It is approximately 28.1 acres in size, and Parcel A is currently under site development for 240 multi-family dwelling units (Arbours Apartments). The subject property is located adjacent to the West Orange Trail on the east with a 73 foot power line easement located along the eastern property line. Pedestrian access to the West Orange Trail is being provided on the northern property line with a vehicular crossing located on the eastern property line. The proposed CSUSA Charter School is located on Parcel B of the Arbours at Crown Point PUD. Within the PUD, Parcel B was reserved for 97,000 sq. ft. of commercial use. The subject site is vacant and contains 10.6 acres. The current zoning designation on the property is PUD. The existing land use designation for the property is "Light Industrial". The table below references the future land uses, zoning classifications and existing land uses of the surrounding parcels. K-8th grade charter school. The campus will consist of a single school building with associated recreational field and tot lot. The recreation field will not be lighted. Stormwater retention will be located on the property. Access to the site will be provided via two (2) access points. The full entrance and exit will be located on West Road. The access will be a right-in /right-out. A secondary access will be provided on Fountain West Boulevard. The access is intended to be an exit only during drop-off/pick-up times and can operate as a full access during non peak hours. An amended traffic impact analysis was submitted based on comments from the Planning and Zoning Commission meeting and a meeting with Orange County Traffic Engineering. The amended traffic impact analysis concludes that the proposed modification to the school access will not trigger intersection operation along West Road to fall below adopted level of service (LOS) standards. Additionally, the school has been shown to have ample capacity onsite to avoid school trips spilling into the travel lanes of West Road based on the access and operational assumptions provided. Based on the analysis herein, Leftwich Consulting Engineers, Inc. recommends approval of the Ocoee Charter School without the need for off-site mitigation. As a result of the revised traffic circulation due to the additional access point at Fountain West Boulevard, the Applicant (and owner of the school site land known as Parcel 2 in the approved PUD agreement) is proposing conditions to monitor the intersection at West Road & Fountain West Boulevard by way of signal warrant at key milestones ahead of full enrollment. Specifically, the Applicant proposes to perform a signal warrant analysis for the West Road/Fountain West Boulevard intersection at the following intervals: (1) within six (6) months of issuance of certificate of occupancy for Parcel 2 Property; and (2) within six (6) months of issuance of certificate of occupancy for the Parcel 1 Property; and (3) within six (6) months of the Parcel 2 Property reaching eighty percent (80%) enrollment. All costs associated with the signal warrant analysis shall be paid by the Parcel 2 Property Owner. The total traffic generated under the amended development plan is 3,433 trips and does not exceed the maximum trips allowed in the PUD (5,161). The Arbours at Crown Point PUD multi-family development will generate a student population of: Elementary - 33 students (Clarcona Elementary School) Middle - 14 students (Ocoee Middle School) High - 16 students (Ocoee High School) The current student enrollment (as of Feb. 1, 2016) for the existing area schools providing education for children in grades K-8th grade is as follows: Citrus Elementary— 608 with a capacity of 683 Clarcona Elementary— 1,037 with a capacity of 809 Spring Lake Elementary - 646 with a capacity of 572 Ocoee Middle School - 1424 with a capacity of 1305 Kids Community College K-8 Charter School—229 with a capacity of 350 The following properties are designated for future schools, but are not contained in Orange County Public Schools Five (5) Year Capital Improvement Plan: Elementary School at Arden Park Elementary School at Ocoee Crown Point Middle School at Ingram Road Additional Information: The applicant requested the following information be included in the staff report. The information was not used by City of Ocoee staff including the Development Review Committee in rendering a recommendation. The Applicant is offering to pay the amount of$200,000 as a payment in lieu of taxes representing five (5) years ad valorem tax revenue the City would receive from a commercial use. The payment will be made in a lump sum at the time of building permit issuance. Also, the Applicant is offering to pay the amount of $128,150 as payment for Police and Fire impact fees, as well as other permit review and issuance fees. Water and Sewer services are provided by Orange County; therefore, those impact fees are payable to Orange County and included in the calculation. 2 Issue: Should the Honorable Mayor and City Commission approve an ordinance for a Substantial Amendment to the Arbours at Crown Point PUD and the PUD Land Use Plan for Charter School USA (CSUSA), a 1,145 student K- 8th grade charter school? Development Review Recommendation: The Development Review Committee (DRC) met on February 1, 2016, and reviewed the proposed amendment to the PUD. Discussion related to traffic impacts due to U-Turns and drop-off/pickup stacking of cars. The DRC expressed concern with the need for U-Turns on West Road at Ocoee Apopka Road. The DRC voted to confirm the determination of a Substantial Change to the PUD and PUD Land Use Plan. After further deliberations, the DRC voted unanimously to recommend approval of the use for a 1,145 student K-8 Charter School in the Arbours at Crown Point PUD and PUD Land Use Plan subject to the resolution of the exit points of the property and receiving Orange County Traffic Engineering approval of proposed improvements to West Road for U- Turns. Planning and Zoning Commission Recommendation: The Planning and Zoning Commission reviewed the proposed PUD rezoning and amendment to the PUD Land Use plan on February 9, 2016. City Staff presented a brief summary and overview of the requested 1,145 student charter school. Discussion ensued about access into the site, improvements to West Road at Ocoee Apopka Road for U-turns, and existing traffic. The main issue of discussion was the traffic study which was provided by the applicant and reviewed by the City. The Planning and Zoning Commission did not make a recommendation in support or opposition. A motion was made and voted on to not provide a recommendation to the City Commission. The Planning and Zoning Commission also requested the City Commission be made aware they feel the traffic generated by the charter school and the amount of U-Turns is unsafe. Staff Recommendation: Staff supports the Substantial Amendment to the Arbours at Crown Point PUD based on the amended traffic impact analysis which addresses the comments from the Planning and Zoning Commission and recommendation from the Development Review Committee. Therefore, staff recommends the City Commission adopt an ordinance for a Substantial Amendment to the Arbours at Crown Point PUD and the PUD Land Use Plan for Charter School USA (CSUSA), a 1,145 student K-8th grade charter school. The school would be located north of West Road, between Ocoee Apopka Road and State Road 429 in Orange County Florida. A Traffic Impact Analysis (TIA), dated December 23, 2015, was previously submitted to the City of Ocoee to forecast build-out traffic impacts based on the site plan under review at the time. This previous site plan provided exclusive non-emergency access to the site from West Road. Recently, the Applicant has resubmitted with a revised site plan which proposes access from West Road and, additionally, from Fountains West Boulevard as shown in Figure 1. This technical memorandum is intended to supplement the previous TIA to update the traffic operations forecast at intersections along West Road to be impacted by the additional access at Fountains West Boulevard. Specifically, build-out project volumes at the following intersections were reassigned and reanalyzed for build-out operational conditions: • West Road&Project Access Road • West Road&Fountains West Boulevard • West Road&Ocoee-Apopka Road Reassignment of project trips involved moving a portion of trips that were previously assigned to the West Road access to the Fountains West Blvd access and carrying forward the assignment to affected intersections along West Road. No changes were made to project distribution outside of the influence area of the access update (model distribution and link analysis provided in the original TIA unchanged). Updated build-out turning movement volumes at the three (3) intersections were developed by summing the background turning movement volumes reported in the original TIA to the new project trip assignment. Additionally, intersection volumes for the multi-family portion of the Arbours at Crown Point PD were added to the background condition as reported in the June 2013 TIA (revised July 2013) provided by City staff(see excerpts in Appendix A). Figure 2 and Figure 3 show the updated turning movement volumes (AM peak hour and PM peak hour, respectively) on the West Road intersections as a result of the added access at Fountains West Blvd. • Tables 1 provides the intersection LOS analysis summary for the updated build-out AM peak and PM peak hour conditions, respectively. Turning movement worksheets in Appendix B provide derivation of the updated turning movement volumes the AM peak and PM peak hour. Highway Capacity Software (HCS+, v5.5), which analyzes intersection data per Highway Capacity Manual 2010 procedures, was utilized to determine the LOS at each intersection. Existing turning movement counts are provided in the original TIA. With the new site design to accommodate exits at Fountains West Blvd, an updated queuing analysis was performed using the same "worse case" conditions requested by the City's consultant (as described in the original TIA). Table 2 provides a summary of the updated queuing analysis for AM peak and PM peak (generator) hours. HCS output for the site access at Fountains West Blvd is provided in Appendix D. The additional analysis was necessary to determine the transportation impact of providing a second access for the project at Fountains West Blvd. Specifically,the addition of the second access(and onsite traffic flow patterns) required updated build-out analysis of intersections along West Road and an update to the queuing analysis at peak pick-up and drop-off times. The summary of the supplemental analysis herein concludes that the proposed modification to the school access will not trigger intersection operation along West Road to fall below adopted level of service (LOS) standards. WHEREAS, the owner or owners (the "Applicant") of certain real property located within the corporate limits of the City of Ocoee, Florida, as described in the Exhibit "A" attached hereto has petitioned the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve an amendment (the "Amendment") to the Arbours at Crown Point PUD and PUD Land Use Plan, as approved by the Ocoee City Commission on September 17, 2013, (the "Land Use Plan"); WHEREAS, the Amendment was scheduled for study and recommendation and was reviewed by the Development Review Committee ("DRC") on February 1, 2016; WHEREAS, the DRC voted unanimously to confer with the determination of Substantial Change to the Arbours at Crown Point PUD and PUD Land Use Plan; WHEREAS, the Amendment was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee, Florida (the "Planning and Zoning Commission"); and WHEREAS, on February 9, 2016, the Planning and Zoning Commission held an advertised public hearing on the Application and did not recommend approval or denial of the Amendment but did express concerns with the anticipated flow of traffic; and WHEREAS, on , the Ocoee City Commission held a de novo advertised public hearing with respect to the proposed Amendment and this Ordinance and determined that the Amendment and this Ordinance are consistent with the 1991 City of Ocoee Comprehensive Plan as set forth in Ordinance No. 91-28, adopted September 18, 1991, as amended; and WHEREAS, the Ocoee City Commission considered this Ordinance in accordance with the procedures set forth in Section 166.041(3), Florida Statutes. NOW, THEREFORE,BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE,FLORIDA,AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2. Amendment to the Land Use Plan. The Construction Plans, prepared by Kimley-Horn for Ocoee West Rd Charter School, dated February 1, 2016, and date stamped as received by the City of Ocoee on February 1, 2016, with such additional revisions thereto, if any, as may be reflected in the minutes of the City Commission of the City of Ocoee meeting approving same is hereby approved, subject to the Conditions of Approval set forth in Section 3 below. The Amended Land Use Plan is attached hereto as Exhibit"B" and by this reference made a part hereof. Said Amended Land Use Plan supercedes and replaces the previously approved Land Use Plans for Arbours at Crown Point PUD and PUD Land Use Plan. All references to the Land Use Plan or the Amended Land Use Plan for the Arbours at Crown Point PUD and PUD Land Use Plan. SECTION 3. Conditions of Approval. The property described in Exhibit "A" hereto shall be developed in accordance with and subject to the Conditions of Approval set forth in the Amended Land Use Plan. Notwithstanding anything herein to the contrary, in the event of any conflict between the Arbours at Crown Point PUD and PUD Land Use Plan referenced in Section 2, above, and the Conditions of Approval, the Conditions of Approval shall control. SECTION 4. Ocoee Comprehensive Plan. The Ocoee City Commission hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan. SECTION 5. Conflicting Ordinances. All ordinances or parts of ordinances in conflict or inconsistent herewith are hereby repealed and rescinded. SECTION 6. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
