HomeMy WebLinkAbout02-20-90 ...... ~ .,- - MINUTES OF THE OCOEE BOARD OF CITY COMMISSIONERS REGULAR MEETING HELD FEBRUARY 20, 1990 The regular meeting of the Ocoee Board of City Commissioners was called to order by Mayor Dabbs at 7:30 p.m. in the commission chambers. Commissioner Foster gave the invocation which was followed by the pledge of allegiance. The Commission was polled and a quorum declared to be present. PRESENT: Commissioners Combs, Foster, Johnson, Woodson, and Mayor Dabbs. Also present were City Manager Shapiro, City Attorney Rosenthal, City Engineer Shira, Planning Director Behrens, Public Works Director Brenner, and City Clerk Grafton. Mr. R.P. Mohnacky, 1820 prairie Lake Blvd, spoke regarding 1) setting aside adequate land for right-of-way for 6 lane roads, 2) revising the ordinance which permits developers to choose whether to pay recreation impact fee or give recreation land, 3) the expense of hiring outside planning experts (LaRue Planning and Management Co.) I and 4) having a meeting at Colony Plaza instead of in the community center. ITEM TAKEN OUT OF AGENDA ORDER: APPOINTMENT OF A COMMITTEE TO EXAMINE THE OVER 65 PROGRAM As a result of a previously discussed need to revise the Over 65 Program, Commission had determined that an eleven member committee should be created with each Commissioner appointing two citizens and the Mayor appointing three citizens to serve. In an advisory capacity, the meetings will also be attended by City Manager Shapiro, City Attorney Rosenthal, and City Finance Director Poston. Commissioner Combs-Bill Stinnett and Mary Ellen Frame Commissioner Foster-Owen and Hilda Ems Commissioner Johnson-Bea Meeks and Melvin Shaner Commissioner Woodson-Bill Gray and Dorothy Dinkel Mayor Dabbs-Walt Cobb, Barclay Hamilton, and Dottie Minnick Commissioner Woodson, seconded by Commissioner Combs, moved to approve the list of appointments and to charge the members to examine the Over 65 Policy and return in sixty days with recommendations. City Attorney Rosenthal advised that the meetings will be public meetings but not public hearings; also that the meetings will not be advertised but notices will be posted at City Hall. ORDINANCES-SECOND READINGS AND PUBLIC HEARINGS Ordinance No. 90-05, relating to motion photography production; adopting Chapter 14.7 of the City Code to be known as the Motion Picture Photography Production Ordinance; providing procedures for the permitting of motion photography productions; providing purposes; providing definitions; providing for the building department to receive and process applications for production permits; providing for exemption from other City Code requirements; providing for recovery of costs for exraordinary services provided by the City; providing for severability; providing an effective date, was presented by title for the second reading and public hearing. The public hearing was opened and R. P. Mohnacky, 1820 Prairie Lake Blvd., asked why this ordinance was being adopted. City Manager Shapiro advised that the motion picture industry is growing in this area and in order for the City to have control it is better to have an instrument in place before a request is made to film here. As no one else wished to speak, the public hearing was closed. Commissioner Woodson, seconded by Commissioner Foster, moved to adopt Ordinance No. 90-05 as presented. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried with unanimous vote in favor. FIRST READING OF ORDINANCES-SECOND READINGS AND PUBLIC HEARINGS ARE SCHEDULED FOR MARCH 6, 1990 Ordinance No. 90-07, relating to garbage collection; amending Section 11-7 of the Code of Ordinances; providing for the collection of commercial, industrial, or institutional waste by a franchisee; providing a date upon which all commercial waste shall be collected by a franchisee; amending Section 11-9 of the Code of Ordinances; creating a new Section 11-10 of the Code of Ordinances; providing authorization for franchise agreements; providing terms and conditions for franchise agreements; providing conditions for the selection of a franchisee; providing for severability; providing an effective date, was presented by title only for the first reading. '- Page 3 Ocoee City Commission Regular Meeting February ~O, 1990 Ordinance No. 90-06, relating to water and Section 22-35 of the Code relating to water amending Section 22-65 of the Code relating charges: providing for severability; providing was presented by title only for first reading. sewers; amending capital charges; to sewer capital an effective date, .~ OCOBB HISTORICAL COMMISSION/WITHBRS-MAGUIRE HOUSB: USB, FBBS, BUDGET Mrs. Jo Baalman, 1199 Westside Dr., Winter Garden, President of the Ocoee Historical Commission, introduced Mrs. Mary Ann Halvorson, Past-President, who presented Mr. Rick Halvorson with a plaque in appreciation for his work on the Withers/Maguire Haunted House for Hallowe'en 1989. Mrs. Baalman then addressed Commission regarding the anticipated use and care of the house. Mrs. Baalman's presentation included a list of proposed uses of the building, a recap of last year's fund raisers showing a net income of $7,089.64, and an estimated 1990 budget of $19,162.00 income and $14,315.00 disbursements. As one of the proposed uses of the house was rental for meetings, City Manager Shapiro asked who was to be responsible for setting up chairs and whose chairs, and Mrs. Baalman responded that would have to be worked out. Mayor Dabbs noted that there was a good chance that City dollars would have to be used for the care of the house and City Manager Shapiro cautioned that the money would have to be spent in an auditable way, just as the rest of City funds are spent. Mayor Dabbs asked if there were questions from the citizens present and no one wished to speak. Mayor Dabbs then commended Mr. and Mrs. Halvorson for their past work and included Mrs. Baalman in the commendation for the energy impetus started this year. Mayor Dabbs then referred the whole matter to City Manager Shapiro to work out details. APPOINTMENT OF COMMITTBB FOR OVER 65 PROGRAM (SBE PAGES 1 & 2) DISCUSSION AND ACTION RB: PROPOSBD MOVING OF THB CIVIL DIVISION AND CRIMINAL DIVISION OF WEST ORANGB COUNTY COURTHOUSB TO DOWNTOWN ORLANDO In response to the report that the Civil and Criminal Divisions are to be moved from the West Orange County Courthouse to downtown Orlando, Commissioner Johnson, seconded by Commissioner Foster, moved to direct City Manager Shapiro to draw up a resolution opposing the move. Motion carried with unanimous vote in favor. Mrs. Cathie Doss Woodson, 613 Spring Lake Circle, said that citizens who wished to call in protest of the move should call 423-6287. Box ~ 1393, Orlando, FL 32802, and another telephone number: 836-2028. ~ Page 4 Ocoee City Commission Regular Meeting February 20, 1990 ZONING MAP AND COMPREHENSIVE PLAN City Manager Shapiro advised that there is a definite need to update and computerize the zoning map, and the cost would be an estimated $20,000.00 or more. After a brief discussion Commissioner Woodson, seconded by Commissioner Johnson, moved to go to bid for this and use the Utility Contingency Fund for the funding source. -- COMMENTS FROM COMMISSIONERS Commissioner Woodson said that he had been to the Senior League Field and he felt that the matter of fencing the entire field should be reconsidered as the repaired fence was run over again and the monument was broken. City Attorney Rosenthal advised that it was the Mayor's prerogative to determine if an emergency situation exists. Mayor Dabbs said that he felt that the acts of vandalism were sufficient cause and declared the matter of the fencing of the entire Senior League Field reopened. Commissioner Woodson, seconded by Commissioner Johnson, moved to fence the entire Senior League Field using funds from General Government Contingency Fund #001-516-4900 as requested in the Staff Report for the February 6, 1990 regular meeting (Agenda item III D). Motion carried with unanimous vote in favor. Commissioner Woodson stated that he would like to honor the Pounds family by renaming Floral Street to Pounds Street and the Griffin family by renaming Cumberland Street to Griffin Street. After a brief discussion, consensus was that City Attorney Rosenthal should research the legal process and work with City Clerk Grafton to set up the public hearings. Commissioner Woodson stated that he wants the City Seal formally adopted, and City Clerk was instructed to place adoption of the seal on the agenda for a future meeting. Commissioner Combs asked if the Boy Scouts who had requested money at an earlier meeting had found any sources. City Manager Shapiro advised that Public Works Director Brenner will be scheduling several scouts to work during the next week. Commissioner Combs reported that Code Enforcement should be advised that the doors are open on the houses located at the corner of Highway 50 and Marshall Farms Road and children are playing on the premises. ,... Commissioner Combs noted that if the yard clipping trash that is put out on the weekends could be picked up on Mondays the City would be much neater. City Manager Shapiro advised that would not be feasible because the three days accumulation of household garbage since the last pickup already cause Monday and Tuesday to be the heaviest days for the sanitation service. Commissioner Johnson had no comments at this time. Mayor Dabbs reported that 1) he has received an acknowledgement for the flowers sent by the City to the Fulford family at their bereavement, 2) he has sent a letter to the Central Florida Commuter Rail Authority indicating no financial support from the City of Ocoee as directed by Commission, 3) he will participate in the League of Women Voters meeting next week, and 4) Friday night is West Orange Chamber of Commerce Banquet night.
