Keller, District 4 ocoee florida PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MINUTES OCTOBER 13, 2015 I. CALL TO ORDER*7:00 PM A. Moment of Silence and Pledge of Allegiance B. Roll Call and Determination of Quorum 0 7:02 PM Present: Acting Chairman Marcotte, Member Keethler, Member de la Portilla, Member Dillard, Member West, and Member Sills. Also present were City Planner Rumer, Assistant City Attorney Crosby-Collier, and Recording Clerk Sibbitt. Absent: Chairman McKey and Member Briggs. II. CONSENT AGENDA*7:03 PM A. Minutes of the Planning and Zoning Commission Meeting held September 8, 2015 Motion for Approval of Minutes: Moved by Member Dillard, Seconded by Member Sills. Vote: Motion passed 5-0 with Member Keethler requesting to abstain due to not being in attendance at the September 8, 2015, Planning and Zoning Meeting. III. OLD BUSINESS-None IV. NEW BUSINESS*7:03 PM A. CSUSA Charter School Public Hearing City Planner Rumer 1. Special Exception for School Use City Planner Rumer gave a summary of the special exception for Charter School USA (CSUSA). In his presentation, he explained the PUD and zoning designation of the subject property located at the northeast intersection of Clarke Road and A D Mims Road. The proposed CSUSA Charter School consists of a two-story, 68,000 sq. ft. PreK-8th grade charter school for 1,145 students. The proposed campus will utilize a single school building with associated recreational field and tot lot. It was also advised that access to the site will be provided via two entrances; one located on Clarke Road, and a second on Ocoee Vista Parkway. The plan as proposed will provide approximately 4,686 feet of lanes, which are four wide stacking and an additional 400 feet of single lane stacking. Student drop-off access will be from Ocoee Vista Parkway during the allotted drop-off and pickup times. Additional access is from a new driveway on Clarke Road. The applicant is maintaining one (1) commercial out parcel along Clarke Road. 1 ( Page Planning and Zoning Commission Meeting October 13, 2015 The special exception as being presented is approving that the use fits within the area and is permitted, if it meets the criteria. Additionally, they would be approving the special exception plan as well; and, if there is any variance from that plan when the applicant goes through for building permits/site plan approval, then they would have to amend the special exception. City Planner Rumer advised a traffic stacking analysis was performed and further explained the requirements based on the traffic analysis report. He also gave further explanation on the Special Exception as defined in the Land Development Code. Upon review by the Development Review Committee (DRC) and staff, they do not find any indication that a school does not fit in that area. Additionally, they are confident in the traffic analysis requiring a light and signalization during peak a.m. and p.m. Discussion: Acting Chair Marcotte inquired if the traffic study included the entrance on Clarke Road as well. City Planner Rumer answered in the affirmative and further explained the vested number of trips that were included in the study for commercial. Acting Chair Marcotte further inquired if there was any idea what might be placed on the remaining C-2 parcels. City Planner Rumer advised that the developer has not indicated any use for those lots at this time; however, the only thing not compatible with a school within those lots would be a bar. A restaurant that serves alcohol would be compatible per the code. Member Keethler inquired if there was a process for charter schools to show that a school is needed in that area such as required for public schools. City Planner Rumer advised he could not answer on how public schools operate. Member Keethler inquired if the City had any concerns about having too many charter schools. It was answered that the City is not concerned at this time. Member de la Portilla inquired if CSUSA had approval from Orange County Public Schools for a charter. City Planner Rumer answered in the affirmative, but advised that he would have the developer confirm that question. Member Sills questioned the right-turn lane going into the school and how it would prevent the school traffic from going onto Ocoee Vista Parkway. City Planner Rumer explained the stacking area within the property and advised that it was increased to be about a mile long to avoid traffic spilling onto the main road. Additionally, if needed, the school could enforce a staggered release schedule for the students. Member Sills inquired what would prohibit the school traffic from using the commercial lots once those outparcels are developed. City Planner Rumer explained some of the options such as a fence that have been discussed with the developer. Todd Lucas, Summit Construction Management Group, shared that at this time they do not have any presentations, but he is available to answer any questions. Member de la Portilla inquired if he could answer the question regarding the charter school being approved by OCPS. Mr. Lucas advised they do have an active charter that was approved by Orange County specific to this location. Regarding the question on planned commercial use, it was 2 IPage Planning and Zoning Commission Meeting October 13, 2015 advised that at this time they are not moving forward with any commercial development for that location. Additionally, Mr. Lucas answered questions on the total acreage including parking that the school would occupy, number of students that would be attending, and the locations and attendance of other Charter USA operated charter schools. The public hearing was opened. The following residents spoke in opposition to the proposed Charter School: • Cheryl King, 2024 Switch Grass Circle • Michelle Greco, 1896 Compass Flower Way • Kay Ludd, 2083 Switch Grass Circle • Aleida Verdasco, 1711 Sparkling Water Circle • Brenda Euler, 2001 Compass Flower Way The public hearing was closed. Acting Chair Marcotte inquired how the notification process was handled for this public hearing. City Planner Rumer briefly explained the notification process for public hearings handled before the Planning and Zoning Commission as well as the advertisement process for the sale of the land heard before the Commission. He further advised the District Commissioner also held a town meeting, but he is not aware of how those notifications were handled since that was separate from the City's process. Member Keethler clarified that the only action the Commission has taken to date is only on the sale of the property. City Planner Rumer answered in the affirmative and further shared that they have only entered into a contract, and within that contract there is a period of due diligence inspection and other required processes before closing. Acting Chair Marcotte inquired if the issue of wildlife has been addressed. City Planner Rumer briefed Mr. Marcotte on wildlife inspections, which he advised is handled during the site plan process. Acting Chair Marcotte inquired if the concern of accidents on Clarke Road could be addressed. City Planner Rumer explained that a traffic study was conducted, and there are some items that do not meet the criteria for the study. Further discussion ensued on the future four lane of Clarke Road. Member de la Portilla shared his concerns regarding the land not being big enough to maintain a school for the proposed size. Motion to Deny Special Exception: Moved by Member de la Portilla, Seconded by Member Keethler.0 7:58 PM Each board member shared their concerns and opinions on the proposed project. After their brief discussion the motion passed as follows: Vote: Motion passed 5-1 to deny Special Exception. MISCELLANEOUS o 8:05 PM A. Project Status Report City Planner Rumer explained they currently have the following plans in review: • Final Site Plan for City Center West Orange • Final Site Plan for Oasis at Lake Bennet Apartments B. October Calendar Acting Chair Marcotte inquired about the Special Election on October 27th that was posted on the calendar and clarified that election was for the Mayor's seat. VI.
