BACKGROUND:
The road impact fee ordinance was adopted in 1989, and then amended in its entirety in 1999 and 2005. The
ordinance update in 2005 increased the impact fees by as much as 113 %. The City Commission requested a
study of the City's transportation impact fees back in 2013 which was provided by CDM Smith consultants. This
ordinance is a result of an update to the City of Ocoee Road Impact Fee. The update retains the standard
methodology that was used in previous impact fee calculations but applies updated trip generation
characteristics, trip lengths, and roadway improvement cost and credits. The update includes new data sources
such as the 9 th Edition ITE Trip Generation Report from 2012 and The Orlando Urban Area Transportation Study
(OUATS) study released in October 2014. Based on the updated calculation to Cost per Vehicle Mile of Travel,
Motor Fuel Tax Rebate, County 6 Cent Gas Tax credits, and trip lengths; this ordinance decreases most impact
fees by roughly 25% with a few land uses receiving less of a decrease due to the expansion of the City's limits.
This ordinance does not provide amendments to the other impact fees and capital charges. Police, Fire, and
Recreation impact fees will go back to their full rates as of April 30, 2015. Water and Sewer Capital charges are
adjusted yearly by the CCI index.
RECOMMENDATIONS:
Staff recommends that the Mayor and City Commissioners adopt the ordinance to decrease the Road Impact
Fee as depicted in Table 1.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, RELATING TO ROAD
IMPACT FEES; AMENDING ARTICLE I, CHAPTER 87 OF THE CODE OF
ORDINANCES OF THE CITY OF OCOEE TO PROVIDE FOR A DECREASE IN
ROAD IMPACT FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee ( "City Commission ")
recognizes that the adverse effects of the national recession and the financial and
credit crises are still impacting the state and local economy; and
WHEREAS, to address, in part, the impacts of these economic issues, the City
previously enacted ordinances which temporarily reduced road impact fee amounts;
and
WHEREAS, the temporary reduction of road impact fees, codified at Section 87-
4 of the Code of Ordinances of the City of Ocoee, is set to sunset on April 30, 2015;
and
WHEREAS, the City has received input suggesting that some of the economic
challenges could be addressed in part by permanently reducing the road impact fees
assessed to new development; and
WHEREAS, in 2014, Lake Transportation Engineering Consultants, Inc.,
completed a transportation impact fee study (Study) based on existing and potential
land use, units of measures, and reflecting full and reduced impact fees; and
WHEREAS, the City Commission finds it to be in the best interest of the citizens
of Ocoee to try to encourage economic development by reducing the road impact fees
assessed to new development and updating the categories as indicated in the Study;
and
WHEREAS, the City Commission has determined that such a reduction will not
adversely impact the ability of the City to meet its financial obligations.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority The City Commission of the City of Ocoee has
the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the
State of Florida and Chapter 166, Florida Statutes.
SECTION 2. Section 87 -14. Schedule of Fees. Section 87 -14 of the
Code of Ordinances of the City of Ocoee, relating to the Schedule of Fees, is hereby
amended as follows:
See Exhibit "A" attached hereto and by this reference made a part hereof.
SECTION 3. Severability If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the validity of the remaining
portion hereto.
SECTION 4. Codification It is the intention of the City Commission of
the City that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City; and that sections of this Ordinance may be
renumbered or relettered and the word "ordinance" may be changed to "chapter,"
"section," "article," or such other appropriate word or phrase in order to accomplish
such intentions; and regardless of whether such inclusion in the Code is accomplished,
sections of this Ordinance may be renumbered or relettered and the correction of
typographical errors which do not affect the intent may be authorized by the City
Manager, without need of public hearing, by filing a corrected or recodified copy of
same with the City Clerk.
SECTION 5. Effective Date This Ordinance shall become effective on
May 1, 2015.

EXECUTIVE SUMMARY
The purpose of this report is to provide an update to the City of Ocoee's Road Impact
Fee. The update retains the standards based transportation impact fee methodology
that was used in previous studies. This approach is the most commonly -used
methodology in Florida and elsewhere.
Originally implemented in 1989, the City's road impact fee has periodically been
updated to reflect changes in the transportation factors that are the bases for the road
impact fee calculations. The updated factors are: trip generation rates and pass -by
percentages, travel patterns trip lengths, roadway improvements costs and update to the
motor fuel and gas tax revenues credit. Based on these revisions, the recommended
Road Impact Fee Schedule is displayed in Table 1. The support documentation for the
recommended road impact fee is provided in the following sections.

UPDATE T TH ROAD IMPACT FEE
The purpose of this report is to provide an update to the City of Ocoee's Road Impact
Fee. The update retains the standards based transportation impact fee methodology
that was used in previous studies. Four major components make up the road impact fee
calculation. They are trip generation characteristics, travel patterns trip length,
roadway improvement costs and credits.
Road Impact Fee Formula
The general equation used to compute the road impact fee for a given land use is:
Demand x Cost — Credit = Fee
The demand for travel placed on the City's transportation network is expressed in units
of vehicle lane miles of travel that is determined based on trip generation rates and trip
lengths for each land use. The cost of the improvement is expressed in the cost per
vehicle lane mile of travel. The credit is an estimate of the revenues generated by the
land use that will generate a motor fuel tax rebate and a gas tax rebate to the City.
Therefore, multiplying the land use demand times the improvement cost minus the tax
credit results in the Road Impact Fee for each land use.
Trip Generation
The first componet utilized in calculating a road impact fee is the average trip
generation rate for each land use. The trip generation trip rates were updated using the
9th Edition ITE Trip Generation Report, 2012 data and the 2nd Edition ITE
Trip Generation Handbook pass -by percentages supplemented with local data.
Table 2 is a comparison of the various land uses and the daily trip generation rates and
pass -by percentages between the last update (1998 using the 6th Edition ITE Trip
Generation Report) and the current 2012, 9th Edition ITE Trip Generation
Report trip generation rates. The table lists the proposed Average Trip Generation
Rate (ATGR) for each land use. The ATGR was calculated by mulpying the 9th Edition
Daily Trip Rate times the Percent Primary percentage.

Travel Patterns Trip Length
The second componet utilized in calculating a road impact fee is the average trip length.
Table 3 presents the comparison between the 1998 study trip lengths, the Florida
Statewide trip length, the Orange County trip length for 2oo1 and 2012, the current
OUATS trip length based on travel within the City limits and areawide travel and the
proposed average trip length. As can be seen from Table 3, moving from the macro
Statewid level to the micro City level, trip lengths become shorter. As documented in
the countywide trip lengths, as more local data was collected, the trip length of various
land use has also changed over time. In addition, the MATS model assignment of the
various land uses assigned to the City roadway network when compared to the areawide
model network represents an average 40% shorter trip length for trips made within the
City. Based on the results of the OUATS model assignments, the Statewide trip lengths
and the changes within the Orange County trip length data the City of Ocoee Proposed
Trip Length (PTL) were updated as shown in Table 3.

Roadway Improvements Cost
The third componet utilized in calculating a road impact fee is the cost of the roadway
improvements programmed within the City of Ocoee jurisdication. The adopted City of
Ocoee Fiscal Year 2015 -2019 Capital Program and 2014 -2015 Adopted Budget were
used to develop a cost per vehicle lane mile. Table 4 presents the roadway or
intersection name and programmed improvement, the length of lane miles added, the
per lane capacity added and the calculated Cost per Vehicle Lane Mile of Travel based
on the total number of roadway /improvements listed is $233.85•
Credits
The fourth componet utilized in calculating a road impact fee is the amount of credit
generated by the motor fuel tax rebate and the Orange County 6 cent gas tax that is
returned to the City. Without these credits, the total funding collected for a
roadway /intersection improvement from impact fees, motor fuel tax, and license fee tax
would be greater than the actual cost for the improvement. The credits "reimburse"
those who pay impact fees for the taxes they will generate in the future for
roadway /intersection improvements. Table 4 also presents the Adopted Budget Fiscal
Year 2014 -2015 Motor Fuel Tax Rebate and County 6 Cent Gas Tax total and the
calculation of the 20% that would be earmarked for Road Impact Fee credit. The per
Vehicle Lane Mile of Travel Credit is $28.02.
Study Conclusions

NOTICE IS HEREBY GIVEN that the OCOEE CITY COMMIS-
SION will consider adopting an Ordinance thereby providing
for a decrease in Road Impact Fees as set forth in the following.

DA, RELATING TO ROAD IMPACT FEES; AMEND-
ING CHAPTER 87 OF THE CODE OF ORDINANC-
ES OF THE CITY OF OCOEE TO PROVIDE FOR A
DECREASE IN ROAD IMPACT FEES; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICA-
TION; PROVIDING AN EFFECTIVE DATE.
The CITY COMMISSION will hold a public hearing on the pro-
posed ordinance on TUESDAY, APRIL 7, 2015, AT 7:15 PM
or as soon thereafter as practical. The' public hearing will be
held in the City Hall Commission Chambers located at 150 North
Lakeshore Drive, Ocoee.
Interested parties may appear at the public hearing and be
heard with respect to the proposed actions above. The complete
case file may be inspected at the Ocoee Development Services
Department /Planning Division located at 150 North Lakeshore
Drive, Ocoee; Florida between the hours of 8:00 a.m. and 5:00
p.m., Monday through Friday, except legal holidays. The City
Commission may continue these public hearing to other dates
and times, as it deems necessary. Any interested party shall
be advised of the dates, times, and places of any continuation
of these or continued public hearings shall be announced dur-
ing the hearing and no further notices regarding these matters
will be published. You are advised that any person who desires
to appeal any decision made at the public hearings will need
a record of the proceedings and for this purpose may need to
ensure that a verbatim record of the proceedings is made which
includes the testimony and evidence upon which the appeal is
