He believes that his property is being "picked on ".
Board discussion ensued regarding the overflow of vehicles parked in the front easement and in the front of
the property. Also discussed was assigned spaces for each unit in that industrial area. Officer Delgado
explained most of the vehicles are untagged, and are repaired and listed for sale. Member Osborne inquired
if industrial requirements for parking fall under the same requirements as those commercial and residential.
The officer explained that when an occupational license is obtained, the property must comply with the
parking standards. Mr. Jakulewicz explained that he requested a permit for parking markers and fence from
the City; however, the Building Department explained they could not issue the requested permit. Member
Carrington inquired from Mr. Jakulewicz if discussion with the City's Building Department regarding
permitted parking resulted in a permit. Mr. Jakulewicz confirmed that the Building Department would not
issue a permit. Code Enforcement Manager Gaines stated that City Planner Rumer's ruling will apply to
this matter.
Board Attorney Sneed inquired if City determined if the 25% waiver was granted. Mr. Gaines explained
that City Planner Rumer would need to answer that question.
David Durgha, owner of Universal Leasing, LLC, apologized that the issue has come this far. He explained
that to mitigate the issue, they are now using an offsite storage area for many of their vehicles. Chairman
Godek inquired from the respondent why he did not call code enforcement to have the property re-
inspected. The officer stated that she was there yesterday [January 26, 2015], and there was little change.
Mr. Durgha explained that the vehicles are now parked in one direction and many of the vehicles have
been stored at the offsite storage.
Member Hopper explained that compliance should be a permanent change, not temporary; a permanent
arrangement must be made to accommodate his business.
Officer Delgado stated that this is an ongoing issue. Mr. Gaines directed the respondent to meet with City
Planner Rumer.
Vice- Chairman Lowery inquired if the vehicles are being repaired and sold. Mr. Durgha answered in the
affirmative.
Board Attorney Sneed explained that the board will allow time for compliance. Mr. Durgha commented
that he feels as though his business is getting "picked on ", as other properties are violating the Code as well
and are not being cited. The Board's attorney explained that he can call code enforcement to file an official
complaint.
Member Carrington, seconded by Member Hopper, moved that in Case #14 -101, the respondents be fo
in violation as cited as of November 20, 2014, and be given until February 23. 2015, to come in to
compliance, or be fined $100 per day, per violation, for each day the violations remain in non - compliance.

Observation: City Ordinance 143 -27: states that your garbage cart and recycling bins should not be placed curbside earlier than
7:00 p.m. the day before your collection day. The ordinance further states the garbage cart and recycling bins should be stored in
the side or rear yard and screened from view. Garbage carts and recycling bins are not to be stored in front of the premises.

Officer Delgado presented the case and gave its history. Photos were presented as exhibits. The officer
explained that the case was brought forward by citizen complaints and the Homeowners Association; the
complaint was regarding residents of Villas at Woodsmere continuously leaving their garbage containers
out. Upon inspection of the neighborhood, the officer noted that this is a neighborhood -wide issue. On
November 6, 2014, the officer left each resident a courtesy note advising them of the ordinance [143 -27]. A
re- inspection of the neighborhood resulted in non - compliance by Mr. and Mrs. El Baz.
Antonette El Baz, property owner, explained that the size of the garages for the townhomes allows very
little room for the garbage container and the container smells -up the garage.
Member Hopper suggested she make space in her garage for the garbage container. Officer Delgado
explained that the she received a call from the builder, and the requirement for the subdivision is to maintain
the garbage container in the garage.
Member Osborne, seconded by Member Hopper, moved that in Case #15 -012, the respondents be found in
violation as cited as of January 12, 2015, and be given until February 6, 2015, to come in to compliance, or
be fined S25 per day, fog° each day the violation remains in non- compliance. Motion carried unanimously.

Officer Siegrist presented the case and gave its history. Photos were presented as exhibits. The officer
explained that the case was brought forward by the City's Building Department while conducting a
Minimum Housing Standards inspection. The City is recommending a 60 -day compliance window, and $50
per day for non - compliance after the 60 days.

The officer continued by saying that he is currently working with the homeowner's brother, Rafael Torres.
Mr. Torres has attempted several times to obtain a permit for the structure, but has been unsuccessful. The
officer explained that the unpermitted work may have been done prior to the current ownership.
Rafael Torres, brother of the property owner, explained to the Board that the house was purchased as a
short sale, with the carport already having been converted to an enclosed living space. He continued by
saying he owned the property for several years and then sold it to his sister.
Code Enforcement Manager Gaines explained the building inspector indicated a permit is not on file with
the City; that the City's position is to move forward with the requirement of a permit.
Board Attorney Sneed read into the record the applicable Code, 51 -13, "It shall be a violation for any
person to engage in the business of or act in the capacity of a building, electrical, mechanical,
plumbing....within the City without first having obtained a permit thereof from the Building Department."
She explained that the City would need to prove the owner violated the Code by constructing without the
permit. She continued by saying that based on the reading of the Code, the City would need to prove that the
current owner did the work without a permit.
Member Hopper stated that Mr. Torres may not have personally enclosed the carport; however, it was still
done without a permit. As a member of the Board, he would feel hardship if there were a safety issue.
Board discussion ensued regarding the responsibility owners should have when acquiring a property.
Board Attorney Sneed advised the Board that it is their responsibility to interpret the code.
Member Carrington inquired from Mr. Gaines if the City could conduct an inspection to determine if there
may be life safety issues. Mr. Gaines stated this is to be determined by the Building Department.
Member Osborne, seconded by Member Carrington, moved to disrniss Case #14 -106, finding no violation.
Member Hopper stated he cannot vote to dismiss this case as he feels it is the responsibility of the owner to
check for these types of issues.

Officer Loeffler presented the case and gave its history. Photos were presented as exhibits. The City is
recommending a 30 -day compliance window and $100 per day, for non - compliance after the 30 days.
Chairman Godek inquired if the sign meets the City's Code standards. The officer responded that it would
need a permitting review to determine if it does meet the standards of the City's Code.
Lisandro Diaz, representative of A and D Ocoee Plaza LLC, stated the City had the wrong address on file,
and he received the City's correspondence at a much later time. He continued by saying the contractor with
the sign company is asking for more time to comply with the permitting process.
Vice- Chairman Lowery, seconded by Member Osborne, moved that in Case #15 -008, the respondents be
found in violation as cited as of December 29, 2014, and be given until February 27, 2015, to come in to
compliance, or be fined 8100 per day, per violation, for each day the violations remain in non - compliance.
Motion carried unanimously.

Police Lieutenant Mike Bryant and Police Detective Michelle Grogan presented a brief video and
showed pictures regarding the condition of the inside of the home. Lieutenant Bryant explained the
children residing in the home fill up jugs with water from the neighboring homes, and bring the jugs back to
the residence in wheelbarrows. There is no other water supply to the home. Detective Grogan explained the
home is infested with roaches.
Officer Siegrist advised the City pulled and locked the meter for non - payment on November 17, 2014.
Chairman Godek inquired if the children remain in the home. Detective Grogan responded that DCF
placed the children with their grandmother. However, she fears the children will be brought back to the

home. She continued by saying this is a squatter issue, and is the worst case that she has encountered in her
15 years as a law enforcement officer. The detective mentioned that a loaded gun was found on the
windowsill in the home.
Chairman Godek inquired regarding the history of the residence. Detective Grogan explained the home is
in foreclosure. Lieutenant Bryant further explained the homeowners have passed away and willed the
horne to their son; however, he has declined the inheritance. The mortgage lender is placing the
responsibility on the inheritance; therefore, the property remains in limbo at the moment.
Detective Grogan explained to the Board that the respondent, Eboni Tucker- Smith, is involved in multiple
criminal enterprises. She asked the Board to remember the conditions of the home and the blighted effect on
the neighborhood and neighbors.
