Background Summary:
At the April 1, 2008, City Commission Meeting, the Annexation and Development Agreement (Agreement)
between the City and Maguire Shoppes II, LLC and Maguire Roberson LLC (Developer) was approved. This
Agreement allowed for the annexation of the remainder of the Belmere Planned Development into the City and
the development of the commercial and residential tracts that have become the CVS Commercial Center, My
Kids Academy, and the Casa Mirella Apartment complex. These developments are located at the southwest
corner of Maguire Road and Roberson Road.
As part of that Agreement, the City and the Developer agreed to construct a widened section of Roberson Road
west of the intersection with Maguire Road. This project would add turn lanes at the intersection to improve
traffic, add a left turn lane into the Casa Mirella complex, taper back to the two lane section on to the west,
provide some additional stormwater collection, and extend the City's reuse system west along Roberson Road.
The City contracted with the Developer to design, permit and to ultimately construct this project. It was
anticipated at that time that the total project would cost approximately $1,300,000, with the Developer's share at
approximately 22% of that overall cost to cover the left turn lane into the Casa Mirella complex and the
extension of the reuse system.
After many design iterations to reduce the scope to keep the road improvements within the existing right -of -way
and to not have to go to costly eminent domain for condemnation of additional right -of -way, the Developer has
secured bids for the Roberson Road Improvements Project. The Developer was only able to secure two
qualified bids with many companies declining to bid because of the size of the project or scheduling issues.
The bids are from Red Fox Trucking, Inc. at $559,711.36 and WLW, Inc. at $947,665.00. WLW, Inc. is the site
contractor for the Casa Mirella Apartment Complex. City Engineering staff has reviewed the low bid and
determined that it is reasonable and responsive.
This overall development will have paid the City $674,455.54 in Road Impact Funds for My Kid's Academy and
the Casa Mirella Apartments by the time the Certificate of Occupancy has been issued for the final apartment
building later this month. The City also secured Road Impact Funds, in the amount of $346,376.43, from
Orange County as a part of the Road Transfer Agreement approved and executed by the City and the County
in June of 2012, which had been previously paid by the Developer when the property was still in the County.
Therefore the city will collect $1,020,831.97 in Road Impact Funds for this portion of the Belmere Planned
Development. The Belmere Annexation and Development Agreement discussed the funding options of Road
Impact Fee Credits or for the City to reimburse the Developer for the construction project.
This project has been in the City's 5 -Year Capital Improvements Plan since the Agreement was approved. It
was placed in the "later" years of the CIP Budget because of the timing uncertainty. The project was moved
forward in this fiscal year's budget because of the monies collected from the initial phases of the development.
City legal staff has been securing Temporary Construction Easements from the four affected property owners
along the north side of the right -of -way to reconnect their existing driveways to the new road.
The Developer is requesting project administration funds to manage the project. That additional funding would
cover bonding and insurance, upfront financing, and general administration of the project. The total project cost
is $626,876.72 and it is broken into the Developer's share of $128,866.67 and the portion that the City will need
to fund of $498,010.06. The Developer's share is a little less than 21% of the overall project.
The Agreement required the Developer to begin and complete the construction of the project prior to the
completion of all of the planned development. Because of the length of time that has past since the execution
of the Agreement and the past economic issues, the overall development and the construction of the Roberson
Road Improvements did not occur according to how all parties involved envisioned in 2008. Additionally, the
Developer possibly has a buyer for the Casa Mirella Apartment complex and would not want the conditions of
the Agreement on the completion of the Roberson Road Improvements prior to the issuance of the final
Certificate of Occupancy to delay that transaction. The Developer has agreed to construct the Roberson Road
Improvements to completion and he wants to start that work upon the issuance of the purchase order from the
City.
Issue:
Should the City partner with Maguire Roberson, LLC for the construction of the Roberson Road Improvements
at the intersection of Maguire and Roberson Road.
Recommendations:
1) Staff recommends that the City Commission authorize the partnering with Maguire Roberson, LLC for
the construction of the Roberson Road Improvements at the intersection of Maguire and Roberson Road
and award a purchase order in the amount of $498,010.06 to Maguire Roberson, LLC for the City's
portion of the overall project.
2) Staff recommends that the City Commission approve the payment of $250 each for temporary
construction easement to reconstruct the driveways for the four affected properties on the north side of
Roberson Road.
3) Staff further recommends that the City Commission only require the Developer to start construction of
the Roberson Road Improvements and not have the project completed prior to the issuance of a
Certificate of Occupancy for the final apartment building.

As requested, Ur icorp National Developments, Inc. solicited four bids for the offsite work on
Roberson Rd. Two of the bidders declined to bid, Sitek and Blue Ox Excavating.
Of the other two bids received WLW was high, $917,665 excluding the administration fee for
Unicorp. Red Fox Trucking is the loxv bidder. Below is a breakdown of the overall project including
Unicorp's project administration costs:

Developer Ins 2 %: $ 11,194.23
Developer Overhead 5 %: $ 27,985.57
