CALL TO ORDER
Chairman Lowery called the regular meeting of the Ocoee Code Enforcement Board to order at 7:02 p.m.
in the Commission Chambers at City Hall. Member Hopper gave the invocation, and Member Kelley led
the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present.
PRESENT: Chairman Lowery, Members Kelley, Odom, Hopper and Blynder. Also present were Board
Attorney Mary Sneed, Asst. Support Services Director - Code Enforcement Manager Doug
Gaines, Code Enforcement Officers Carmen Diaz, Edward Loeffler, Theresa Rodriguez and
Bob Siegrist; Administrative Assistant Bridgett Coffey, and Recording Clerk Nichole
DeRienzo.
ABSENT: Vice-Chairman Carrington& Member Osborne.
GUESTS: None.
Administrative Assistant Coffey administered the oath to the code enforcement officers and to anyone
intending to speak regarding a case.

Officer Rodriguez presented the case and gave its history. This was a citizen complaint regarding an
abandoned, red SUV, with no tag. The respondent has been in contact with the officer, and is in attendance
for the case. Staff requested 15 days to comply or be fined $50 per day, until the violation is brought into
compliance.
Sharon Graham Nelson, property owner, explained she planned to get a tag for the vehicle and had
recently obtained insurance for the vehicle, but that would not resolve the problem of the vehicle being
abandoned. She has decided to find a junk yard to come and remove the car from the property. The vehicle
is of sentimental value to her, but she is ready to part with the vehicle.
Member Hopper, seconded by Member Blynder, moved that in Case #16-040, the respondent be found in
violation as cited as of April 8, 2016, and be given until May 31, 2016, to come into compliance, or be fined
$25 per day,for as long as the violation remains in non-compliance. Motion carried unanimously.
Member Kelley, seconded by Member Hopper, moved to Case #16-028 be heard following Case #16-030,
and then revert back to the agenda. Motion carried unanimously.

Observation: Habitual violation; prohibited trailer parking and trade debris; buckets, tools, building materials. Black trailer
parked in-front of front building line (prohibited). Building materials, buckets left out in driveway (prohibited nuisance). No
address / building numbers displayed (prohibited). Prior history of warnings, citizen complaints and violations notices; always
complied however violation routinely reoccurs.

Officer Loeffler presented the case and gave its history that included exhibits for this case. This was a
multiple citizen, generated complaint regarding a box trailer parking, building material on property and no
building address displayed on the property. The officer explained this property is currently in compliance;
however, this case is to demonstrate the violation had existed, and would request this be noted as a repeat
violation in the future.

Kenneth Bresk, property owner, explained he had received his first violation notice about a year ago. The
owner explained he was recently working on remodeling the house, and although he would often work
throughout the night, the items were not left out overnight. He noted that the numbers were not displayed on
the property due to him re-painting his house.
Member Kelley, seconded by Member Blynder, moved that in Case #16-035, the respondent be found in
compliance as ofApril 26, 2016, and the case be dismissed. Motion failed 2-2.
Member Hopper moved that in Case #16-035, the respondent be found in violation as cited as of April 7,
2016, and be found in compliance as of April 26, 2016, with no fine to be assessed at this time. Motion dies
due to lack of second.
Discussion ensued. Board members were considering dismissing the violations.

Officer Rodriguez presented the case and gave its history and exhibits were displayed of previous violation
that occurred in 2011. The officer received numerous complaints of the respondent parking trailers on
private, residential property, which is prohibited within the city. The officer explained this property is
currently in compliance; however, this case is to demonstrate the violation had existed, and would request
this be noted as a repeat violation in the future.
Shaun Cantu, property owner, explained that a friend had dropped off the trailer, and had notified a cousin
to move the trailer to their shop. He is not sure when it was moved, but it is not there currently according to
his cousin.
Member Hopper, seconded by Member Kelley, moved that in Case #16-030, the respondent be found in
compliance as ofApril 26, 2016, and the case be dismissed. Motion carried unanimously.

Officer Rodriguez presented the case and gave its history. This was due to numerous citizen complaints
regarding an inoperable vehicle present on property. As of today, property is still in non-compliance. The
officer also noted there were previous violations in December of 2015.
Davey Mixson, the property owner, explained the vehicle in violation was his son's black truck, and he had
been waiting for him to get it fixed in order to move the vehicle. The property owner had called a tow truck
to come to tow the vehicle away, just after 5 p.m. However, the officer was not able to verify this
information due to being in attendance for the meeting. He also explained the red vehicle was on the
property being looked at for repair, but is no longer there.
Member Kelley, seconded by Member Hopper, moved that in Case #16-028, the respondent be found in
repeat violation for codes 168-6B(1), 165-3A and 165-4, as cited as of April 26, 2016, and be given until
May 1, 2016, to come into compliance, or be fined$100 per day, per violation,for as long as the violation
remains in non-compliance. Motion carried unanimously.

Officer Siegrist presented the case and gave its history. This was a citizen generated complaint regarding a
vacant property, where the officer observed a dirty swimming pool, with grass and weed growth within the
pool, as well as a fence in poor condition. The officer presented exhibits of the unsanitary conditions and
un- maintained structure, which showed the pool covered with a man-made mesh cover over it. As of today,
property remains in non-compliance. Staff is requesting a compliance time of 10 days, or a fine of$100 per
day until violation is brought into compliance.
Member Blynder, seconded by Member Kelley, moved that in Case #16-021, the respondent be found in
violation as cited as of March 17, 2016, and be given until May 10, 2016, to come into compliance, or be
fined $100 per day, per violation for as long as the violation remains in non-compliance. Motion carried

Officer Siegrist presented the case and gave its history. This repeat violation, previously heard at the June
25, 2013, meeting, was a citizen generated complaint regarding a vacant property, where the officer
observed a dirty swimming pool. The officer presented exhibits of the unsanitary conditions. As of April 19,
2016, the property was in compliance.
Original Motion:
Member Blynder, seconded by Member Hopper, moved that in Case #16-023, the respondent be found in
violation as cited as of March 28, 2016, and be found in compliance as of April 19, 2016, and no fine b e__
assessed at this time.

Observation: Conditions constituting a nuisance to the public health, safety and welfare. Conditions that endanger the health,
safety and welfare of the neighborhood, the residents, the public and the occupants. Conditions creating a blighted appearance
affecting the city and changing the character of a residential area. Persons occupying 2 different recreational camping vehicles
connected to water utilities with garden hoses, connected to electric utilities with extension cords and emptying waste water and
human waste into ground; all prohibited and also causing an odor nuisance to neighbors. Variety of trailers on property; six
observed. Only 2 permitted and cannot be connected to utilities or occupied and utilized for living and sleeping. Mechanic
observed working on vehicles. 5 untagged vehicles present. Large piles of scrap lead on ground; not contained in water-tight
container; health, safety and welfare condition with possible ground contamination. Misc. junk, trash, debris, car-parts, tools
littering property. Unpermitted accessory structure; large shed building. Unapproved gate access and easement use/egress from
back fence and gate onto Flewelling Ave. Main house clothes washer draining waste water onto ground.

Officer Loeffler presented the case and gave its history. This was generated by multiply citizen complaints
regarding multiple people living in backyard, where camping tents and campers are present, with
miscellaneous debris, vehicles and trailers, as well as a homemade septic for human waste that is being
disposed of on the property. The officer presented exhibits of the conditions, and advised these violations
are a nuisance to the public's safety and health. The officer advised that the vehicles and trailers were
removed as of April 21, 2016, and the property is in compliance. However, citizens are concerned the
violations may occur again. City is requesting to impose fine during time of violation.
Board Attorney Mary Sneed educated the Board on these cases and stipulations of imposing violations.

violation as cited as of March 31, 2016, and be found in compliance as of April 21, 2016, and no fine be

Officer Diaz presented the case and gave its history, with exhibits presented. This was generated by City
Staff regarding two vehicles for sale on the vacant lot. The officer suggested no trespassing signs to the
respondent, which were the respondent's vehicles. Property is in compliance. Cars were removed on April
25, 2016, however, as of today there is a new vehicle parked on the property. Staff is requesting to make this
a repeat violation.

general public effecting the overall welfare of the city and changing the safe character of a residential area. The use, sale of,
abuse and storage of heroin and methamphetamines, misc.junk, debris and trash littering the property, broken window glass,tall
weeds and grass, inoperable and missing smoke detectors, unnavigable blocked garage passage and egress and a back fence gate
opening to Florida Central Railroad habitually used by foot and bike traffic engaged in the purchasing and use of heroin and
methamphetamines. All conditions presenting a nuisance to the public health, safety and welfare and creating a blighted effect
upon the neighborhood and the city.
SPECIFIC TO THIS VIOLATION NOTICE: Ocoee ordinances 108-3 define a Public Nuisance as (1) any public nuisance
known at common law or in equity jurisprudence or as provided by the statutes of the State of Florida or ordinances of the City of
Ocoee.

Member Blynder expressed his concerns regarding trailer parking that is becoming a rising issue within the
City. He suggested consistent regulations to be implemented towards the violators.
Officers recommended having the Commissioners review the Code to implement something new to come
into effect.
Member Blynder also inquired about the annual budget for the Board, and discussed how the funds could
potentially be used to benefit the members.
