HomeMy WebLinkAbout07-17-90 ~ ~ '-" MINUTES OF THE OCOEE BOARD OF CITY COMMISSIONERS REGULAR MEETING HELD JULY 17, 1990 CALL TO ORDER Mayor Dabbs called the regular meeting to order at 7:30 p.m. in the commission chambers. Commissioner Woodson led in prayer and the pledge of allegiance to the flag. Mayor Dabbs called the roll and declared a quorum present. PRESENT: Mayor Dabbs; Commissioners Combs, Foster, Johnson and Woodson. Also present were City Manager Shapiro, City Engineer/Utilities Director Shira, Public Works Director Brenner, Assistant City Attorney Woodson, and City Clerk Grafton. ABSENT: None PRESENTATIONS AND PROCLAMATIONS Recreation Director Jim Beech thanked the City Commission for backing the Big Orange Games, a state-wide annual event for physically disabled public school students, which was held this year on May 5. Mr. Beech also presented plaques by way of expressing his appreciation to the following city employees who helped with the event: Janet Resnik, Ellen King, Sherry Seaver, Ellis Shapiro, James Mobley, Buddy Elmore, Garry Smith, Jerry Bass (not present), Tony Brooks, Butch Stokes, John Cockrell, Rick Waldrup, John Boyd, Chuck Seaver, Randy Conyers, Ken Strickland, Dave Whitaker, Linda Gleason, Steven Barnes, and Mark Davis. CONSENT AGENDA The proposed consent agenda consisted of items A, B, C, and D. A. Acceptance and Approval of the Minutes of Regular Commission Meeting of July 3, 1990; B. Acceptance and Approval of Wesmere, Phase II, Final Engineering Plans; C. Acceptance and Approval of Extension of Site Plan Engineering Contracts; D. Approval to Transfer Funds and Solicit Bids for Chlorine Leak and Low Chlorine Alarms. Commissioner Woodson, seconded by Commissioner Combs, moved to approve the consent agenda. Motion carried with unanimous vote in favor. PUBLIC HEARINGS AND SECOND READINGS Ordinance No. 90-14, "relating to garbage collection: amending subsection 11-10(B) of the Code of Ordinances: providing that either City or Franchisee may bill and collect fees: providing for severability; providing an effective date" was presented by title only for the second reading. The public hearing was opened and Mr. John Linebarier, 1308 Center Street, asked what the franchise fee would be and City Manager Shapiro advised that it could be up to 20%. Mrs. Bruni Massa, 611 E. Lakeshore Drive, pointed out that that kind of fee is passed on to the customer. Mr. Shapiro advised that this applies only to commercial customers. As no one else wished to speak the public hearing was closed. Commissioner Foster, seconded by Commissioner Johnson, moved to adopt the ordinance as presented. On roll call commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried. Page 2 Ocoee City Commission Regular Meeting ~ July 17, 1990 '-" "--' Ordinance No. 90-15, providing for an adjustment of the City of Ocoee Recreational Parks Facilities Impact Fees; providing for severability; providing for an effective date" was presented by title only for the second reading and public hearing. City Manager Shapiro explained that the construction industry and all the developers were notified by posting in the building department approximately 60 days ago the possibility that this would be considered. Mr. Shapiro continued that also the fee varies depending on what district the development is in. The public hearing was opened. Mr. R.P. Mohnacky, 1820 prairie Lake Boulevard, asked that the figures on page two of the ordinance be clarified and stated further that he felt that the City should be reimbursed for the existing parks as well as the new facilities needed for growth. As no one else wished to speak the public hearing was closed. Commissioner Combs, seconded by Commissioner Johnson, moved to adopt Ordinance No. 90-15 as presented. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried. Ordinance No. 90-16, "relating to the City of Ocoee Personnel Rules and Regulations; amending Appendix "C" of the Ocoee City Code by the addition of a new Section 12.09 relating to longevity pay; providing for severability; providing an effective date." was presented by title only for the second reading and public hearing. City Manager Shapiro explained that, when adopting the Personnel Rules and Regulations, the matter of longevity pay was postponed until mid-year in order to determine if there were funds available to support a longevity pay system. However, as originally written, the document excluded several employees who had been here the longest. This amendment takes care of that. The public hearing was opened, and as no one wished to speak, the hearing was closed. Commissioner Johnson, seconded by Commissioner Combs, moved to adopt Ordinance No. 90-16 as presented. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried. -COMMENTS FROM CITIZENS/PUBLIC Mr. Bill James, 804 Spring Creek Drive, stated that the railroad crossings all around town and also street paving at Jamela Drive needed attention, and that Hyland Springs and Spring Creek Drive are all right now but should be watched because of the flow of water during the wet season. Mayor Dabbs read from a report from Public Works Director Brenner which stated that the Central Florida Railroad has scheduled a crew to begin working July 19 to correct the crossing problems, and that American Asphalt Company has been issued a notice to proceed to begin resurfacing at Marshall Farms Road, Marshall Farms Road Extension, Jamela Drive, Mabel Street, Apricot Drive, and Silver Star Road Extension. City Manager Shapiro asked Mr. James to submit a list of roads that need attention and said that it would be considered along with the list on hand during budget time. ~ Page 3 Ocoee City Commission Regular Meeting July 17, 1990 Mrs. Sherri Bohannan had spoken with Mayor Dabbs before the meeting regarding the enforcement of the sign ordinance dealing with banners and Mayor Dabbs noted that fact here, saying also that he had referred Mrs. Bohannan to City Manager Shapiro and also Building Official Flippen. DARRELL P. ROWE APPOINTED TO CODE ENFORCEMENT BOARD Mr. James Skirvin had asked to not be reappointed ended in June 1990. Commissioner Johnson, Commissioner Combs, moved to appoint Mr. Darrell 6812 Cross Cut Court, to replace Mr. Skirvin Enforcement Board. This term will end June 1993. with unanimous vote in favor. when his term seconded by P. Rowe, Jr., on the Code Motion carried BUDGET WORK SESSIONS SCHEDULED City Manager Shapiro advised that he is waiting for information from Rachlin & Cohen but he will have the budget ready by August 1 and also that the budget will balance without a tax increase. Budget work session was scheduled for August 15 at 7:00 p.m. in the commission chambers to continue on August 16 at 7:00 p.m. if needed. '-' STAFF REPORTS City Manager Shapiro requested that (in order to save approximately $1,000,000 in bonding) the proposed July 26th meeting for Clark Road be delayed approximately thirty days (during the week of August 20-24) and schedule the closing of the bond issue the third week of September. The request was granted. COMMENTS FROM COMMISSIONERS Mr. James asked to speak again and he asked if/when new city maps would be available. City Manager Shapiro advised that we are now working with Orange County Mapping and the computor information should be available within a few weeks, but there is not a date certain about the availability of maps for the general public. Commissioner Foster had no comments at this time. Commissioner Johnson had no comments at this time. Commissioner Woodson displayed the recycling hard hats provided by Public Works Director Brenner and advised that the trucks are operating but are a little bit behind schedule. Commissioner Combs 1) complimented Cpl. Conyers on his activities with the D.A.R.E. Program and said that when Commission is giving away dollars this program should be considered. City Manager Shapiro said that $4,000 is available to them. No action was taken at this time. ~. 2) complimented Recreation Director Beech on the Big Orange and thanked him for his involvement with those special people. Garnes young Page 4 Ocoee City Commission Regular Meeting ~ July 17, 1990 3) commended also Public Works Director Brenner for quick action regarding drainage from the construction site at Good Homes Road/Highway 50 when he reported it and noted also that there is a continuing drainage problem at the Bluford Avenue/Orlando Avenue intersection. City Manager Shapiro advised that then the bond dollars come in any available dollars will be earmarked for "others" and will cover that location. Mayor Dabbs 1) complimented Public Works Director Brenner for the way the recycling program has been handled; 2) announced that a business person in the City has complimented the Code Enforcement team and he will pass on the information to City Manager Shapiro after the meeting; 3) announced that he will be out of town the rest of the week; 4) confirmed that the County Manager will speak at the Council of Local Government of Orange County meeting on July 26 in the Ocoee Community Center and said that we will serve barbeque at 6:00 p.m. just prior to the meeting; 5) reminded those present of the Over 65 Program public hearing scheduled for July 24 at 7:30 p.m. in the Ocoee Community Center.
