HomeMy WebLinkAbout03-28-2017 Minutes CODE ENFORCEMENT BOARD MINUTES March 28, 2017 CALL TO ORDER Chairman Lowery called the regular meeting of the Ocoee Code Enforcement Board to order at 7:01 p.m. in the Commission Chambers at City Hall. Vice-Chairman Carrington initiated the moment of silence, and Member Odom led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Lowery, Vice-Chairman Carrington, Member Odom, and Member Lomneck, Also present were Board Attorney Mary Sneed, Asst. Support Services Director - Code Enforcement Manager Doug Gaines, Code Enforcement Officers Edward Loeffler, Officer Siegrist, and Officer Theresa Rodriguez; Administrative Assistant Bridgett Coffey, and Recording Clerk Amber Landry. ABSENT: Member Blynder and Member Osborne Administrative Assistant Coffey administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. She further explained that the property was in compliance as of February 28, 2017. She is presenting this case to the board for future repeat violation due to the history, which has required her to write repeated violation notices: April 12, 2016, June 22, 2016, and February 21, 2017. Kaylee Dorman who resides at 16 Lafayette Street was present but did not speak. Speaker reservation form is on file. Further discussion ensued about the board's ability to take action; Attorney Mary Sneed recommended that the City withdraw the case. Exhibits were presented. Officer Loeffler further explained that as of March 28, 2017, the property is still in non-compliance. He also noted that the current owners, Jorge and Elizabeth Medina are not the owners who pulled the original permit. lie confirmed that the current owners are working with the Building Department to resolve this matter. The City is requesting an order of compliance within 30 days or be fined $10.00 per day thereafter that the violation remains in non-compliance. Vice-Chairman Carrington, seconded by Member Odom, moved that in Case #17-003, the respondent be found in violation for code violations 105.4.1.2, as cited as of December 30, 2106, and be given until April 30, 2017, to come into compliance or be fined $10.00 per day until found in compliance . Motion carried unanimously. Exhibits were presented. Officer Siegrist further explained as of March 28, 2017, the property is still in non-compliance. He was able to confirm with the Building Department that Ignacio Mendoza-Andrade, the tenant attempted to pull a permit; however, he was unable to pull a permit without the property owner's written approval.The city is requesting an order of compliance within 60 days or be fined $25.00 per day thereafter that the violation remains in non-compliance. 3iPage Member Odom, seconded by Vice-Chairman Carrington, moved that in Case #17-013, the respondent be found in violation for code violation 51-13, as cited as of February 25, 2017, and be Liven until May 30, 2107, to come into compliance or be fined$25.00 per day until found in compliance. Case No. 17-015 Antonio Zepeda Officer Loeffler 1804 Adair Street Olivia Zepeda Violation Cited: 168-6B(1), 115-3 Observation: Vehicle(s) parked/stored upon unimproved and unsurfaced front yard grass; red Camaro and routinely changing other vehicles. Property littered with empty beer cans, scattered and piles, front and side yards, corners. He is presenting this case to the board for future repeat violation due to the history. The city is requesting a finding of violation but in compliance with no fines assessed at this time. Vice-Chairman Carrington, seconded by Member Odom, moved that in Case #17-015, the respondent be found in violation for code violations 168-68(1) and 115-3, as cited as of February 17, 2017, and be found in compliance as of March 24, 2017, no fines be assessed at this time. Conditions constituting a public nuisance, an attractive nuisance to juveniles and criminals, creating a blighted effect upon the neighborhood and the city as a whole. Danger to the public health, safety and welfare. No further action was required by the board. He was able to verify with the Building Department that permits have been applied for and are awaiting approval. Vice-Chairman Carrington, seconded by Member Lomneck, moved that in Case #17-010 the compliant date be extended to April 17, 2017. Motion carried unanimously. COMMENTS Board Attorney Mary Sneed —wished everyone a great evening. Member Lomneck—stated that he would like to see some of the fines increased.Asst. Support Services Director- Code Enforcement Manager Doug Gaines and Chairman Lowery explained the City is only giving a recommendation the Board sets the final fee. Chairman Lowery — Thanked everyone for a great meeting and work well done. Ended the meeting by wishing everyone a good April and said he looks forward to seeing everyone next month.
