Colonial Drive (SR 50) adjoining Lake Bennet. The parcel numbers for this project are 20- 22 -28- 6156 -04 -000, 20- 22 -28- 6156 -03 -000 and 20- 22 -28- 0000 -00 -068. This project is proposing to construct a 302 unit multi - family, four -story apartment development on approximately 13.01 acres. The site is currently a part of the Ocoee Town Center lots 3, 4, and 6. The parcels are undeveloped. The project lies in Target Area 2 and is zoned "Community Commercial" (C -2). The Future Land Use designation for the subject site is "Commercial ". The table below references the future land uses, jurisdiction, zoning classifications and existing land uses of the surrounding parcels: Direction Future Land Use Zoning Classification Existing Land Use North Conservation /Floodplains Public Facilities /Institutional City of Ocoee (C -2) Vacant Undeveloped Land East Commercial City of Ocoee C -2 Commercial South Commercial City of Ocoee (C -2) Commercial Vacant Undeveloped Land Ocoee Town Center West Commercial City of Ocoee (C -2) Commercial Vacant Undeveloped Land On July 6, 2010, the City Commission adopted the "CRA Target Areas Special Development Plan ". The subject site is located within what is considered Target Area 2. Target Area 2 was further divided into two general sub areas (Sub -Area 1 and Sub -Area 2). Sub -Area 1, which is located along the frontage of Bluford Avenue and SR 50, provides for a more conventional suburban design while Sub -Area 2 is intended to be a more urban environment. The subject site is generally located in Sub -Area 2. Transportation: The applicant has submitted a traffic impact analysis (Oasis at Lake Bennet Apartments revised April 2015). The traffic study was performed in accordance with City of Ocoee requirements and a discussion with the City's transportation consultant on the methodology. According to the traffic analysis, the proposed development will generate an estimated 2,008 trips per weekday with 154 a.m. peak hour trips and 188 p.m. peak hour trips. The previously approved Ocoee Town Center commercial subdivision was approved with a trip generation of 6,823 daily trips and 646 at the peak hour. The traffic study results indicate a requirement to add an additional turn lane from south bound Bluford Ave on to east bound Hwy 50. The applicant's proportionate share contribution is 37% of the cost of the improvement. An additional proportionate share contribution for a future signalized intersection at Maine Street and Bluford Ave is required. The applicant is responsible for 1 % of the cost for the signalization. Urban Design: The site plan provides the land for the road network as proposed in the Target Area 2 overlay. The site plan, building layout and elevations are provided in the plans. Per the justification statement provided for in the site plan (Sheet CO) the proposed residential development meets the intent of the Target Area 2 overlay by proposing residential development that will compliment future retail, commercial, office and residential development; creating true multi -use walkable urban community within the CRA. Buildings are designed to be four stories with awnings on the street side, and have been pushed against the property lines to create an urban streetscape. Wide sidewalks with tree wells, open green spaces, a public park and pedestrian connectivity to all adjacent streets help promote walkability and a sense of place for residents and the public alike. A logical street and sidewalk network is provided. Parking is provided along the external streets with no parking located behind buildings. DISCUSSION: The Oasis at Lake Bennet Apartments Preliminary Site Plan (PSP) will be developed by seven, four -story apartment buildings with some associated garage parking on three (3) lots within the Ocoee Town Center. The proposed development will have all the requisite infrastructure and amenities (swimming pool & clubhouse) including some open space for the public. Dedication of right -of -way for the extension and construction of Richmond Avenue and Ocoee Town Center Boulevard will be provided in this development. All development will happen in one phase. Access into the subject site will be provided through Bluford Avenue and the existing Maine Street. The Developer is requesting four (4) waivers from the Land Development Code (See sheet CO). The waivers are: 1. Minimum 2 -Story buildings required in Sub -Area 2 of Target Area 1. 2. Two entrances required for each parcel. 3. Allowing Half Street. 4. All protected trees shall be replaced at a 4:1 ratio, in addition to required street trees and parking lot landscaping. The proposed waivers are justified per the waiver table. Staff does not object to the waivers as stated. Issue: Should the Honorable Mayor and City Commissioners approve the Preliminary Site Plan for The Oasis at Lake Bennet Apartments and the associated Development Agreement, subject to resolution of outstanding staff comments? Development Review Committee Recommendation: The Development Review Committee (DRC) met on May 5, 2015, and reviewed the Preliminary Site Plan for The Oasis at Lake Bennet Apartments. There were several issues to be addressed from city staff that were identified in written staff comments and /or presented verbally. There was some discussion on school concurrency, utilities, reuse water, open space, firefighting /protection access and road phasing. All of the issues were discussed and changes to the plans were agreed upon. The applicant was also notified that review comments on transportation and development agreement are still forth coming and that all comments need to be resolved prior to the item being scheduled for City Commission meeting. When the discussion was finished, the DRC voted to recommend approval of the Preliminary Site Plan, subject to the resolution of all staff comments. Planning & Zoning Commission Recommendation: The Planning and Zoning Commission (P &Z) reviewed the proposed Preliminary Site plan at the May 12, 2015, Planning and Zoning Commission meeting. The Planning and Zoning Board was split 3 -3 on approving additional apartments in Ocoee. The three P &Z members not in support of the proposed site plan and use stated they wanted more of an ownership driven development such as Condos. After deliberations on the project, a motion was made to recommend denial of the project. The P &Z voted 3 -3 and the motion failed for a lack of a majority. A second motion was made to recommend approval. The P &Z voted 3 -3 and the motion failed for a lack of a majority. Therefore, the Planning and Zoning Commission did not provide a recommendation for or against the project. Staff Recommendation: Staff supports the Preliminary Site Plan for The Oasis at Lake Bennet Apartments and associated Development Agreement, subject to resolution of outstanding staff comments.
