MINUTES OF THE OCOEE BOARD OF CITY COMMISSIONERS REGULAR MEETING
HELD SEPTEMBER 18, 1990
The regular meeting of the Ocoee Board of City Commissioners was
called to order by Mayor Dabbs at 7:30 p.m. in the commission
chambers. Commissioner Foster led in the prayer and pledge of
allegiance. The roll was called and a quorum declared present.
PRESENT: Mayor Dabbs, Commissioners Combs, Foster, Johnson, and
Woodson. Also present were City Manager Shapiro, City Attorney
Rosenthal, City Engineer/Utilities Director Shira, Building
Official Flippen, Associate Planner Claman, and City Clerk
Grafton.
ABSENT: None
PRESENTATIONS AND PROCLAMATIONS
Mayor Dabbs proclaimed September 30-0ctober 6 to be National Job
Skills Week.

OPERATION OCOEE - Tammy Hacker
Mrs. Tammy Hacker, 311 15th Avenue, proposed Operation Ocoee,
which is "a community project to combine in action and heart to
support our members in Saudi Arabia by sending magazines, letters,
and other items to remind them that the people at home are
thinking about them." Mrs. Hacker asked for postage for the
packages which will be collected at Wal-Mart and other locations.
City Manager suggested that the city employees be more involved
and be responsible for the mailing of the packages. Mayor Dabbs,
seconded by Commissioner Johnson, moved to authorize City Manager
Shapiro to enter into Operation Ocoee for service men in Saudi
Arabia and to authorize funds for postage in the amount of $600,
with the option to come back for $600 more. Motion carried with
unanimous vote in favor.

REQUEST FOR FUNDS TO PAY FOR BANDS ON FUN DAY - Lions Club
Mr. Jay Worsham, Jr., President of the Lions Club, explained that
the Lions Club has historically coordinated the activities for the
City for those in need, and their funding comes from earning money
by working as parking attendants and also from public donations.
Mr. Worsham said also that they represent the City by preparing
the Ocoee display booth at the fair, by coordinating the Christmas
parade, and by sponsoring Fun Day annually and he requested funds
to help pay for the entertainment for Fun Day, October 5, 6, and
7. City Manager Shapiro suggested that the funds be encumbered
from this year's budget for all three occasions rather than just
the one. After some discussion, Mayor Dabbs, seconded by
Commissioner Combs, moved to authorize City Manager Shapiro to
work with the Lions Club with up to $6,500 for those 3 projects
(Fun Day in October, Christmas parade this year, and the fair
early next year). Motion carried with unanimous vote in favor.

Commissioner Combs, seconded by Commissioner Foster, moved to
approve the consent agenda as presented. Motion carried with
unanimous vote in favor.
COMMENTS FROM CITIZENS/PUBLIC
There were no citizens wishing to speak at this time.

SECOND READINGS AND PUBLIC HEARINGS
ORDINANCE NO. 90-20, "relating to states of emergency; creating
a new Chapter 23 of the Code of Ordinances; designating the Mayor,
or his designee, as the official with authority to declare a state
of emergency; authorizing emergency measures including suspension
of liquor sales, restrictions on firearms, establishment of
curfew; restrictions on public congregations, prohibition of price
gouging, and confiscation; providing penalties; providing for
severability; providing an effective date." was presented by title
and a brief explanation for the second reading and public hearing.
The public hearing was opened and Mr. R.P. Mohnacky, 1820 Prairie
Lake Blvd., asked for further explanation. Both City Attorney
Rosenthal and City Manager Shapiro explained the plan in greater
detail. No other citizen wished to speak and so the public hearing
was closed. Commissioner Combs, seconded by Commissioner Johnson,
moved to adopt Ordinance No. 90-20. On roll call Commissioner
Combs voted "aye," Commissioner Foster "aye," Commissioner
Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye."
Motion carried with unanimous vote in favor. Mayor Dabbs commended
staff for producing a good document.
ORDINANCE NO. 90-21, "providing for a regular municipal election
to be held on November 6, 1990, and a run-off special
election, if necessary, to be held on November 20, 1990;
providing for the qualification of candidates; providing for
elections boards and conduct of elections; providing for the
registration of voters; providing for the canvas of returns;

providing for voting machines; providing for additional duties
of the City Clerk; providing for absentee ballots; providing
for notice of election; providing for severability; providing
an effective date." was presented by title with a brief
explanation for the second reading and public hearing. The public
hearing was opened and, no one wishing to speak, the hearing was
closed. Comissioner Woodson, seconded by Commissioner Foster,
moved to adopt Ordinance No. 90-21, relating to municipal election
for 1990. On roll call Commissioner Combs voted "aye,"
Commissioner Foster "aye," Commissioner Johnson "aye,"
Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried
with unanimous vote in favor.
OTHER BUSINESS
JAMES W. PAUL REQUESTS OPEN AIR VENDOR OCCUPATIONAL LICENSE
Building Official Flippen explained the requirements for an open
air vendor occupational license and noted that the Church of God
of Prophecy, as owner of the property, has given permission for
the produce stand to be located on the property. Mrs. Letha Paul,
12450 Marshall Farms Road, Winter Garden, said that they have a
license to sell produce in Winter Garden, but that 90% of their
customers are from Ocoee and their customers have asked them to
relocate here in Ocoee. Pastor Lester Weldon, Church of God of
Prophecy, reinforced the statements made in the letter of
permission from his church. City Manager Shapiro noted that
several lawsuits addressing unpaved parking have been set aside
because of this same thing and permitting this application will
cause those cases to reactivate. After discussion during which
each Commissioner expressed sympathy for Mr. and Mrs. Paul in
their quest for a proper location for the stand, Commissioner
Johnson suggested that they consider the Sid Reeves property on
Franklin Street. Commissioner Foster, seconded by Commissioner
Combs, moved to deny the request at this particular location
because of the lack of paved parking area and lack of
ingress/egress. On roll call Commissioner Combs voted "aye,
Commissioner Foster "aye," Commissioner Johnson "aye,"
Commissioner Woodson "Nay," and Mayor Dabbs "aye." Motion carried
with 4-1 vote in favor.
RESOLUTION NO. 90-17, "adopting the City of Ocoee Disaster Plan,
which provides the Mayor with certain powers, establishes standard
operational procedures, provides staff support information
regarding shelters/hospitals, evacuation routes, location of
supplies and materials; providing for severability; providing an
effective date." was presented by title. Commissioner Combs,
seconded by Commissioner Johnson, moved to adopt Resolution No.
90-17 relating to the Disaster Plan. On roll call Commissioner

Combs voted "aye," Commissioner Foster "aye," Commissioner
Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye."
Motion carried with unanimous vote in favor.
RESOLUTION NO. 90-18, "urging City of Ocoee citizens to support
the Constitutional Amendment No. 3 on the November 1990 ballot
limiting unfunded state mandates on cities and counties." was
presented by title and Mayor Dabbs explained the resolution.
Commissioner Woodson, seconded by Commissioner Combs, moved to
adopt Resolution No. 90-18. On roll call Commissioner Combs voted
"aye," Commissioner Foster "aye," Commissioner Johnson "aye,"
Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried
with unanimous vote in favor.

FIRST READING OF ORDINANCES-Second Readings and Public Hearings
Scheduled for October 2, 1990
ORDINANCE NO. 90-22, "relating to regulating electrical
construction; repealing Ordinance No. 959; repealing Section 39 of
Ordinance No. 638; repealing Section 9-11 of Article I of Chapter
9 of the Ocoee City Code; adopting a new Section 9-11 of Article I
of Chapter 9 of the Ocoee City Code; providing for severability;
providing an effective date." was presented by title for the first
reading. During a brief discussion on the fairness of this
ordinance, Mayor Dabbs left the table and turned the meeting over
to Mayor pro tem Johnson, returning in approximately three
minutes.
STAFF REPORTS
City Manager Shapiro introduced the new City Personnel Director
Peggy psaledakis and announced that Marian Green is now Deputy
City Clerk.
COMMENTS FROM COMMISSIONERS
Commissioner Combs
1) announced that Ocoee will be host for the Tri-County League of
Cities luncheon November 15;
2) mentioned Mt. Dora and government in the sunshine, saying we
are OK in that respect;
3) said that horse droppings near Betty J's Florist on Bluford
Avenue stayed there for a week. City Manager Shapiro suggested
that the way to control that would be by ordinance;
4) noted that he and Commissioner Johnson had discussed the fence
ordinance with staff and felt that if it is being interpreted
properly it should be revised;
5) said he appreciated the fact that no one qualified against him
for this election.

Commissioner Foster said amen to #5 above and that the Code
Enforcement officers should revisit Pioneer Key Park II.

Commissioner Johnson
1) said he wishes he could feel the same about #5 above;
2) Pop Warner games start Saturday at Dr. Phillips and citizens
should get involved and help;
3) announced Fun Days are October 5, 6, and 7;
4) and Pioneer Awards will be presented to some pioneer citizens
during Fun Day.
Commissioner Woodson
1) noted that there were several Boy Scouts present and he
expressed appreciation that they were here;
2) asked The Times to give Fun Day lots of press;
3) gave City Manager Shapiro a letter regarding the parking of RVs
and boats.

Mayor Dabbs
1} announced that the Police Department was commended
by a citizen and the letter has been posted on the Good News
bulletin board in City Hall;
2) commended the incumbents for continuing to serve;
3) said that he will have several politicians present for Fun Day
and asked if there will be a microphone available.
