HomeMy WebLinkAbout10-01-91 '-' MINUTES OF THE OCOEE BOARD OF CITY COKKISSIONERS REGULAR MEETING HELD OCTOBER 1, 1991 The regular meeting of the Ocoee Board of City Commissioners was called to order by Mayor Dabbs at 7:30 p.m. in the commission chambers. Commissioner Foster led those present in the prayer and pledge of allegiance. The roll was called and a quorum declared present. PRESENT: Mayor Dabbs, Commissioners Combs, Foster, Johnson, Woodson. Also present were City Manager Shapiro, City Attorney Rosenthal, Administrative Services Director Beamer, City Engineer/Utili ties Director Shira, Planning Director Behrens, Public Works Director Brenner, and City Clerk Grafton. ABSENT: None PRESENTATIONS AND PROCLAMATIONS The following proclamations were announced by Mayor Dabbs: 1. October 1991 as ALPHA DELTA KAPPA MONTH 2. October 7-11, 1991 as FLORIDA CITY GOVERNMENT WEEK 3. October 19-27, 1991 as NATIONAL RED RIBBON WEEK 4. October 24, 1991 as UNITED NATIONS DAY 5. October 27-November 2, 1991 as NATIONAL JOB SKILLS WEEK Mayor Dabbs and Fire Chief Strosnider were presented POW/MIA Flags from VFW Auxiliary 4305 for City Hall and the Fire Station. ..... CONSENT AGENDA The proposed consent agenda consisted of items A, B, C, D, E, F, G, H, I, and J. Commissioner Woodson pulled item B to be voted on separately. A. Acceptance and Approval of Minutes of Regular Commission Meeting~ September 17, 1991 and Special Sessions of September 3 and 24, 1991 C. Approval and Authorization to Execute Renewal of Fleet Maintenance Agreement with the Town of Windermere D.__Approval and Authorization to Execute All Documentation Necessary to Consummate the Purchase of Clark Road Parcel Nos. 108, 208, and 308 from Orange County at a Total Purchase Price of $18,755 E. Approval and Authorization to Proceed with the Relocation, at the City's Expense, of Approximately 800' of Orange County's 24-inch DIP Water Main Located within the Existing Clark Road Right-of-Way, Including All Design and Construction Costs Associated Therewith F. Approval and Authorization to Execute Easement Agreement with Florida Power Co~ration and Authorize Payment for the Purchase of this Easement in the Amount of $1,755 with Funding Coming from the Clark Road Right~of-Way Acquisition Funds G. Approval and Authorization to Execute Agreement with PDR Architects, Inc. for M~nicipal Complex H. Approval and Authorization to Execute Work Order No.1 in the Amount of $8,595 with Additional Reimbursable Cost Not to Exceed $75 with PDR Architects, Inc. for Architect Services I. Approval of Pr~osed Addendum to P.E.C. Approval and Authorization to Pay East Central Florida Regional Planning Council Annual Assessment in the Amount of $2,492 '-" ~ '-' ~ Page 2 Ocoee City Commission Regular Meeting October ~, 1991 Commissioner Combs, seconded by Commissioner Johnson, moved to approve items A, C, D, E, F, G, H, I, and J on the consent agenda as presented. Motion carried with unanimous vote in favor. B. Acceptance and Authorization to Execute Developer Agreement with Arvida/JMB Partners, Ltd.-II (Arvida) for Wesmere P.U.D. City Attorney Rosenthal explained that this developer agreement contains nothing substantively new, that the City Code requires that certain items on the Land Use Plan be incorporated into a developer agreement and recorded of record so that everyone is on notice of what is in the Land Use Plan, and the exhibit is a reproduction of the development notes and conditions of approval contained on the document previously approved by Commission. Commissioner Woodson said that he had voted against this item when it was considered previously and wished to be consistent. Commissioner Combs, seconded by Commissioner Johnson, moved to approve item B as presented. Motion carried with 4-1 vote in favor. Commissioner Woodson voted "no." COKKENTS FROM CITIZENS/PUBLIC R.P. Mohnacky, 1820 Prairie Lake Boulevard, spoke regarding the advantages of the City going to independent recycling rather than dealing with Orange County. PUBLIC HEARINGS - None OTHER BUSINESS Award of Clark Road Construction Contract City Manager Shapiro advised that the low bid for the Clark Road Construction Contract is in order and that Mr. Bob Campbell, P.E.C., is present to answer any questions. City Attorney Rosenthal said that the agenda packet also contains copies of the protests made by three of the bidders: Bumbyand Stimpson,Inc., The Conduit and Foundation Corporation, and American Ductile Iron Pipe, along with his firm's legal analysis and recommendation that the protests do not have sufficient legal basis to constitute a challenge to an award to the low bidder. Mayor Dabbs asked if representatives of any of the firms wishing to protest were present, but the only firm represented in the audience was S & E Contractors. Commissioner Combs, seconded by Commissioner Foster, moved to award the contract for the construction of Clark Road to S & E Contractors as recommended by staff in the amount of $3,993,962.51 and authorize the Mayor and City Clerk to execute the contract. On roll call Commissioner Combs voted "aye," Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor Dabbs "aye." Motion carried. Resolution No. 91-21, establishing charges for photocopying of public records "establishing charges for services in responding to public records requests; providing for severability; providing for an effective date." was presented by ti tIe only. Commissioner Woodson, seconded by Commissioner Combs, moved to adopt Resolution No. 91-21 as presented. Motion carried with unanimous vote in favor. Designation of Depositories for City Funds Commissioner Foster, seconded by Commissioner Combs, moved to authorize staff to continue the use of Orange Bank and Barnett Bank as depositories for City funds. Motion carried with unanimous vote in favor. '-' Page 3 Ocoee City Coamission Regular Meeting October 1-', 1991 First Reading of Ordinance - Second Reading and Public Hearing Scheduled for October 15, 1991 Ordinance No. 91-29, "relating to the collection of garbage, yard trash and recyclable materials; amending Section 11, Chapter 11 of the Ocoee Code of Ordinances; providing for definitions; requiring specified containers; setting forth requirements for the use and placement of containers; requiring the sorting of waste by type; prohibiting accumulations and deposits; providing requirements for the removal of garbage; authorizing the setting of collection fees by resolution; establishing collection schedules for City collection of garbage, yard trash and recyclable materials; providing for time of placement of containers for collection; providing for severability; providing for codification; providing an effective date." was presented by title only for the first reading. Mayor Dabbs announced that the second reading and public hearing for this ordinance will be held October 15, 1991. STAFF REPORTS - None ~ COKKENTS FROB COKKISSIONERS Commissioner Woodson announced the following events: 1) Orange County Commission public meeting regarding redistricting to be held at the West Orange Services Center on Thursday, October 3 at 7:00 p.m. 2) YMCA Golf Tournament in Windermere October 4 at 11:00 a.m. 3) YMCA Fun Day at YMCA October 5. Commissioner Combs: 1) Said that he will be away on vacation the week of October 15. 2) Thanked his City family for the flowers, thoughts and prayers in the loss of his wife's brother. 3) Applauded staff for the super job on "City Limits," the newsletter just mailed. 4) Presented the Marilyn Calvert Liver Transplant Fund with a check from Kiwanis in the amount of $500. Commissioner Foster: 1) Said that he continues to see washers and furniture curbside and asked that the items be picked up and a special assessment levied. 2) Objected to the State assessment of 1% of commissioner's salary going to the Cabinet. Co..issioner Johnson: Thanked Commissioner Combs for the Kiwanis contribution to the Marilyn Calvert Liver Transplant Fund and reported that they may need $200,000 for Pittsburgh and an additional $15,000 for the testing to see if a transplant is advisable. Approximately $13,300 has been raised to date, with a golf tournament scheduled for October 27, continuing carwashes, a drawing for a 51" Mitsubishi TV, and a Las Vegas Nite scheduled in the near future. In addition to these, wrestlers are giving a portion of the proceeds for their matches to the fund, and Rock and Roll station is having an antique car show on October 13.
