Contact Number: Ext. 1026 City Manager: Subject: Appointment of a Charter Review Commission, in accordance with the City of Ocoee Charter, Article X, Section C-59. Background Summary: Article X, Section C-59 of the Charter: A Charter Review Commission shall be appointed by the City Commission no later than December 15 in the year 1999 and no later than December 15 every ten (10) years thereafter. A Charter Review Commission may also be appointed by the City Commission at such times as deemed necessary by the City Commission. The Charter Review Commission shall consist of five (5) members who shall be appointed by a majority vote of the City Commission and who shall serve on such Commission for terms of one (1) year unless such terms are extended by the City Commission. The Mayor shall also appoint two (2) alternate members, subject to the approval of the City Commission, who may fill in for any member absent from a Charter Review Commission meeting. On April 19, 2016, the City Commission voted unanimously to allow residents to apply by July 29, 2016, for consideration to be appointed to the Charter Review Commission. At that time, the City Manager was also directed to bring forward the names and credentials of three (3) qualified individuals to work with the Charter Review Board as facilitator. Attached are the proposals to be considered. Issue: In accordance with C-59 of the City Charter, the City Commission shall appoint, by majority vote, a Charter Review Commission consisting of five (5) members who shall serve on such Commission for terms of one (1) year unless such terms are extended by the City Commission. The Mayor shall also appoint two (2) alternate members, subject to the approval of the City Commission, who may fill in for any member absent from a Charter Review Commission meeting. Recommendations Staff recommends the Honorable Mayor and Commissioners a) appoint a Charter Review Commission consisting of five (5) members and two (2) alternate members, for a term of one year; and b) select an individual as Charter Review Board facilitator. [Amended 12-1-2009 by Ord. Footnotes: ---(1)--- Editor's Note:This ordinance was approved by the electorate of the City of Ocoee by referendum on 3-9-2010.Said ordinance provided for an effective date of 6-1-2010. § C-60. - Removal; vacancies. A. Removal. Any member of the Charter Review Commission may be removed by the City Commission in accordance with the following procedures: (1) The City Commission shall adopt by affirmative vote of a majority of all its members a preliminary resolution which must state the reasons for removal. A copy of the resolution shall be promptly delivered to the member of the Charter Review Commission sought to be removed. (2) Within five (5) days after a copy of the resolution is delivered to the member sought to be removed, such member may file with the City Commission a written reply and/or a written request for a public hearing. This hearing shall be held at a City Commission meeting no earlier than fifteen (15) days and no later than thirty(30) days after the request is filed. (3) The City Commission may adopt by affirmative vote of a majority of all its members a final resolution of removal, which may be made effective immediately. Such resolution, if adopted, must be adopted no earlier than six (6) days and no later than thirty(30) days from the date a copy of the preliminary resolution was delivered to about:blank 8/8/2016 Ocoee, FL Code of Ordinances Page 2 of 2 the member sought to be removed, if such member has not requested a public hearing. If such member has requested a hearing, such resolution, if adopted, must be adopted within forty-five (45) days from the date of the hearing. B. Vacancies. If any vacancy occurs in the Charter Review Commission, a qualified individual shall be appointed by the City Commission to serve in place of the member who created the vacancy. Such vacancy shall be filled within thirty(30) days after the vacancy occurs. § C-61. - Powers and duties. [Amended 12-1-2009 by Ord. No. 2009-030][2] The Charter Review Commission shall be empowered to conduct a comprehensive study of any or all phases of city government. A Charter Review Commission may, during its term, place proposed amendments and revisions of the Charter on the ballot at general municipal elections only, provided a report of the proposed changes has been delivered to the City Clerk at least ninety(90) days prior to the election, or as otherwise may be required by law. Such amendments or revisions do not require the approval of the City Commission. Ms. Marilyn Crotty will direct and facilitate the project. The Institute of Government will provide the following services: • Design of a process that allows for a thorough examination of the existing charter and opportunities for maximum citizen input to any changes • Attending and facilitating all meetings of the Charter Review Commission including all public hearings • Providing background information on charter issues • Providing appropriate speakers/consultants as needed on issues • Assisting the Charter Review Commission and legal counsel in writing proposed charter revisions and ballot measures • Assisting the city with the design of a public education process to inform voters about proposed charter changes The City of Ocoee will be responsible for: • Providing appropriate notice, space, and secretarial support for all Charter Review Commission meetings and public hearings • Providing legal counsel to advise the Charter Review Commission as needed and assistance in drafting appropriate language for charter revisions and ballot measures. • Purchasing appropriate publications and reproducing materials as needed A final report including all recommended changes to the charter will be submitted to the Ocoee City Commission upon conclusion of the project. The fee for this project is $5,000, half of which ($2,500) will be payable at the beginning of the project. Rosenthal, Esq. Date: April 12, 2016 Re: Ocoee Charter Review Commission This is to follow-up on our phone conversation regarding the upcoming Ocoee Charter Review Commission. I would be pleased to serve as a Consultant/Advisor to the CRC as it goes through the review process. Having worked on all the Charter amendments since 1988, I think my experience and knowledge would be helpful to the CRC and the City and provide a resource to guide them through the process. I would view my role as separate from legal counsel to the CRC, which role could be provided by the City Attorney. Legal counsel is more of a neutral role serving as legal adviser and a drafter of amendments which might be requested. I think the first task for the Consultant to the CRC would be to work with the City Clerk to put together a proper historical packet regarding the past CRC's so that they aren't re-inventing the wheel. My old files at Foley& Lardner would be helpful in this regard. An organizational meeting could then be held where the Consultant would go over this information and assist the CRC in organizing itself. As Consultant to the CRC, I would attend its meetings and work with the City Clerk in preparing the Agenda. I would also coordinate with the City Attorney and review drafts of any proposed amendments to the Charter. In this regard, I would also coordinate with you to make sure that the City Manager and City Commission are kept up to date on the CRC activities and proposals. I would be willing to undertake this task with my fees being charged on an hourly basis. My rate would be the same rate charged by the City Attorney. I would bill on a monthly basis. As you know, I continue to represent Heller Bros Groves who is a landowner in the City. I might also be engaged to represent others dealing with the City (though this hasn't happened since my retirement as City Attorney). Any engagement by the City would need to be with the understanding that it would not prevent me from representing Heller Bros Groves and others in matters involving the City. However, I would not represent any party in litigation against the City. I do not believe that there would be a conflict between my continued representation of others and my serving as a Consultant to the CRC.
