Background Summary: The Villas at Woodsmere townhouse development is located on the west side of Good Homes Road, just north of SR 50 and the Good Homes Plaza. The property has a Professional Offices and Services Future Land Use designation in the Comprehensive Plan and is zoned P-S. The northern edge of the subject property abuts part of the Rose Hill subdivision in Orange County. The southern edge and western edges of the subject property abut the Good Homes Plaza shopping center and an existing retention pond. This site is covered with planted pines and a mixture of oak trees and other varieties of trees scattered around the property. The Development Review Committee, at its meeting on January 26, 2005, recommended approval provided certain changes were made to the plans before they were considered by the Planning and Zoning Commission. The Planning and Zoning Commission, at its February 8, 2005 meeting, reviewed the plans and recommended approval provided the developer makes certain changes to the plans for Villas at Woodsmere. Issue: Should the Mayor and City Commissioners approve the Preliminary I Final Subdivision Plan and Site Plan for the Villas at Woodsmere? Recommendations Staff recommends the Mayor and City Commissioners approve the Preliminary I Final Subdivision Plan and Site Plan for the Villas at Woodsmere, as date stamped received by the City on February 21, 2005. Scott Vandergrift STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Thomas Grimms, AICP, Senior Planner DATE: February 14,2005 RE: Preliminary /Final Subdivision Plan and Site Plan for Villas at W oodsmere ISSUE Should the Mayor and City Commissioners approve the Preliminary / Final Subdivision Plan and Site Plan for the Villas at Woodsmere? BACKGROUNDIDISCUSSION The Villas at W oodsmere townhouse development is located on the west side of Good Homes Road, just north of SR 50 and the Good Homes Plaza. The property has a Professional Offices and Services Future Land Use designation in the Comprehensive Plan and is zoned P-S. The northern edge of the subject property abuts part of the Rose Hill subdivision in Orange County. The southern edge and western edges of the subject property abut the Good Homes Plaza shopping center and an existing retention pond. This site is covered with planted pines and a mixture of oak trees and other varieties oftrees scattered around the property. On March 16, 2004, the City Commission approved the Conceptual Plan for the Villas of Woodsmere. Condition of Approval # 2 of that approval stipulated that a Preliminary Subdivision Plan for the project be submitted within 90 days of the City Commission action unless the Commission grants an extension (per Article IV, Section 4-6 A.(4)(e) 3. City Code). In a June 7, 2004 letter, the developer requested a 90-day extension for the Conceptual Plan approval in order to complete the Preliminary Subdivision Plan. Staff supported the extension. At the January 4, 2005 meeting, the City Commission under its consent agenda, voted to grant an extension of approval of the Conceptual Plan with the stipulation that a Preliminary Subdivision Plan for the project be submitted within 90 days. The plan provided met that condition. DISCUSSION: The Villas at Woodsmere subdivision includes 64 townhouse lots on about 6.4 acres. As shown in the Plan, there is an existing 7' brick wall along the entire southern boundary of the site. The Developer will construct a new 7' brick wall along the entire northern and western boundaries of the site to buffer the townhouse development from the existing Rose Hill subdivision. Turn lanes on Good Homes Road will also be provided. The Land Development Code requires a minimum living area of 1,200 square feet per unit for townhouses, which has been exceeded in this Conceptual Plan (the plan shows an minimum 1,500 square feet). The only waiver requested and granted by the City Commission on March 16, 2004 was from the maximum cul-de-sac length of 800 feet, due to the unique constraints of limited access and the shape of the subject property. The Traffic Impact Analysis shown on the Plan indicates that the impact of the proposed townhouse development is less than the impact that would have been generated by an office development on this property, thereby meeting the criteria set forth in the Code for a development that is inconsistent with the underlying zonmg. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC), on January 26, 2005, reviewed the proposed Villas at Woodsmere Subdivision development and a number of issues were discussed. The DRC voted to recommend approval of the Preliminary / Final Subdivision Plans and Site Plan, provided the developer incorporates the changes discussed during the DRC meeting into a revised set of Preliminary / Final Subdivision Plans and Site Plan. These were: . The road into the project will be a private road but not gated and will not be set up for gating in the future. The developer must put a definitive note in the plans indicating as such. . It was agreed that there would be an increase in spacing between units 53-60 with enhanced landscaping. . The developer will review the need to install sidewalks along the townhouse units along the access roads, that is along units 53-60, 37-42, and 61-64. . There will be raised curbs along each side of the internal road where there are not a series of driveways. PLANNING AND ZONING COMMISSION RECOMMENDATION: At its February 8, 2005 meeting, the Planning and Zoning Commission reviewed the proposed development and raised various issues with the developer. The developer's representative agreed to adjust the street lighting to 250 watts, and will add sidewalks along the northwest edge of the cul-de-sac (units 33-36). He also agreed to place sidewalks along units 53-56. The Planning and Zoning Commission voted to recommend approval of the Preliminary /Final Subdivision Plan and Site Plan with the following conditions: . The internal roads are to be private and not gated and not gated anytime in the future. . Increase the spacing between units 53 and 60 and add enhanced landscaping. . Install sidewalks along units 33 - 36 and units 53 - 56. . Install raised curbs along south internal road where there is not a series of driveways. . Street lights are to be the Homeowner Association's responsibility and the access way (carriage) lights at the front door are to be the owner's responsibility with enforcement by the Homeowners Association. STAFF RECOMMENDATION: Based on the recommendation of the DRc and the Planning and Zoning Commission, Staff recommends that the Mayor and City Commissioners approve the Preliminary and Final Subdivision Plans and Site Plan for the Villas at Woodsmere, as date stamped received by the City on February 21, 2005. Transfer of the Ocoee Crown Point PUD Phase 1 Water and Sewer Systems to Orange Co tilities Background Summary: As a part of the phase 1 infrastructure for the Ocoee Crown Point PUD project development, the City of Ocoee has constructed the water and sewer systems which will be connected to Orange County Utilities. These systems have been constructed in accordance with the project plans and specifications and have been cleared for use by the Florida Department of Environmental Protection. As the developer of this project, the City is required to transfer the water and sewer systems to Orange County by execution of the Bill of Sale document. The execution of a Bill of Sale and a Maintenance Bond or Letter of Credit is required by Orange County, which is similar to the City of Ocoee' requirements for development. Issue: Authorization by the City Commission for the Mayor and City Clerk to execute the Bill of Sale to transfer the water and sewer systems constructed as a part of the Ocoee Crown Point PUD phase 1 infrastructure to Orange County. Recommendations: The Engineering and Public Utilities staff recommends the City Commission authorize the Mayor and City Clerk to execute the Bill of Sale to transfer the water and sewer systems constructed as a part of the Ocoee Crown Point PUD phase 1 infrastructure to Orange County and authorize delivery of a Maintenance Bond or Letter of Credit to Orange County in accordance with Orange County Utility requirements.
