Oak Trail Reserve PUD - Public Hearing Principal Planner Fabre — Preliminary/Final Subdivision Plan (PSP/FSP) Principal Planner Fabre presented a summary of the Oak Trail Reserve PUD, which is located on the northeast quadrant of the intersection of Clarke Road and Clarcona-Ocoee Road. The subject property is approximately 38.62 acres in size of which approximately three acres are designated as wetlands. The subject property is currently undeveloped and is partially covered with trees mostly on the south side and along the eastern boundary of the property. Also discussed was the wetland area (+/-3 acres) that is to be impacted and converted as an open space water retention feature. He explained that it was an old cattle water pond, which over time has accumulated wetland characteristics. There is one (1) waiver from the Land Development Code that is currently requested. Principal Planner Fabre gave a brief summary of the Oak Trail Reserve Preliminary/Final Subdivision Plan, which originally proposed a total of 123 single-family residential lots at approximately (41) 42.5 feet by 110 feet and (82) 52.5 feet by 120 feet. The developer has requested to modify the plans to address the Florida Building Code separation requirements. As a result, residential lots will be reconfigured to be (25) 40 feet by 110 feet and (101) 50 feet by 120 feet. The resulting subdivision will produce three (3) additional residential lots, resulting in a total of 126 single-family residential lots. The single-family residential homes will range from 2,200 sf to 4,950 sf of living space. The development is proposed to be constructed in two (2) phases. Principal Planner Fabre discussed the plan showing a 6-foot high wall with landscaping that will be installed along the extended North Clarke Road. Landscaping with aluminum railings and columns are proposed along the West Orange Trail. A black chain-link fence will be along the water retention/conservation areas adjacent to the subdivision boundaries. Landscaping and a decorative vinyl fence will be installed along the subdivision northern boundary. The subdivision is proposed to be gated with the residential streets owned and maintained by the homeowners association. As shown on the plans, the subject subdivision will have one (1) access point off the extended North Clarke Road. The construction of the extended North Clarke Road will be facilitated through a separate development order, which the developer is obligated to build. Development Review Committee Recommendation: The Development Review Committee (DRC) met on March 1, 2016, and reviewed the Preliminary/Final Subdivision Plan for Oak Trail Reserve PUD. There were technical issues to be addressed from staff that were identified in written comments and/or presented verbally. The Applicant agreed to address all the remaining staff comments. When the discussion was finished, the DRC voted to unanimously recommend approval of the Preliminary/Final Subdivision Plan for Oak Trail Reserve PUD, subject to the resolution of the remaining staff comments. 2IPage Planning and Zoning Commission Meeting March 8, 2016 Staff Recommendation: Based on the recommendation of the DRC, Staff respectfully recommends that the Planning and Zoning Commission recommend approval of the Preliminary/Final Subdivision Plan for Oak Trail Reserve PUD, subject to resolution of staff comments before the City Commission meeting. Discussion: 7:14 pm Chairman McKey inquired about the fencing; and further asked if the wall will continue to be built if Clarke Road is extended. Principal Planner Fabre indicated that the developer will have to build the wall along the border. Chairman McKey also inquired if Clarke Road is scheduled to be extended. Principal Planner Fabre advised that certain developers are obligated to improve and extend Clarke Road, and staff is striving to have the four lanes built at the same time. Member Sills asked how close the extension of Clarke Road will get to McCormick Road. Principal Planner Fabre indicated he does not know at this time, but said the developers are required to get a two-lane extended system put in, and staff is requesting the construction happen sooner than later. Chairman McKey asked whether the Arden Park development has an entrance on the Clarke Road extension, and Principal Planner Fabre indicated they do. Richard Wohlfarth, Applicant, Engineer with IBI Group, Inc., indicated he is hopeful they can break ground in April. He discussed the roads and indicated the benefits of the extension for their project off of McCormick Road. He expressed as an engineer he has agreed to draw the designs pro bono just to get the extension finished. Member Keethler asked for clarifications regarding the way the homes face on Street E indicating the front of the homes are facing the backs of the homes across the street. Mr. Wohlfarth indicated that is correct, but the elevations of the backs of the homes are more advanced, and the homebuilders are very comfortable with their product. Member Keethler asked his opinion on how homes five-feet apart sell on the real estate market. Mr. Wohlfarth advised that their project off of McCormick is the same product type. They have not officially opened the McCormick project and have already sold three homes and have five reservations. He further expressed that they believe there will be a very strong market for this project, because of the fact that the homes face the West Orange Trail. Further discussion entailed the 70 percent impervious area, and Mr. Wohlfarth expressed they do not anticipate many homes acquiring pools. Member West inquired about the triangle design off of Hobson Road and the extended Clarke Road. Mr. Wohlfarth indicated they are planning for that to be a trailhead, leaving the trees intact, but adding parking spaces off of Hobson Road. 3IPage Planning and Zoning Commission Meeting March 8, 2016 Chairman McKey thanked the development team for including parking spaces within the development. Member Keethler inquired if this community will have a homeowners association. Mr. Wohlfarth answered that it will be run by an HOA, and further it will be gated with private streets. Member Keethler asked what the homes will be selling for. Mr. Wohlfarth indicated from $250,000 to as high as $350,000. Further details on the homes and community were discussed. The public hearing was opened and closed with no speakers. 7:26 pm Motion: Move that the Planning and Zoning Commission, acting as the Local Planning Agency, recommend to the Ocoee City Commission Approval of the Preliminary/Final Subdivision Plan for Oak Trail Reserve PUD, subject to resolution of the remaining staff comments before the City Commission meeting; Moved by Member Dillard, Seconded by Member Sills. Member Keethler expressed his opinions that the homes are shotgun homes, and the developers are making parking lots. He further voiced that this and other similar developments are constructed versions of trailer parks, and he expressed it seems futile to speak out against these type of developments, but he will continue to do so. Chairman McKey mentioned they are in compliance with all of the land development codes. He inquired if there are any outstanding conditions or items at this time. Principal Planner Fabre indicated there is nothing outstanding and mentioned there are only technical comments from Public Works regarding stormwater and wetland issues. Chairman McKey expressed his concerns about fire safety with the homes so close together. Principal Planner Fabre explained with the five (5) foot setback there will be ten (10) feet between the homes. He stated this is a building code issue that the building official is in charge of. 7:31 pm Vote: Motion passed 5-1 to recommend to the Ocoee City Commission approval of the Preliminary/Final Subdivision Plan for Oak Trail Reserve PUD, subject to resolution of the remaining staff comments before the City Commission meeting. Antonio Fabre, AICP, Principal Planner (' DATE: April 6, 2016 SUBJECT: Silver Star Rd Property Annexation, PUD Rezoning and Land Use Plan • Case#(s)AX-01-16-57 & RZ-16-01-01 ISSUE: Should the Planning & Zoning Commission recommend approval of the Annexation, PUD Rezoning and Land Use Plan for Silver Star Rd Property? BACKGROUND: The subject property is located on the south side of Silver Star Road, approximately 1,200 feet east of Johio Shores Road and 900 feet west of Good Homes Road. The subject site is approximately 10.91 acres in size and is currently undeveloped with planted pine trees. The parcel ID number is 15-22-28-4716-00-142 with a physical street address of 8600 Silver Star Road. The table below references the future land uses, jurisdiction, existing land uses and zoning classifications of the surrounding parcels: DIRECTION: JPA FUTURE LAND USE/JURISDICTION EXISTING LAND USE/ZONING North Low Density Residential/City of Ocoee SFR(s)(Coventry at Ocoee Subdivision) /"R-1A" East Low Density Residential/Orange County SFR(s)(S&S Acres)/"R-CE" South Low Density Residential/City of Ocoee SFR(s)(Temple Grove Estates Subdivision) /"R-1 AA" West Low Density Residential/City of Ocoee SFR(s)(Temple Grove Estates Subdivision) /"R-IAA" The Future Land Use designation for the subject site is "Low Density Residential" which allows up to 4 dwelling units per acre. The requested rezoning would be from Orange County "Agriculture" (A-1) to City of Ocoee "Planned Unit Development" (PUD) with a corresponding "Land Use Plan" (LUP). • The Planning and Zoning Commission Meeting Date:April 12,2016 Page 2 of 2 CONSISTENCY WITH STATE & LOCAL REGULATIONS: Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes grants municipalities the authority to annex contiguous, compact, non-circuitous territory so long as it does not create an enclave. The subject property is considered contiguous to the City of Ocoee since it bordered by property located within the City limits on the west, north and south adjacent boundaries. Joint Planning Area Agreement: The subject property is located within the Ocoee-Orange County Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA Agreement. Orange County has been notified of this petition in accordance with Section 171.044(6) FS and Subsection 13-A of the City of Ocoee-Orange County Joint Planning Area Agreement. Rezoning: The Applicant has requested a City of Ocoee zoning designation of "PUD" (Planned Unit Development), which is consistent with the zoning of adjacent properties. The PUD designation is consistent with the adopted future land use designation of Low Density Residential, as shown on the City of Ocoee & Orange County Joint Planning Area future land use map. Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5 that states in part, "The City shall consider requests for voluntary annexation into the City when those lands are logical extensions of the existing City limits, when services can be properly provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA Agreement, and the City's Annexation Policy....". The rezoning is consistent with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA Agreement..." Annexation Feasibility & Public Facilities Analysis Report (See attached): Because the property is essentially part of an enclave in the City, it already benefits from Fire Rescue services via a joint "First Responder" Agreement with Orange County. The Applicant is proposing to extend the City's potable water mains and sanitary sewer in order to service the site. Annexation Summary: The proposed annexation is a logical extension of the City limits, urban services can be provided, and the annexation meets state and local regulations. The land use and initial zoning are also consistent and compatible with surrounding properties. DISCUSSION: The Silver Star Rd PUD/Land Use Plan is a planned residential subdivision that proposes a total of 43 single-family residential lots with a requested density of 3.12 units per acre. The residential street (50' wide) is planned to be designated as public right-of-way. The residential lots will be approximately 42.5 feet by 115 feet. The PUD has a minimum living area set at 1,500 square feet. The development is proposed to be developed in one (1) phase. As shown on the plans, the subject subdivision will have one (1) access point on Silver Star Road. This main entrance will be aligned with the existing Coventry at Ocoee subdivision entrance across Silver Star Road. The Plan also shows a 6-foot high wall with landscaping will be installed along Silver Star Road. Landscaping, columns and aluminum railings are proposed along the open space portions of the site. Finally, potable water, sewer, solid waste, reuse water (when available), police and fire protection will be provided by the City of Ocoee. The Planning and Zoning Commission Meeting Date:April 12,2016 Page 3 of 3 DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on March 29, 2016, and reviewed the Annexation, PUD Rezoning and Land Use Plan for the Silver Star Rd Property. There were several technical issues to be addressed from the City's Engineering Department and City Attorney's Office that were identified in written staff comments and presented verbally. There was some discussion on the existing conditions of the site, public vs private roadways, existing Silver Star Road conditions, and surrounding proposed subdivision features. When the discussion was finished, the DRC voted to recommend approval of the Annexation, PUD Rezoning and Land Use Plan, subject to addressing the items mentioned in the meeting and the resolution of the remaining staff comments. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff recommends that the Planning and Zoning Commission recommend approval of the Annexation, PUD Rezoning and Land Use Plan for the parcel of land known as the Silver Star Rd Property, subject to resolving City Staff comments. BACKGROUND: The subject property is located on the north side of West Road and west of SR 429. The overall parcel is 10.49 acres in size. The subject site is comprised by two (2) parcels identified as Parcel ID numbers 06-22-28-2856-00-010 & 06-22-28-0000-00-046. The subject property is located adjacent to the West Orange Trail on the east with a 73 foot power line easement located along the eastern property line. The Arbours at Crown Point PUD is a mixed use commercial PUD with two (2) lots. Lot 1 is the Arbours at Crown Point Apartments. The Ocoee West Road Charter School Charter • The Planning and Zoning Commission Meeting Date:April 12,2016 Page 2 of 2 School received PUD rezoning approval on March 15, 2016. The proposed Ocoee West Road Charter School consists of a two story, 68,000± sq. ft. K-8th grade charter school. The campus will consist of a single school building with associated Tot Lot, basketball court, and a sports field. The recreation fields will not be lighted. Stormwater retention will be located on the west side of the property. Access to the site will be provided via the right in/out located on West Road and a second access on Fountains West Blvd. The subject site does not contain environmental areas such as wetlands or 100 year flood plain. Also, the site does not contain any of the Wekiva Study Area environmental indicators such as "A" soils, karst features or sensitive habitat. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on April 5, 2016, and reviewed the Preliminary/Final Site Plan for Ocoee West Road Charter School. Staff discussed technical drainage and road design issues to be addressed from the City's Engineering Division. When the discussion was finished, the DRC voted to recommend approval of the Preliminary/Final Site Plan, subject to the resolution of the remaining staff comments. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff recommends that the Planning and Zoning Commission recommend approval of the Preliminary/Final Site Plan for Ocoee West Road Charter School, subject to resolving any remaining staff comments before the City Commission meeting.
