Subject: Potential Code Enforcement Special Magistrate
Background Summary:
At the request of the City Commission, staff was tasked with looking at the pros and cons of using a
Special Magistrate to replace the current Code Enforcement Board.
Issue:
The City Commission directive led staff to review several examples of cities with a Special Magistrate
program in place. These cities have programs that run exactly like a Code Enforcement Board, except
that the Special Magistrate hears the cases, issues the Findings of Fact and Conclusion of Law. The
Code Enforcement officers and staff continue to do their tasks as they always have. Liens and lien
reduction requests are also handled by the Special Magistrate.
Recommendations
After evaluating several options, the city commission has two clear choices:
1. Continue enforcing city codes using the current Code Enforcement Board.
2. Implement a Special Magistrate and establish operational guidelines and program rules.
Attachments:

Financial Impact:
There would be no significant financial impact to the city. The city could experience a $400 annual
savings in the cost of board uniforms, plus the meetings may run faster equating to a small reduction
from the Special Magistrate (current Board Attorney).
