Apartments Phase 2?
Backaround Summary:
Key Isle Apartments Phase 2 Site Plan is the final phase of the existing Key Isle Apartments located on the
south side of Bridge Creek Boulevard and east of Maguire Road. Key Isle Apartments Phase 2 is located on
the south side of the existing Key Isle Apartments and on the north side of Moore Road approximately 800
feet east from the intersection with Maguire Road. The subject property is currently undeveloped and
sparsely covered with a mixture of cherry trees, oak trees and other varieties of trees.
The Future Land Use designation is designated as "High Density Residential" which allows up to 16 dwelling
units per acre. The surrounding land use to the north is developed as part of the Key Isle Phase 1 multi-
family residential apartments. To the northwest is the Plantation Grove Shopping Center (Publix) and to the
southwest is the Plantation Grove Phase 3 commercial center, currently under construction, both of which
are zoned PUD-Commercial. To the east is Cross-Creek a single-family residential subdivision, zoned PUD-
Low Density; and to the south is Meadow Ridge a single-family residential subdivision, zoned PUD-Low
Density and currently under construction.
On July 21, 1998, the City Commission reviewed and approved the Preliminary Site Plan for Key Isle
Apartments (FKA: The Esplanade at Plantation Grove). The Final Site Plan for Key Isle Apartments Phase 2
as presented is consistent with the original Preliminary Site Plan as approved.
DISCUSSION:
The Key Isle Apartments Phase 2 Site Plan proposes 165 residential units on approximately 11.46 acres.
The property is zoned as a PUD which requires a minimum living area of 650 square feet per unit. However,
most of the units as presented far exceed this PUD requirement. The architectural theme appears to be
reminiscent of Key West architecture. This architectural design is intended to be cohesive with the existing
Key Isle apartments. Amenities that are proposed on the site plan are a swimming pool, clubhouse, gazebo,
and picnic area.
The Key Isle Apartments Phase 2 is design to connect with the existing Key Isle apartments to the north via a
private roadway (Treasure Landing PY) and a parking interconnect. The main access will be on the south
side via Moore Road. Along with the usual utility improvements, the site plan will provide for a left turn lane
on Moore Road for the south access entrance. This entrance will be secured with a decorative metal gate.
As shown on the Site Plan, there will be a 6-foot brick wall on both sides (east and west) of the development.
The privacy wall on the western boundary has been provided through a joint venture with the adjacent
commercial development. There will be a pedestrian gateway to connect with commercial development.
Along Moore Road will be a decorative black aluminum fence supplemented with stone columns and
appropriate landscaping.
The proposed sanitary system is connecting to a private sanitary system. The City of Ocoee will not own or
maintain the proposed sanitary system. The Developer of the Key Isle Apartments is responsible to
coordinate the utilities connection with the commercial developers adjacent to the west. Finally, a Reciprocal
Easement Agreement will be required from the Developer/Owner in order to ensure that utilities, recreational
facilities, and access rights (et. al.) will be jointly used and shared with the existing Key Isle Apartments.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) reviewed the Key Isle Apartments Phase 2 Site Plan on
October 31, 2006. There were a few minor issues to be addressed from the City Attorney and from the
Engineering Department that were identified in written staff comments (see attached) and presented verbally.
There was also a new minor technical issue raised on an inlet at the trash storage area and how it was
supposed to be connected to the drainage system. All of the issues were discussed and some changes to
the Plan were agreed upon.
When the discussion was finished, the Committee voted unanimously to recommend approval of the Final
Site Plan, subject to making the changes agreed upon at the DRC meeting before the City Commission
meeting.
PLANNING & ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission reviewed the proposed Key Isle Apartments Phase 2 Site Plan on
November 14, 2006. City Staff and the Applicant answered several questions regarding apartment access,
screening walls, the cross use of the recreation amenities, the private sewer system and the stormwater inlet.
All of the questions were addressed adequately in the P&Z meeting. There was no one from the public to
speak regarding this subdivision approval.
After finishing its deliberations, the Planning & Zoning Commission voted unanimously to recommend
approval of the Final Site Plan for Key Isle Apartments Phase 2, as date stamped received by the City on
October 30, 2006, subject to resolving the issues specified on the City Attorney's memorandum, the
Engineering Department comments and resolving the issue with the inlet at the trash storage area before the
City Commission meeting.
On November 27, 2006, the City received the revised Final Site Plans for Key Isle Apartments Phase 2
incorporating the agreed upon changes; however, minor City Attorney's Office and Engineering Department
comments still need to be addressed by the Applicant.
Staff Recommendation:
Based on the recommendation of the Planning & Zoning Commission, Staff recommends that the Mayor and
City Commissioners approve the Final Site Plan for Key Isle Apartments Phase 2, as date stamped received
by the City on November 27, 2006, subject to resolving the issues specified on the City Attorney's
memorandum and the Engineering Department comments.

In connection with the above-referenced project, we have reviewed the following
documents:
1. Final Site Plans for Key Isle Apartments Phase II stamped received by the City of
Ocoee on October 30, 2006 (the "Plan").
2. Reciprocal Easement Agreement dated January 29, 1999 as recorded in OR Book
5675, Page 1537 (the "Reciprocal Easement Agreement").
This memorandum supersedes our previous memoranda dated January 23, 2006, February
23,2006, June 21, 2006 and October 3, 2006. Based on our review of the documents noted above
and pursuant to the Land Development Code, we have the following comments:
1. The Reciprocal Easement Agreement should be amended to provide that: (i) The
Phase I Property and the Phase II Property will have shared and joint use of all recreational
facilities, and (ii) The Agreement cannot be amended without the consent and approval of the City
in an instrument recorded in the Public Records of Orange County, Florida. The foregoing should
be submitted to the City for review and approval prior to City Commission consideration of the
Final Site Plan. Following approval and prior to City Commission approval of the Final Site Plan, a
fully executed original should be delivered to the City for recording, along with a joinder and
consent from all mortgage holders.
2. We have no further comments regarding the Plan.

will maintain the proposed and existing sanitary system. The agreement provided was
between two apartment companies. The agreement to allow for sanitary connection needs
to be between the property owner and Plantation Groves (Opus South).
