HomeMy WebLinkAbout02-24-2015 MinutesCODE ENFORCEMENT BOARD MINUTES February 24, 2015 CALL TO ORDER Chairman Robert Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:02 p.m. in the Commission Chambers at City Hall. Member Carrington gave the invocation, and Member Hopper led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice - Chairman Lowery, Members Blynder, Carrington, Hopper, Kelley and Osborne. Also present were Asst. Support Services Director - Code Enforcement Manager Doug Gaines, Code Enforcement Officers Edward Loeffler and Bob Siegrist; Administrative Assistant Bridgett Coffey, Board Attorney Mary Sneed, and Recording Clerk Diana Turner. ABSENT: GUESTS: UCF Graduate Student Dana ( ?) Administrative Assistant Coffey administered the oath to the code enforcement officers and to anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. The officer explained the property came into compliance in December 2012; the accrued fine is $375,000.00 and the City's cost is $923.50. The home came into compliance upon occupancy by the tenants. Angelia Gillette advised she is currently working with the mortgage company and the property owner to resolve the liens so that the home may be offered as a short sale. Officer Loeffler stated the property has been well- maintained since its compliance date. Member Osborne, seconded by Member Hopper, moved that in Case 912 -108, that the Code Enforcement Board recommend to the City Commission to reduce the fine to $923.50. Member Kelley inquired how the accrued fine could be so high if the property was in violation for only five months. After discussion with Staff, it was concluded the accrued fine amount is incorrect. The fine should be $37,500. After Board discussion: Motion carried, 4 -3, with Chairman Godek and Members Carrington and Kelley dissenting. Member Osborne, seconded by Member Carrington, moved that in Case #15 -019, the respondent be found in violation as cited as o January 22, 2015, and be given until March 6, 2015, to come in to compliance, or be fined $50 per day, for each day the violation remains in non - compliance; and to authorize the City to abate the nuisance and assess the costs to the fine. The Board explained that this was due to compliance of one of the Codes; otherwise, the previous case would have been cited for violating two Codes as well. Officer Siegrist — presented a photo showing the fence in Case #15 -007 was secured by the City. Member Blynder — apologized for missing the January meeting. Member Kelley — inquired if when the Board authorizes abatement of a property, it is done so at the City's discretion. Ofc. Loeffler explained that if a property is occupied, the City is not able to abate the nuisance. Mr. Gaines added that if the property is vacant, the City generally does abate the nuisance. Vice - Chairman Lowery — informed the Board of the Political Forum scheduled for February 25, 2015, at 6:00 p.m. in the Commission Chambers of City Hall. Member Osborne - thanked the officers for being proactive regarding the parking issues in neighborhoods. Chairman Godek — thanked the Board and staff for a job well done, and thanked the residents for coming in to compliance.
