REGULAR CITY COMMISSION MEETING
A. CALL TO ORDER
Mayor Vandergrift called the regular session to order at 7:15 p.m. in the Commission
Chambers of City Hall. Commissioner Keller gave the invocation, followed by the Pledge of
Allegiance to the Flag, led by Commissioner Wilsen. City Clerk Eikenberry called roll and
declared a quorum present.
Roll Call: Commissioner Grogan, Commissioner Wilsen, Mayor Vandergrift, Commissioner
Johnson, and Commissioner Keller.

B. PRESENTATIONS AND PROCLAMATIONS
Proclamations — April 2015 - Water Conservation Month
Mayor Vandergrift read his proclamation and proclaimed April as Water Conservation Month.
Utilities Director Smith briefly spoke about the new free AquaHawk Personal Conservation and
Alerting Tool that is currently available to Ocoee utility customers and will allow residents to get
alerts, text messages, or 24/7 access to their water consumption and monthly billing for their
residence.
Proclamation - Arbor Day — April 24 — This proclamation will be heard at a future meeting.
Parks and Recreation Director Hayes advised that the City would like to proclaim Arbor Day
on April 16 since they will be hosting a Tree Planting Ceremony and picnic in honor of Arbor
Day at the Ison Center on that day.

Mayor Vandergrift read his proclamation and proclaimed April 16 as Day of Remembrance.
C. COMMENTS FROM CITIZENS/PUBLIC
Jim Riffle, 2536 W. Ponkan Road, said he is representing the Ocoee High School Alumni
Association and would like to request the waiving of the fees for use of the Jim Beech Center for
Saturday, September 26` for their upcoming high school reunion. He has confirmed with Parks
and Recreation Director Hayes that the facility is available and they would also be glad to pay
any reasonable fees regarding the cleaning up of the facility, if needed. The Alumni would need
the facility for a few hours before the event to decorate.
Parks and Recreation Director Hayes shared that the fees being requested to be waived would
be $500 -$600 for rental of the facility and the $250 security deposit.
Commissioner Wilsen, seconded by Commissioner Grogan, moved to waive the
fees for use of the Jim Beech Recreation Center for Saturday, September 26,
2015. by the Ocoee Hiah School Alumni Association. Motion carried 5 -0.

Martha Lopez- Anderson, 2438 Alclobe Circle, said she is before the Commission to follow -up
on the Strategic Plan and find out where they are at this point with some of the key items that
they had discussed regarding downtown Ocoee. She further inquired if they would be doing any
public engagement with regards to the Strategic Plan.
City Manager Frank addressed Mrs. Lopez - Anderson's inquiry advising there was about
$600,000 in the budget from last year to embark upon a master plan for the items they discussed
regarding the downtown renovation project. Several meetings ago they engaged the services of
several companies to move forward with the master planning process which will tie into the 429
and Franklin Street. He further shared they do not anticipate much building this year but will
have a public engagement to get ideas from the community. Further discussion ensued regarding
the funding for the proposed future downtown project.
Mrs. Lopez- Anderson advised that as a citizen it is costing them money when the city does not
invest in the City. She is asking that the Commission please take the action and steps to move
forward because they cannot afford to do nothing any more. Commissioner Johnson
commented that he would like to have things sped up, including looking into bonds, so they can
have it set up and ready by October. Commissioner Keller said he will be going to Tallahassee
and he does plan on meeting with Legislatures to see if they can get some funding out of the
State. Last year, Senator Nelson, Senator Rubio and Congressman Webster were all favorable to
helping the City get some WIFA loans which may have a lower interest than bond money.
Commissioner Wilsen shared that some of the issues she feels they have encountered is that
every budget year they get residents who do not support them when they need to raise rates to
better the City. She will be asking her residents this budget year to come out to support their
decision so they can move forward. Commissioner Grogan briefly commented that the very
first step is to wait until the consultants they hired lay out the whole master plan for them. The
biggest time constraint he foresees for the City will be in acquiring property. Mayor
Vandergrift commented that they passed the fire fee so there will be money freed up that would
not be earmarked for the Fire Department and is something they can think about during the
budget season. Brief discussion ensued regarding the topics they had covered during their last
Strategic Planning.
D. STAFF REPORTS AND AGENDA REVIEW
City Manager Frank announced the following:
1) Cemetery fence construction is being finished this week to provide a new ornamental iron
fence with brick columns along the Geneva Street boundary along the north side of the
cemetery and a black vinyl- coated chain -link fence has been installed along the western
boundary. Lockable ornamental iron gates were also installed and the old sign was
refurbished and installed as a single unit on a brick base.
2) Police Recruiting Unit Open House — March 31, 2015, 6:30 -8:30. The Ocoee Police
Department's recruiting unit will be hosting an Open House for those hoping to get an
inside look at career opportunities with the Police Department. Administrative staff will
be present along with officers from the Recruiting Unit to answer questions and give
information regarding civilian and sworn open positions with the department. If you

E. COMMISSIONERS ANNOUNCEMENTS
Commissioner Keller — 1) thanked everyone that came out and voted this past election. 2) The
Ocoee Family Aquatic Facility will open for the 2015 season on Saturday, May 2nd starting at
11:00 a.m. Information on the pool hours and admission costs can be found on the city's
webpage www.ocoee.org or by calling the Beech Recreation Center at 407 - 905 -3180. 3) The
Parks and Recreation Department will begin accepting registration for its Summer Camp
Program. Registration for residents will be April 6th thru 10th and open registration will begin
April 13th for Ages 5 to 12 years. The Summer Camp will run from June 8th to August 21 st. For
more information contact the Beech Recreation Center at 407 - 905 -3180.
Commissioner Johnson — 1) announced parents interested in signing their children up for the
Parks and Recreation Department's Spring Break Camp, running from March 23rd through the
27th, can still do so by calling the Parks and Recreation Department at 407 - 905 -3180 or stopping
by the Jim Beech Recreation Center, at 1820 A.D. Mims Road. 2) The Parks and Recreation
Department will be hosting its monthly Food Truck Friday event on Friday, March 20th, from
6:00pm to 9:00pm on Lakeshore Drive, in Bill Breeze Park. Food trucks will be offering
gourmet food and delectable treats, and the movie "Guardians of The Galaxy" will be shown
during the event; the movie will start at 7:30p.m., so come out and enjoy a dinner and a movie in
the park.
Commissioner Wilsen — 1) thanked everyone that came out to vote especially her residents for
their vote of confidence. 2) Spring Fling was a great success and thanked all the volunteers who
helped make it a successful event. 3) Public Safety Academy — April 9, 2015 through June 11,
2015, from 6:00 pm -9:00 pm. The Ocoee Police Department and Fire Department will be hosting
our annual Public Safety Academy. If you have any questions, please contact Officer Patera
Scott-Marsh at (407) 905 -3160 ext. 3024 or Patera.scottgocoee.org 4) S.A.F.E. Class — April 2,
2015, 6:00 pm -9:00 pm. This is a free, one time, three hour presentation on self - defense and
safety awareness for women. The class is taught by Ocoee Police Officers using the NSDI's
S.A.F.E. curriculum. Topics covered include: self - defense, crime prevention and domestic
violence. You must be at least thirteen years of age to attend. The class is held at the Ocoee

Commissioner Grogan — 1) announced the City's new CivicPlus website was launched and is
being rapidly improved as more content and functionality is created. 2) thanked the Public
Works Department and Director Krug for the recycling program and the savings to the City of
$1500 /per week in labor costs. 3) The Parks and Recreation Department will be sponsoring its
Annual Easter Eggstravaganza on Saturday, April 4th at the Jim Beech Recreation Center from
10:00 a.m. to noon. There will be Easter Egg Hunts for children from infants to 12 years of age;
along with prizes, bonce houses, arts & crafts, face painting, coloring contest, clowns, DJ Todd
and pictures with the Easter Bunny. For more information contact the Parks and Recreation
Department at 407 - 905 -3180. 4) The City of Ocoee Parks and Recreation Department will be
hosting its annual Big Orange Games on Saturday, April 18th at the Ocoee High School Football

Mayor Vandergrift — 1) announced they had a low turnout of voters for this past election with
13% voting in District 2 and 8% voting in District 4. He further encouraged residents to please
exercise their right to vote. 2) thanked the volunteers who helped with the Spring Fling and the
safety of the children.

2. Approval of Resolution and Railroad Reimbursement Agreement for Municipal Grade
Crossing Traffic Control Devices — Bowness Road (Maguire). (Public Works Director
Krug) _. .
This agreement provides for funding from the Federal Highway Administration to the FDOT to install new
railroad grade crossing signals on Bowness Road (Maguire) at the Florida Central Railroad crossing. The
purpose of this agreement is to allocate the Federal funds to upgrade existing grade crossing signals to meet
current requirements.
The signal upgrades are funded through a FHWA Aid Project administered by the FDOT. The financial impact
to the City is the continuation of the annual $3,402.00 maintenance fee already incorporated in the budget.
Approved on Consent. Motion carried 5 -0.
3. Approval of Resolution and Railroad Reimbursement Agreement for Municipal Grade
Crossing Traffic Control Devices — North Clarke Rd. (Public Works Director Krug)
The City approved an agreement at the November 5, 2013, Commission meeting providing for funding from the
Federal Highway Administration to the FDOT to install new railroad grade crossing signals on North Clarke
Road at the Florida Central Railroad crossing. The purpose of the agreement was to allocate the Federal funds
to upgrade existing grade crossing signals to meet current requirements and the upgrades have been completed.
The Railroad has noted a clerical error in that the annual maintenance cost participation for the City was
erroneously shown as 50% percent when it should have read 100% percent. The 100% cost participation is
based on the Stipulation of Parties adopted by the City in 1992 for the construction of the then new Clarke Road
over the existing railroad. The agreement conforms to the correct cost participation originally stipulated and
approved by the City.
The signal upgrades have been funded through a FHWA Aid Project administered by the FDOT. The financial

4. First Reading of Ordinance — Change in Chapter 75, False Alarm Response Fees. (Second
Reading and Public Hearing scheduled for April 7, 2015, Regular Commission Meeting at 7:15 p.m. or soon
thereafter). (Police Chief Brown)
Chapter 75 of the City Code provides procedures and fines /fees for City Police and Fire Department responses
to false alarms or the activation of an alarm system due to reasons including, but not limited to, mechanical
failure, malfunction, improper maintenance, or other negligent or intentional acts. Responding to a false alarm
is a poor use of resources, resulting in unnecessary costs to the City and presenting a risk to public safety due to
the unnecessary diversion of critical public safety resources. For this reason, staff believes the ordinance should
be updated and clarified.
Currently, enforcement of alleged false alarm violations are heard by the City's Code Enforcement Board.
However, under the proposed changes, alleged violations will be heard by the City's Violations Hearing Board.
Additionally, the proposed changes include establishing a flat fine of $100.00 for fourth and any subsequent
violations occurring in a six month period.
City Attorney Cookson read the title of the Ordinance. Mayor Vandergrift announced the
second reading and public hearing will be held on April 7, 2015, Regular Commission Meeting
at 7:15 p.m. or soon thereafter.
H. FIRST READING OF ORDINANCE — PUBLIC HEARING
First Reading of Code of Ordinances Amendment — Road Impact Fee Reduction.
(Advertised in the Orlando Sentinel on Sunday, March 8, 2015. Second Reading and Public Hearing scheduled
for April 7, 2015, Regular CqptLt Mision Meeting at 7:15 p. m. or soo__. & ; E4 ter). (City Planner Rumer)
The road impact fee ordinance was adopted in 1989, and then amended in its entirety in 1999 and 2005. The
ordinance update in 2005 increased the impact fees by as much as 113 %. The City Commission requested a
study of the City's transportation impact fees back in 2013 which was provided by CDM Smith consultants.
This ordinance is a result of the Commission's directive and further work by CDM Smith. This ordinance
decreases most impact fees by roughly 25% with a few land uses receiving less of a decrease due to the
expansion of the City's limits.
This ordinance does not provide amendments to the other impact fees and capital charges. Police, Fire, and
Recreation impact fees will go back to their full rates as of April 1, 2015. Water and Sewer Capital charges are
adjusted yearly by the CCI index.
City Attorney Cookson read the title of the Ordinance.
Mayor Vandergrift opened the public hearing.
City Planner Rumer advised that he will be giving a staff report at the second reading and
public hearing. He shared that at this time staff as not received any opposition to this ordinance.

L SECOND READING OF ORDINANCES - PUBLIC HEARINGS
6. Swatkowski - 112 Lee Street. (Advertised in the West Orange Times on Thursday, March 5, 2015, and
Thursday, March 12, 2015). (City Planner Rumer)
The subject property is located on the North side of Lee Street, 200 feet east of the intersection of N Kissimmee
Ave and Lee Street. The subject parcel has one existing Single - Family Residence and numerous structures used
for agricultural processing. The Applicant is annexing into the City limits as a condition to receive city potable
water connection. The applicant has requested a City of Ocoee zoning designation of A -1 (Agriculture), which
is consistent with the zoning of the adjacent Orange County properties on the south.

City Planner Rumer gave a background summary of the proposed annexation which included
general location and future land use designation. The subject parcel has one existing Single -
Family Residence and numerous structures used for agricultural processing. The Applicant is

The DRC proposed three conditions to recommending approval of the annexation:
i) Provide documentation of environmental compliance to a past issue with Orange County EPD
ii) Have a minimum standards inspection,
iii) Initial fire inspection.
City Planner Rumer advised the applicant has complied with the conditions. The Planning &
Zoning Commission, acting as the Local Planning Agency, voted unanimously to recommend
approval of the Annexation of the +/- 5.01 acre parcel of land known as the "Swatkowski
Property" with an Initial Zoning classification of "A -1 ".
Mayor Vandergrift opened the public hearing for the annexation ordinance. As no one wished
to speak, the public hearing was closed.
Commissioner Johnson, seconded by Commissioner Wilsen, moved to approve
Annexation Ordinance No. 2015 -004 for Michael Swatkowski Property, per staffs
recommendation. Motion carried 5 -0.
Mayor Vandergrift opened the public hearing for the rezoning ordinance.
Mike Swatkowski, applicant, thanked the Commission for the consideration of the annexation
and commented that regardless of the vote they support Arbor Day and would like to donate and
plant five (5) Cathedral Oak trees. It was asked that Mr. Swatkowski meet with Parks and
Recreation Director Hayes.
Mayor Vandergrift closed the public hearing.
Commissioner Johnson, seconded by Commissioner Grogan, moved to approve
Rezoning Ordinance No. 2015 -005 for Michael Swatkowski Property, per staff s

7. Chaudhry & Angard - 1102 E. Silver Star Road - Annexation Ordinance. (Advertised in the
West Orange Times on Thursday, March 5, 2015, and Thursday, March 12, 2015). (City Planner Rumer)
The subject properties are located on the west side of 2nd Street and east side of Whittier Avenue, fronting E
Silver Star Road. The subject parcels contain one single- family dwelling. With respect to State annexation
criteria, Chapter 171.044 of the Florida Statutes grants municipalities the authority to annex contiguous,
compact, non - circuitous territory so long as it does not create an enclave. The subject property is considered
contiguous to the City of Ocoee since it is bordered by property located within the City limits on the north,
south and east.
City Attorney Cookson read the title of the annexation ordinance.

J. REGULAR AGENDA
Code Enforcement Reduction of Fine /Lien by Realtor William G. Jefferson on behalf of
Lindsey Cunningham Regarding 2603 Coventry Lane. (Assistant Director of Support
Services Gaines)
This case involved a vacant property with a missing fence gate leading to an un- secured pool enclosure and an
in- ground swimming pool with green unsanitary water. These were conditions constituting an attractive public
nuisance to the public health, safety and welfare. The property owner, Lindsey Cunningham, was cited on July
3, 2012, by Code Officer Edward Loeffler. The codes in violation were: 115 -3 prohibited acts, 115 -6
unsanitary swimming pool water and 108 -35 public nuisance. On July 24, 2012, the Code Enforcement Board
issued an order to comply by August 7, 2012, or be fined $100.00 per day per violation. On August 31, 2012,
the Code Enforcement Board imposed fine and lien for non - compliance. The violations were found in
compliance on December 11, 2012.
On February 24, 2015, the Code Enforcement Board re- opened the case. The board recommends that the
$37,500.00 fine /lien be reduced to the city's cost of $923.50. The discussion by the Board to reduce the amount
was based on testimony and answers from Ms. Angelea Gillette and city staff.
Assistant Director of Support Services Gaines gave a brief history of the case located at 2603
Coventry Lane. The property owner, Lindsey Cunningham, was cited on July 3, 2012, by Code
Officer Edward Loeffler. The codes in violation were: 115 -3 prohibited acts, 115 -6 unsanitary
swimming pool water and 108 -35 public nuisance. On July 24, 2012, the Code Enforcement

Lindsay Cunningham, former property owner, still resides on the property. He is requesting the
lien amount be reduced to facilitate a traditional sale to the current quit claim owners, who got
the property via quit claim in December 2014. On February 24, 2015, the Code Enforcement
Board re- opened the case. The board recommends that the $37,500.00 fine /lien be reduced to the
city's cost of $923.50. The discussion by the Board to reduce the amount was based on testimony
and answers from Ms. Angelea Gillette and city staff.
Ms. Angelea Gillette, representative for the applicant, said that in 2012 she was solicited by the
owner to negotiate the short sale process. She said when she got involved she was managing the
property and got the pool and fence fixed. There was discussion regarding the conveyance of the
property, and City Attorney Cookson clarified that Mr. Cunningham will be selling it in a short
sale and not getting any proceeds from the sale. Commissioner Keller said he is concerned that
the property was in non - compliance for 6 months before it was corrected, and the pool and fence
were serious safety issues. No action has been taken to clear this up until they are trying to sell.
Commissioner Keller, seconded by Commissioner Wilsen, moved to approve per
staff's recommendation to reduce the fine to $933.50 to be paid within 30 days or
it reverts back to the original lien amount. Motion carried 4 -0 with Mayor
Vandergrift away from the dais.
9. Most Valuable Partnership Grants — Cycle 2014/2015. (Community Relations Manager
Wright)
The Most Valuable Partnership Grants Program has been in operation for several years. The grant program
assists Ocoee neighborhoods and organizations with projects that will enhance property values and improve the
quality of life in Ocoee. The MVP grant program is a matching grant program held annually in November. The
maximum matching grant award is $2,000. Funding is not given up front, but is reimbursed at the completion
of the organization's project. Applicants fund their improvement projects and then get a portion back, up to a
maximum of $2,000. Six applications were submitted. Two organizations, Silver Glen HOA and Dirty Jeans
4H, withdrew their applications, leaving four applicants. The total amount of grant monies requested from the
four applicants is $7,500. There is $12,000 funded for the MVP Grant Program. The following four
organizations were recommended to receive grants: Admiral Pointe HOA; Roberts Rise HOA; Rotary Club of
Ocoee and Sleepy Harbour HOA.
This item was moved up and heard out of agenda order.
Community Relations Manager Wright advised six applications were submitted. The total
amount of grant monies requested from four applicants is $7,500. There is $12,000 funded for
the MVP Grant Program. The following organizations were recommended to receive grants:

The Community Grant Review Board (CGRB) met on August 12, 2015, to discuss the 12 applications received
for the Community Grant Program (formerly the Community Merit Awards Program). The Community Grant
Program provides financial grants of up to $500 to non - profit organizations and civic groups located within the
city limits or are located outside the city limits but benefit residents of Ocoee. The grant cycle is open twice

yearly (January and July) to acknowledge excellence and further the contributions these local organizations
bring to the Ocoee community.
There is $5,000 allotted for this cycle of the Community Grant Program. The Community Grant Review Board
recommended funding 8 organizations in the total amount of $4,000. The CGRB recommended the following
three organizations do not receive grant funding: Garden Community Choir, Center for Muliticultural Wellness
and Prevention, Inc. and Orlando Chargers Basketball Organization.
This item was moved up and heard out of agenda order.

Commissioner Wilsen, seconded by Commissioner Grogan, moved to approve
Community Grant Program — January 2015 Cycle per staff's recommendation.
Motion carried 5 -0.
Jim Sills, Chairman of the Community Grant Review Board, thanked the Commission for
allowing the funds for this program. He shared a positive comment from one of the applicants
who was not awarded a grant but stated that Ocoee is light years ahead of other Cities for
allowing this program.

I1. Approval of Bluford Avenue Drainage Project Resolution for Acquisition by Eminent
Domain — Brown Property. (Public Works Director Krug)
The City Commission approved the acquisition of right of way required for the Bluford Avenue Stormwater
Project at the November 19, 2013, meeting, authorizing the Attorney to make the statutorily required pre -
condemnation offer letters at the appraised values and then proceed to eminent domain. Ms. Karen Brown,
Parcels 101 & 701, had agreed to accept the appraised values for both parcels totaling $7,310.00. The
Commission approved the Purchase Agreement for said parcels at the March 4, 2014, meeting authorizing the
Attorney to complete the subsequent closing actions with the property lien holders. Since the last Commission
action on this property, one of the lien holders has foreclosed on the property and is no longer willing to
participate in the purchase agreement. The Attorney has recommended proceeding with the eminent domain
process to acquire these two (2) final remaining parcels required for the project.
Public Works is requesting the City Commission approve the Resolution relating to the acquisition by eminent
domain for the Brown Parcels 101 & 107. In conjunction with the Resolution, the required property survey and
updated property appraisal have been authorized by Public Works to proceed concurrently. The Attorney is
preparing to file suit immediately following receipt of the required documents which are currently scheduled for
completion by the second week in April. The Order of Taking will be approximately 60 days from filing and is
dependent on the volume of actions filling the docket. Following the Order of Taking, the City can take

possession of the property as soon as we deposit the good faith estimate of value and the bidding process can
proceed. This is the last acquisition required for the project and the only property requiring condemnation. The
property acquisition is adequately funded in the project budget.
Public Works Director Krug advised we have acquired all of the properties except one on the
corner of Bluford Avenue and 7` Street, Brown Property. Due to financial distress all of the
parties are not able to cooperate with a sale, staff is recommending proceeding with acquisition
through eminent domain in order to move forward with the drainage project. Commissioners
consented that we have been trying to get this done for a long time.

Commissioner Johnson, seconded by commissioner Wilsen, moved to approve
Resolution No. 2015 -112, approving the acquisition of property by eminent
domain per staff's recommendation. Motion carried 5 -0.
12. Election of Mayor Pro Tem. (City Clerk Eikenberry)
Section C -9 of the Ocoee City Charter states: ... The Mayor pro tem shall be elected from among the
Commissioners by the City Commission but shall continue to represent the district in which such Commissioner
resides. The Mayor pro tem shall be elected at the first City Commission meeting following the swearing in of
the candidates elected at each general city election ... and shall serve as Mayor pro tem until the successor is
elected. On March 20, 2007, the Commission created a policy to elect the Mayor Pro Tem annually, even in
non - election years, by rotating down through the seniority list, beginning with Commissioner Johnson for the
term of March 2007 -2008. The following elections have been made since 2007:

Each year in March, the Commission reviews the Liaisons Appointments to various boards and makes changes,
if needed. In 2014 the following appointments were made:
Commissioner Wilsen inquired about the West Orange Airport Authority and if anything is
going on with it. Noted that we have not received a recent update from Mr. Maxwell.

L. COMMENTS FROM COMMISSIONERS
Commissioner Grogan — announced the Town Hall meeting on Thursday, March 19 regarding
HOAs with gated communities. He stated that many residents had confusion about the ordinance
that we are trying to pass, so they want a community input meeting.
Commissioner Wilsen — announced she has invited one gated community to attend the
upcoming Town Hall meeting and she plans on attending as well.
Commissioner Johnson — None
Commissioner Keller — advised Public Works Director Krug that one of the things he noticed
when he walked door to door campaigning is that there are a lot of sidewalks that need to be
shaved down. He doesn't know if we have a process in place to handle that, but many
subdivisions have sidewalk issues. Public Works Director Krug shared that they are handling
that issue as they can with limited resources. If any resident has a specific problem they can
contact him. Commissioner Keller said we may need to dedicate a small budget to the process.
Commissioner Johnson stated the City causes a lot of the problem with uplifted sidewalks due to
out tree and landscape requirements.
