Background Summary:
The property located at 709 Lakeview Drive has two separate fines /liens from separate code enforcement
actions; they are being presented as a single agenda item so the property owner can be provided a single
solution.
Case 07 -106:
The property was cited on June 19, 2007 by Officer Carmen Delgado for an inoperable and untagged blue
Chevy vehicle with no front windshield. The code in violation was: §165 -3 Prohibited Acts. On July 24, 2007,
the Code Enforcement Board issued an order to comply by August 17, 2007 or be fined $100.00 per day per
violation. On August 28, 2007 the Code Enforcement Board imposed the accruing fine and lien for non-
compliance of 165 -3. On November 14, 2007, the property was documented as in compliance, thus stopping
the accruing fine with a total due of $8,900.00. The new property owner, Federal National Mortgage Assn. CIO:
Choice Legal Group PA, obtained the property through foreclosure on August 12, 2014.
Case 10 -049:
The property was cited on March 24, 2010 by Officer Carmen Delgado for overgrown grass and weeds. The
code in violation was: §115 -5. On April 28, 2010, the Code Enforcement Board issued an order to comply by
May 7, 2010 or be fined $150.00 per day, if not in compliance with the Board's orders. On May 26, 2010, the
Code Enforcement Board imposed the accruing fine and lien for non - compliance. The property was found to be
in compliance on August 16, 2010 stopping the accruing fine with a total due of $15,000.00. The new property
owner, Federal National Mortgage Assn. C /O: Choice Legal Group PA, maintains the property in compliance.
A representative of Federal National Mortgage Assn. CIO: Choice Legal Group PA, the new property owner,
appeared before the Code Enforcement Board on January 27, 2015, and requested a reduction of the fine /lien
for Case No. 07 -106 in the amount of $8,900.00, plus $970.59 in City costs totaling $9,870.56., and for Case
No.10 -049 in the amount of $15,000.00, plus $1,273.64 in City costs totaling $16,273.64.

Issue:
Should the City Commission reduce the amount of the fines to be paid for these enforcement actions, which
total $26,144.20?
Recommendations:
The Code Enforcement Board recommends the fine /lien be reduced to $970.59 for Case No. 07 -106 and
$3,273.64 for Case No. 10 -049, which is the cost to the City and a penalty for the negative blighted impact on
the neighborhood and the city. The decision by the Board to reduce the amount was based on testimony and
answers from the representative of U.S. Bank National Association Trustee and city staff.

Financial Impact:
The city would recover its costs of $2,244.23, plus receive a $2000.00 penalty for the negative blighted impact
on the neighborhood and the overall city, resulting in a total recovery of $4244.23.

Officer Delgado presented the case and gave its history. The officer explained the property came
into compliance on August 16, 2010; the accrued fine is $15,000.00, plus the City's cost of
$1273.64, for a grand total of $16,273.64.
Annisa Bolton, of Choice Legal Group, attended the meeting on behalf of Federal National
Mortgage Association. Ms. Bolton explained Federal National Mortgage Association obtained
the property by virtue of a foreclosure action. The mortgage company is in the process of trying
to sell the property. The fine was recorded after the Lis Pendens; therefore, it would be subject to
the foreclosure action. She asked the fine to be reduced to the City's cost. She continued that
upon possession of the property, it was brought into compliance within 100 days.
Member Osborne inquired if this case was brought forward by citizen complaints. The officer
responded in the affirmative.
Member Osborne, seconded by Member CarrinLton, moved that in Case #10 -049, that the Code
Enforcement Board recommend to the City Commission to reduce the fine to $3,273.64. Motion
carried, 4 -1, with Member Hopper dissenting.
Vice - Chairman Lowery, seconded by Member Hopper, moved that Case #15 -008 be heard as
the seventh agenda item, and then revert back to the original agenda. Motion carried
unanimously.
Member Osborne, seconded by Member Carrington, moved to re -hear Case #07 -106, for
request of reduction of fine. Motion carried unanimously.

into compliance on November 17, 2007; the accrued fine is $8,900.00, plus the City's cost of
$970.59, for a grand total of $9,870.59.
Annisa Bolton, of Choice Legal Group, attended the meeting on behalf of Federal National
Mortgage Association. Ms. Bolton explained the vehicle in question was owned by the previous
property owner. The foreclosure action began in 2009; therefore, and the property came into
compliance prior to the foreclosure action.
Vice - Chairman Lowery, seconded by Member Carrington, moved that in Case #07 -106, that the
Code Enforcement Board recommend to the City Commission to reduce the fine to the City's cost
of $970.59. Motion carried, 4 -1, with Member Osborne dissenting.
