MINUTES OF COMBINED WORKSHOP OCOEE CITY COMMISSION, PLANNING AND ZONING COMMISSION, DESIGN REVIEW COMMITTEE AND PLANNING DEPARTMENT HELD ON NOVEMBER 17, 1990 This Joint Workshop on Future Joint Planning Areas wi th Orange County was held at the Holiday Inn Orlando West, Peachtree Room. Present: Ocoee City Commissioners Foster and Woodson, Planning & Zoning Commission Members Swickerath and Weeks, City Manager Shapiro, City Engineer Shira, Public Works Director Brenner, Planning Director Behrens, Building Official Flippen, City Attorney Rosenthal, and City Clerk Grafton. Also present were Theo Graham, Milton West, Lou Roeder, Jack Douglas, Bryan Miller, ~~ RV~~~L, Charles Gallagher and Marty Kreidt. City Manager Shapiro called the meeting to order at 4:30 p.m. and explained that the meeting had been called to alleviate his own concerns regarding City services and how best to extend them. Everything that has been annexed has been serviced as promised and there is still sewer capacity available. Water service has been a problem and it appears it will continue as it has been. With the traffic impact fees, the City will be constructing Clark Road and may be looking at Maguire Road in the future. There are some larger blocks of land that are potential annexations that could create a problem for the City if some plans are not made well in advance. At the moment, the City is doing well with its concurrency and service delivery area ratios. Municipalities in the ~ area have been meeting with the County and have gotten no where, due to politics. Mr. Shapiro felt that there could be a problem in the offing; possibly a county addressing environmental issues only, with cities to split the services. Broward County decided, when it became a charter county, that it would take over the environmental issues such as zoning, DER, and building construction but would not service the unincorporated areas. They would allow the Cities to split the other services. A natural boundary to the east would be Hiawassee Road. South boundary would be Winter Garden Road on to Gotha and the Windermere I imi ts. The Ci ty of Winter Garden would be the west limits. There could be a possible conflict at the beltway depending on where it is finally located. Apopka would prefer to go northward not to the south, so McCormick Road would appear to be the boundary. A land owners association north of Ocoee and south of Apopka has approached both Ocoee and Apopka concerning the annexation of 1800 acres. The County has no plans to include this in its service area and it certainly would be an impossible situation for engineers to gauge. Mr. Swickerath stated that a land owners association had spoken to him. The major concern of the group is that they feel ei ther Apopka or Ocoee will be gobbling them up. They would like, he feels, to develop some form of structure to permit them to remain rural. Their concern is not even services, just to maintain their current level. ........ '-' Page 2 Ocoee City Commission Workshop Session November 17, 1990 Mr.Shapiro said his impression was quite different, in that some of the people in the association felt they had developable land and that it was time to move toward some type of zoning for other uses. There are really two groups - one of each opinion. Mr. Shapiro explained the problems wi th infrastructure/concurrency wherein it must be proved to the state that there is an ability to provide services wi thin certain time elements. To raise impact fees and use the money to develop away from central core areas is not the answer. He mentioned the West property as being a stretch for the City in the area of service. He pointed out some possible solutions. First, the property could be taken in and the impact fee could be raised. Second, have annexation and provide some kind of agreement for timing, concurrency and appropriate service. The staff will have to start thinking more carefully about what we can provide and fulfill. Mr. Lou Roeder explained that he felt the association people discussed earlier just wanted to be in some jurisdiction with some zoning possibilities. In the county there is little prospect of that. ~ The major concern of Ocoee is being able to provide service if that commi tment is made. Annexation and zoning is not really the problem. The County is still a big question mark. Mr. Swickerath does not think Ocoee should be stopped because the County will not disclose their plans. He added that he felt the County could be forced if the City went to them and said this is what Ocoee wants. Mr. Douglas, Assistant Administrator for Apopka, stated that when or if the beltway goes in, that area will be forced to develop. The cities will not receive benefits. Mr. Shapiro explained that Ocoee could feel very good about the Comprehensi ve Plan and concurrency. He warned that there are uncharted waters ahead with the acres of development so close and with no direction from Orange County. Mr. Swickerath suggested that Ocoee should take the lead rather than allow Orange County to "lead" it. Attorney Rosenthal added that a meeting wi th the new County Commissioners and the City Commission to discuss these problems might be beneficial. Mr. Shapiro suggested that Winter Garden, Apopka and Ocoee might discuss their problems and present them jointly to the Orange County Commission. Mr. Douglas expressed his opinion that one plan with all the cities cooperating would be a good idea. Law suits would be a part of this cooperative effort. The County has very recently been changing its positions on issues. '-" Mr. Roeder reported that many south Florida counties are reorganizing. Mr. Swickerath said the City of Orlando may be ready to cooperate because they are dealing with the County also. Mr. '-- Page 3 Ocoee City Commission Workshop November 17, 1990 Shapiro suggested that just talking to West Orange County Cities and developing a plan would be a step forward. Mr. Kreidt feels Orange County is very concerned with their own Comprehensive Plan that has been transmitted. The City staff should stay in close touch with Tallahassee and keep them advised of the City plans and the City's views of what is coming. This would be most helpful. Mr. Behrens said that there had been some contact with developers in that area. And as development increased, he expected there would be more. The City of Ocoee should be looking at involuntary annexations, according to Mr. Shapiro. This means taking the bad and the good. There are some very bad areas just north of the City limits. Mr. Graham talked about enclaves and the law controlling them. '~ Mr. Behrens expressed his opinion that the cities in West Orange County get together and develop a plan to be presented to Orange County. Others in the group agreed.
