NOVEMBER 24, 2015
CALL TO ORDER — NOVEMBER 24, 2015
City Clerk Eikenberry called the Canvassing Board to order at 4:14 p.m. in the office of the
Supervisor of Elections, 119 W. Kaley Street.
BOARD MEMBERS: Jean Grafton, Victoria Laney, and Martha Lopez- Anderson.
ALSO PRESENT: City Clerk Eikenberry, Assistant City Attorney Crosby- Collier, Orange
County Supervisor of Elections Bill Cowles, Supervisor of Elections
Representative Daughtry, Supervisor of Elections Representative Melendez and
Recording Clerk Sibbitt.
Audit Team Members Kathy Heard, Beth Lewis, Supervisor of Elections
Representative Mary Cruz, and Supervisor of Elections Representative Timothy
Frazier.
ABSENT: None.
OPEN ABSENTEE BALLOTS /PROCESSING THE ABSENTEE BALLOTS (through the
tabulator)
The opening of ballots and separating of the certificate (outer) envelopes from the secrecy
envelopes as well as the processing of the ballots were handled by the SOE prior to the
convening of the Canvassing Board.
VOTE TO ACCEPT THE ABSENTEE BALLOTS ACCEPTED BY THE SUPERVISOR OF
ELECTIONS OFFICE
City Clerk Eikenberry advised a motion would be required to accept the 1,159 absentee ballots
that the Supervisor of Elections Office ( "SOE ") has reviewed and deemed acceptable.
Canvassing Board Member Laney, seconded by Canvassing Board Member Grafton,
moved to accept the 1,159 absentee ballots reviewed and deemed acceptable by the SOE.
Motion carried unanimously.
REVIEW OF QUESTIONABLE BALLOTS
City Clerk Eikenberry announced that they received seventeen (17) questionable absentee
ballots for the Canvassing Board to review.
Questionable Ballot #1: Supervisor of Elections Representative Melendez briefly
explained the questionable absentee ballot received by Dorothy A. Hendrix. She advised
Ms. Hendrix tried to correct her no signature ballot by submitting the affidavit sent to her
by the Supervisor of Elections Office; however, her affidavit was received incomplete for
lack of providing identification with the affidavit.

Canvassing Board Member Lopez- Anderson, seconded by Canvassing Board Member
Laney, moved to reiect the ballot of Dorothy A. Hendrix for lack of providing identification
with the affidavit submitted. Motion carried unanimously.
City Clerk Eikenberry gave a brief explanation as to why the following ballots were deemed
questionable:
Questionable Ballots #2 - #12: Farhat Yaqub, Jayesh A. Patel, Eddie J. White, Sun Cha
C Bennett, Joseph M. Cymbura, Emile Ulysse, Theodore J. Eckbreth III, Evelyn Marks,
Carrie Cox, Jose Cosme Lopez, and Diderot Jean Baptiste - No signature on certificate
envelope. All voters were notified that their signatures were missing and did not
respond to the opportunity to correct their ballot by the date they were provided.
Canvassing Board Member Laney, seconded by Canvassing Board Member Lopez -
Anderson, moved to reject the ballots of Farhat Yaqub, Jayesh A. Patel, Eddie J. White

certificate envelopes. Motion carried unanimously.
Questionable Ballot #13: Nathan R. Koch - Signature did not match signature on file
with the SOE Office.
Canvassing Board Member Lopez - Anderson, seconded by Canvassing Board Member
Grafton, moved to reject the ballot of Nathan Koch due to signature not matching
signature on file for that specific absentee ballot. Motion carried unanimously.
Questionable Ballot #14: Macie H. Fogarty - Signature printed and does not match
signature on file with the SOE Office.
Canvassing Board Member Grafton, seconded by Canvassing Board Member Lopez -
Anderson, moved to reiect the ballot of Macie H. Fogarty due to signature printed not
matching signature on file for that specific absentee ballot. Motion carried unanimously.
Questionable Ballot #15: Rafael Yara - Signature printed and does not match signature
on file with the SOE Office.
Canvassing Board Member Grafton, seconded by Canvassing Board Member Lopez -
Anderson, moved to reject the ballot of Rafael Yara due to signature printed not matching
signature on file for that specific absentee ballot. Motion carried unanimously.
Questionable Ballot #16: Jordan M. Stone - Signature did not match signature on file
with the SOE Office.

Canvassing Board Member Grafton, seconded by Canvassing Board Member Lopez -
Anderson, moved to reject the ballot of Jordan M. Stone due to signature not matching
signature on file for that specific absentee ballot. Motion carried unanimously.
Questionable Ballot #17: Victoria L. Wright - Signature did not match signature on file
with the SOE Office.
Canvassing Board Member Laney, seconded by Canvassing Board Member Lopez -
Anderson, moved to reject the ballot of Victoria L. Wright due to signature not matching
signature on file for that specific absentee ballot. Motion carried unanimously.
PROVISIONALS
Supervisor of Elections Representative Melendez briefly explained the one provisional ballot
that had been received. She advised the voter (Luther Davis) had returned his absentee ballot on
November 9`" and it had been accepted. Mr. Davis, however, went to the polls to vote for which
it was explained that he had already voted. He opted to fill out the provisional ballot and stated
that he did not receive an absentee ballot because he was out of town. The absentee ballot
received does match the signature on file for Mr. Davis. Supervisor of Elections
Representative Melendez advised that it is not uncommon for some voters to remember if they
have already voted based on the time frame that they have to vote.
The SOE has already accepted the absentee ballot so if the Canvassing Board agrees with the
SOE then they would reject the provisional ballot.
Consensus of the Canvassing Board was to reject the provisional ballot of Luther Davis.
Motion carried unanimously.
POST LOGIC AND ACCURACY TEST & ZERO TAPE
SOE Representative Daughtry explained and compared the Pre Logic and Accuracy Test tape
with the Post Logic and Accuracy test tape he had just conducted. The City Clerk confirmed that
the accuracy test and zero tape read the same as the initial public test conducted on November
12th. The City Clerk signed and dated both tapes.
Audit Team Members Kathy Heard, Beth Lewis, Supervisor of Elections Representative Mary
Cruz, and Supervisor of Elections Representative Timothy Frazier were taken aside to be briefed
on the audit procedures.
CERTIFY THE ELECTION
Canvassing Board Member Lopez- Anderson, seconded by Canvassing Board Member
Laney, moved to certify the election with the following: Total ballots casted were 2,526 with
Jim Sills receiving 1,253 of the votes and Rusty Johnson receiving 1,270 of the votes plus 3
under /over votes. A recount was not necessary as the spread was more than .5% of the
vote. Motion carried unanimously. (Certification Attached)
Orange County Supervisor of Elections Bill Cowles shared that he felt they should have
waited to certify the election until all the boxes from the polling locations with the result tapes

were confirmed just in case a poll worker accidently placed a ballot in the box that will need to
be counted. Assistant City Attorney Crosby - Collier advised the Canvassing Board that they
could reaffirm their motion if they results were the same.
The ballot boxes arrived at 8:10 p.m. in which the Canvassing Board verified the result tapes to
the results provided by the SOE from the tabulator that had been certified.
Canvassing Board Member Laney, seconded by Canvassing Board Member Lopez -
Anderson, moved to accept the result tape for Precinct #2106 as being accurate with the
tabulation results of 521 votes. Additionally, the result tape for Precinct #3106 is accurate
with the tabulation results of 234 votes. Motion carried unanimously.
Canvassing Board Member Lopez- Anderson, seconded by Canvassing Board Member
Laney, moved to accept the result tape for Precinct #1106 as being accurate with the
tabulation results of 331 votes. Additionally, the result tape for Precinct #4106 is accurate
with the tabulation results of 274 votes. Motion carried unanimously.
Canvassing Board Member Laney, seconded by Canvassing Board Member Grafton,
moved to reaffirm their previous motion certifying the election which stated the following:
Total ballots casted were 2,526 with Jim Sills receiving 1,253 of the votes and Rusty
Johnson receiving 1,270 of the votes plus 3 under /over votes. Rusty Johnson was elected
with 50.34% of the votes. A recount was not necessary as the spread was more than .5% of
the vote. Motion carried unanimously.
AUDIT TEAM
The random selection of the race and precinct to be audited was conducted by roll of die. City
Clerk Eikenberry rolled a two so precinct 2106 was audited. The Audit Team was moved to
another table to begin the audit process. Kathy Heard, Beth Lewis, SOE Representative D
Wilsen, SOE Representative Radhica Zingh, SOE Representative Mary Cruz, and SOE
Representative Timothy Frazier began counting the precinct ballots for District #2. Their
results were as follows:

Total Audited Precinct Ballots: 910
City Clerk Eikenberry and a SOE Representative compared the auditing committee
worksheet with the previous machine results, and all numbers matched. The Voting System Post -
Election Audit Report was certified and signed by the Canvassing Board.

The meeting adjourned at 9:10 p.m.
