HomeMy WebLinkAbout12-18-90 '-' MINUTES OF THE OCOEE BOARD OF CITY COMMISSIONERS REGULAR MEETING HELD ON DECEMBER 18, 1990 The regular meeting of the Ocoee Board of City Commissioners was called to order by Mayor Dabbs at 7:30 p.m. in the commission chambers. Commissioner Woodson led in prayer and the Mayor led in the pledge of allegiance. The roll was called and a quorum declared present. PRESENT: Woodson. Attorney Official Mayor Dabbs, Commissioners Combs, Foster, Johnson and Also present were City Manager Shapiro, Assistant City Lower, Planning Director Behrens (left at 8:15), Building Flippen, City Clerk Grafton, and Deputy City Clerk Green. ABSENT: None. In a surprise visit, Santa Claus presented candy canes to the Mayor, Commissioners, and staff and wished all a Merry Christmas. ~ PRESENTATIONS AND PROCLAMATIONS The Citizens Recognition Committee (Mary Anne Swickerath, Walt Cobb, Commissioner Johnson, and City Manager Shapiro) had recommended four citizens to receive Pioneer Awards in recognition of their significant contributions over the years toward improving the quality of life in Ocoee. Mrs. Swickerath enumerated contributions of Hartle Bowness and Edwin Pounds and Commissioner Johnson enumerated contributions of Miriam Reid and Dorothy Wurst. Mayor Dabbs proclaimed December 27, 1990 to be Pioneer Award Day and presented plaques in appreciation. Commissioner Johnson expressed appreciation for City Clerk Grafton's research and preparation of the awards. RECESS 7:47 P.M. - 7:55 P.M. J. W. Taylor, Manager of Cablevision Industries, Inc., explained a letter and a new channel line-up card that had recently been mailed to subscribers in Ocoee. They are introducing a new level of service consisting of the first twenty channels which includes all of the broadcast stations as well as the three super stations at a cost of $10.95 per month. The "T V Host Guide" will be fifty cents per month for those who opt to continue rereiving the publication. Government access will be provided on Channel 16. One of the company's projects for 1991 will be the replacement of cable which was not replaced in 1988 or 1989. Commissioner Woodson had asked him to address the Commission, and he thanked him for corning. ~ CONSENT AGENDA The proposed consent agenda consisted of items A, B, C, D, and E. ~ Acceptance and approval of Minutes of Reqular Commission Meetinq of December ~ 1990, and Commission Workshop of October ~ 1990 ~ Approval and authorization to set 1991 election run-off date for November ~ 1991 and to draw ~ ordinance '-' Page 2 Ocoee City Commission Regular Meeting December 18, 1990 ~ establishinq election procedures per City Charter ~ Approval and authorization of Annual Boat Races on April 13 ~ 1.L.. 1991 ~ Approval and authorization to increase Prima Vista Developer Aareement Accounts Wastewater Guaranteed Revenue from $103.00 per ERC to $106.00 per ERC ~ Approval and acceptance of Good Homes Road Plaza: ~ Developer's Aareement ~ Final Plat City Manager Shapiro advised that the Engineer's comments on the Good Homes Plaza final plat should be noted. Commissioner Foster requested that Item E be pulled. Commissioner Combs, seconded by Commissioner Johnson, moved to approve items A, B, C, and D. The motion was unanimously approved. In response to Commissioner Foster's question about the advantages to the City of the new Developer's Agreement, Mr. Shapiro explained that neither we nor the developer realized at the time the property was bought that it would require platting as it is uncommon to see commercial buildings in platted areas. The current law required them to have a developers' agreement in order to plat, and a final plat was required in order to receive a certificate of occupancy. The new agreement protects the City in the development of the out- parcels. Planning Director Behrens explained that the "As-Built survey" included in the Engineer's comments referred to drawings showing exact locations of easements and how they would interface with other development. Commissioner Foster, seconded by Commissioner Johnson, moved to approve the Developer's Agreement and Final Plat for Good Homes Road Plaza with the Engineer's stipulation that no more than five C.O. 's be issued in the aggregate for any business in any phase of this project, including the out parcels, unless acceptable As-Built survey and easement documents are provided to the City and recorded by the developer at his cost. The motion was unanimously approved. COMMENTS FROM CITIZENS/PUBLIC None. \..., SECOND READINGS AND PUBLIC HEARINGS Ordinance No. 90-81, relating to adopting the current revisions of the Standard Building Code for Building, Plumbing and Mechanical Standards: repealing Ordinance Nos. 958, 961 and 960: repealing Section 5-12 of the Ocoee City Code and adopting a new Section 5- 12 of the Ocoee City Code relating to Building Standards: repealing Section 14.5-12 of the Ocoee City Code and adopting a new Section 14.5-12 relating to Mechanical System Standards: repealing Section 18-13 of the Ocoee City Code and adopting a new Section 18-13 relating to Gas and Plumbing Standards: providing for severability: providing an effective date. Mayor Dabbs opened the public hearing. As there were no comments, the public hearing was closed. Commissioner Combs, seconded by Commissioner Woodson, moved to enact Ordinance No. 90-81. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." The motion was unanimously approved. - Ordinance No. 90-82, relating to surety for improvements in connection with subdivision platting; amending Section 5.3.3 of Article V of Appendix B to the Code of Ordinances of the City of Ocoee relating to developers agreements as a surety for improvements; repealing in its entirety Ordinance Number 872 relating to mandatory developer's agreement in order for developers to operate in the City; repealing in its entirety Appendix 5.5 of Appendix B to the Code of Ordinances of the City of Ocoee relating to the form of developers agreement as surety for improvements; providing for severability; providing for an effective date. City Manager Shapiro read the proposed ordinance by title only. He explained that developers could no longer use developer agreements in lieu of cash bond or letter of credit. Mayor Dabbs opened the public hearing. R. P. Mohnacky, 1820 prairie Lake Boulevard, asked if there had been a problem with the old way. Mr. Shapiro replied that the old way had cost the City money and aggravation. As there were no further comments, the public hearing was closed. Commissioner Woodson, seconded by Commissioner Johnson, moved to enact Ordinance No. 90-82. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." The motion was unanimously approved. Ordinance No. 90-83, relating to the time, place and procedure for meetings of the City Commission of the City of Ocoee; repealing in its entirety Ordinance No. 2 of the City of Ocoee, as amended; creating a new Section 2.4 of Article I of Chapter 2, of the Code of Ordinances of the City of Ocoee; providing for severability; providing an effective date. City Manager Shapiro read the proposed ordinance by title only. Mayor Dabbs opened the public hearing. R.P. Mohnacky asked when the first meeting in January would be held and was told that it would be on Wednesday, January 2nd. As there were no other comments, the public hearing was closed. Commissioner Combs, seconded by Commissioner Foster, moved to enact Ordinance No. 90-83. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." The motion was unanimously approved. OTHER BUSINESS Resolution 90-22, protesting the high tolls on East-West ~ Expressway. City Manager Shapiro read the proposed resolution by Page 4 Ocoee City Commission Regular Meeting ~ December 18, 1990 title only. Mayor Dabbs read the last paragraph. Commissioner Combs, seconded by Commissioner Johnson, moved to adopt Resolution 90-22. The motion was unanimously approved. Senior League Field Access City Manager Shapiro reported that the Glad Tidings Assembly of God Church had offered to sell to the City a 30 foot by 590 foot strip of the church's property to provide access to the Senior League Field at a cost of $12,000.00. As local realtors had indicated that this was a very reasonable price for a parcel of this size, Staff recommended purchase of the property with the funds to be taken from the CommunitY-Wide Park Impact Fee Fund. Commissioner Johnson, seconded by Commissioner Combs, moved to accept staff recommendation to purchase the 30 by 590 foot strip of the Glad Tidings Assembly of God Church property in the amount of $12,000.00 with the funds to be taken from the CommunitY-Wide Park Impact Fee Fund and to authorize the City Attorney to draw up all documents for the closing. Mr. Shapiro and Commissioner Johnson expressed appreciation to the Glad Tidings Church and Pastor Dillard Burgess for their help with solving the access problem. The motion was unanimously approved. Commissioner Johnson 1 - Reported good response from citizens about the Christ~as lights and thanked City crews for their effor~s. M:. ShaP7ro commented that Winter Garden has had good exper1ence w1th leas1ng Christmas decorations and Ocoee may want to consider leasing next year. 2 - (NOTE: NON-AGENDAED ITEM) Initiated discussion about the sidewalk problem at the corner of Adair and Wurst Road. Mr Shapiro stated that we anticipate having enough money when we co~plete our projects to pay the County an estimated $2,400.00 to construct the sidewalk. Commissioner Johnson~ secon~ed by Commissioner Foster, moved to advise Staff to reV1ew the s~dewalk situation at Adair and Wurst and to pay the Co~nty approx~mately $2,400.00 to construct the sidewalk. The mot10n was unan1mously approved. 3 - Requested input from Commissioners for Pioneer Award nominees. Commissioner Woodson Mr. Woodson expressed the Lions Club's appreciation for the City's ~ help with the Christmas parade. Page 5 Ocoee City Commission Regular Meeting ~ December 18, 1990 Commissioner Combs 1 - Thanked all Commissioners who participated in the Kiwanis golf tournament. 2 - Noted Eddie Hendrix letter of commendation from Maronda Homes. 3 - Announced that judging of Christmas Decorations was scheduled for December 19th from 6:00 p.m. to 9:00 p.m. 4 - Wished all a Merry Christmas from him and Mrs. Combs. '-' Mayor Dabbs 1 - Also commented on Eddie Hendrix letter of commendation from Maronda Homes. 2 - Reported receipt of a letter from a Spring Hill Drive resident inquiring about a branch library for Ocoee. Mr. Shapiro said that he had contacted the library system and had learned that less than 1/2 of one percent of residents with Ocoee addresses used the library. The use rate did not justify adding a library in Ocoee. Commissioner Foster asked how many residents have non-Ocoee addresses. Mr. Shapiro responded that that was a point well- taken. 3 - Had received a letter from Winthrop Rockefeller announcing that he will be the speaker at a luncheon scheduled on Wednesday, February 13 to benefit the Snowbabies organization. 4 - Had received notice of a meeting scheduled in Zellwood on December 20th at 10:00 a.m. for a Joint Environmental Water Quality Project for Lake Apopka Grant Ceremony. Asked for a volunteer to attend and Commissioner Woodson said that he would attend. 5 - Mentioned a report from the Lions Club about how monies were spent on the parade. 6 - Wished all a Merry Christmas.
