April 28, 2015
CALL TO ORDER
Chairman Robert Godek called the regular meeting of the Ocoee Code Enforcement Board to order at
7:00 p.m. in the Commission Chambers at City Hall. Member Hopper gave the invocation, and Member
Kelley led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present.
PRESENT: Chairman Godek, Members Blynder, Hopper, Kelley and Osborne. Also present were Asst.
Support Services Director - Code Enforcement Manager Doug Gaines, Code Enforcement
Officers Edward Loeffler and Bob Siegrist; Administrative Assistant Bridgett Coffey, Board
Attorney Mary Sneed, and Recording Clerk Melanie Sibbitt and Nichole DeRienzo.
ABSENT: Vice - Chairman Lowery, excused and Member Carrington, excused.
GUESTS: None.
Administrative Assistant Coffey administered the oath to the code enforcement officers and to anyone
intending to speak regarding a case.

Officer Siegrist presented the case and gave its history. A re- inspection of the property was conducted on
April 10, 2015, and resulted in compliance. The officer explained the people who took over the property
have done an excellent job bringing into compliance. The total City's cost is $816.32, plus the accrued fine
of $24,400.00.
Claudie Montes, of Florida Dream Real Estate, said she was assigned to the property in February and it was
already in bad shape. There was an eviction process, so she was only able to meet with the Code Officer
until after that process. On April 9th, the eviction process was finished and it took them three days to bring
the property into compliance. Ms. Montes explained they are requesting a reduction of fine so they may list
the property for sale to a cash buyer who is willing to take the property "As Is ".
Member Osborne inquired about market value. It was appraised at $40,000 but there is about $35,000 in
repairs.

Member Kelley, seconded by Member Blunder, moved in Case #14 -060, that the Code Enforcement Board
recommends to the City Commission that the fine be reduced to $1,000 which includes the City's cost.

Claudie Montes, of Florida Dream Real Estate, said she is the leasing agent of the property and as soon as
they were in possession of the property, they were able to remove all of the trash within the property. The
bank paid $3,600 for the removal of all the trash inside the property. The property was in non - compliance

Kimberlee Frank, with Sell Fast Realty, explained Mrs. Kennington is an elderly woman who was unable
to maintain the property, which she has recently moved out of due to foreclosure. Ms. Frank has a cash
buyer ready to close and is requesting to reduce the fine to $1000.00 since the property is now in
compliance.
Member Hopper, seconded by Alt. Member Amey, moved that in Case #14 -085, that the Code Enforcement
Board recommends to the City Commission that the fine be reduced to $1, 000, which includes the City's
cost of $523.00. Motion carried unanimously.

building line, it is not screened from view with 6' opaque fence and gate. As of today, April 28, 2015, the

Assistant Support Services Director — Code Enforcement Manager Doug Gaines commented that the
compliance date given to the property owner will not give enough time to obtain a permit to come into
compliance.
Member Kelley explained he feels the respondent has the option to rent a storage unit until he is able to
obtain the permit. He also mentioned he noticed an additional violation of the respondent's trashcan
location.

Observation: Occupancy of a dwelling in violation of the Minimum Housing Standards Codes. Within all rooms, hallways and
the garage: conditions constituting a public nuisance and a nuisance to the public health safety and welfare. Life - Safety
violations. Physical and unsanitary conditions so lacking illumination or ventilation as to be dangerous to human life or
detrimental to the health of occupants or persons on or near the premises. Violations of the Minimum Standards Codes which
cumulatively impact upon premises to the point whereby conditions endanger human life or substantially and detrimentally affect
the safety or security of occupants. Interior air quality unwholesome and detrimental to the health of human beings. Hazard or
menace of fire to a greater degree than that customarily recognized as normal in preventing, suppressing or extinguishing fire or
which may obstruct, delay or hinder or may become the cause of an obstruction, a delay, a hazard or a hindrance to the
prevention, suppression or extinguishment of fire.

Animal waste and food waste littering interior of dwelling. Garbage, junk and debris stacked, positioned and stored within the
dwelling making impossible safe normal passage, egress, entry and exit. Doors, windows and hallways blocked and congested
with stored and stacked garbage, junk and debris. Inoperable toilet plumbing fixture with standing waste and related odor.
Missing, blocked and inoperable smoke detectors. No ventilation due to stacked and stored garbage, junk, debris blocking
windows and air conditioning vents. Stacked and stored garbage, junk and debris to the extent that risk of fire is increased, ability
to escape is decreased, ability to extinguish is decreased and danger to the health and safety of responding authorities is increased.

Officer Siegrist reported that as of today, April 28, 2015, the respondent is in full compliance; however,
they would have been in non - compliance for 22 days based on the board's compliance order. It was
calculated that the fine accrued at $300 for 22 days amounting to a total of $6,600.00. Member Osborne
inquired about the City's cost. Administrative Assistant Coffey advised that they do not have that amount
calculated at this time.
Member Hopper, seconded by Member Amy, moved that in Case #15 -031, that the respondent be found in
compliance as of April 28, 2015, and that no fine be assessed.
Member Kelley inquired if this would be considered a repeat violation should this come before them again.

The chairman answered in the affirmative. Board Attorney Sneed shared that if the City did end up abating
the property as stated in the original board order, then they could still come before the board to request to
impose the abatement cost.
