HomeMy WebLinkAbout11-15-94 '-" MINUTES OF THE CITY OF OCOEE BOARD OF COMMISSIONERS REGULAR MEETING HELD NOVEMBER 15, 1994 Mayor Vandergrift called the regular city commission meeting to order at 7:35 p.m. in the commission chambers. Commissioner Foster led in prayer and Mrs. Frances Watts led in the pledge of allegiance. The roll was called and a quorum declared present. PRESENT: Mayor Vandergrift, Commissioners Combs, Foster, Gleason, and Johnson. Also present were City Manager Shapiro, City Attorney Rosenthal, City Engineer/Utilities Director Shira, Administrative Services Director Beamer, Building Official Flippen, Planning Director Wagner, Police Chief Mark, Concurrency Analyst Resnik, and City Clerk Grafton. ABSENT: None PRESENTATIONS AND PROCLAMATIONS Mayor Vandergrift presented two proclamations: American Education Week - November 13- 19, 1994, and PTA Week - December 11-17, 1994, and then invited Mrs. Nora Gledich, principal of Ocoee Elementary School, to speak. Mrs. Gledich spoke briefly about Teach-in 2000 and expressed appreciation for the fact that the people in local government are so accessible to the children in Ocoee schools. .~ Mrs. Frances Watts, president of the Ocoee Senior Citizens, announced that Mr. Jewel Long, recently recognized for getting his G.E.D. at age 90, had been chosen to be Grand Marshal of the parade at Disney on November 17, 1994. CONSENT AGENDA The consent agenda consisted of items A, B, C, D, and E. Mayor Vandergrift pulled items B, D, and E for discussion. Mavor Vandere:rift. seconded bv Commissioner Gleason. moved to aoprove and acceot items A and C as oresented. Motion carried 5-0. A. Acceptance and Approval of Minutes of the Re~ular Meetin~ held November 1. 1994. C. Approval and Authorization for Mayor and City Clerk to execute Water Service A~reement and Sewer Service A~reement. both dated June 7. 1994. with Opus South Corporation. Clerk's Note: The document actually submitted to Commission and approved was "Sewer and Water Recognition Agreement" to be effective October 25, 1994. The items pulled for discussion were: B. Approval and Authorization to use forfeiture funds not-to-exceed $4.000 to purchase ten (10) VHF frequency portable radios with chare:ers. Mayor Vandergrift asked Police Chief Mark to explain this item. Chief Mark said the radios '-" were to be used with the new Youth Watch Program and the school system had agreed to buy Ocoee City Commission Regular Meeting "-' November 15, 1994 3 radios if/when the City purchased 10 radios. Mavor Vandenrrift. seconded by Commissioner Foster. moved to avorove and authorize the use of forfeiture funds not-to-exceed $4.000 to ourchase ten VHF freauencv oortable radios with charl!ers. Motion carried 5-0. D. Approval and Authorization for Commissioner Gleason to attend Leadership West Oranfl:e for an amount not-to-exceed $600. Mayor Vandergrift said he had asked for a policy to cover this type of action. Commissioner Combs advised that he was invited by West Orange Chamber to attend the Leadership West Orange last year and at the end of the session the participants were asked to recommend someone for the next session. He had recommended Commissioner Gleason. Commissioner Combs. seconded bv Commissioner Johnson. moved to aoorove an exoenditure of an amount not-to-exceed $600 for Commissioner Gleason to attend Leadershiv West Oranl!e. Motion carried 5-0. E. Approval and Authorization to declare Kissimmee Avenue Water Stora!!e Tank Surplus Equipment. Mayor Vandergrift asked if this will plug the well also. City Engineer Shira responded that it would not be plugged at this time, but sometime in the future. Commissioner Gleason. seconded by Commissioner Johnson. moved to declare Kissimmee Avenue Water Storal!e Tank ~ Surolus Eauioment. Motion carried 5-0. COMMENTS FROM CITIZENS/PUBLIC Mr. R. P. Mohnacky, 1820 Prairie Lake Boulevard, asked if the City could make a request regarding the striping on A. D. Mims Road near the intersections with Forest Oaks and Carriage Oaks, as he has had near-accidents caused by the way the road is striped. City En~ineer Shira responded that he had contacted the County about this some time ago and would again. Mr. Mohnacky stated also that he felt that Lakeshore Drive should be opened by now. PUBLIC HEARINGS SECOND READINGS OF ORDINANCES. ORDINANCE NO. 94-27, ADOPTING CURRENT CITY SEAL. This ordinance was presented by title only for the second reading and public hearing. City Attorney Rosenthal explained that in 1990 the City Seal had been adopted by resolution, and subsequent to that time the State had adopted a statute providing a method for cities that had adopted their seal by ordinance to prosecute for misuse of the seal. The public hearing was opened. As no one wished to speak the public hearing was closed. Commissioner Combs. seconded by Commissioner Gleason. moved to enact Ordinance No. 94-27. adootinl! the Citv Seal. On roll call Commissioner Combs voted "ave." ORDINANCE NO. 94-28, AMENDING CH. 7 RE: CODE ENFORCEMENT BOARD PRIVATE PROCESS SERVERS. This ordinance was presented by title only for the second reading and public hearing. City Manager Shapiro explained that this authorization is needed to avoid the delay now being experienced by the Code Enforcement Department in processing and serving papers. Commissioner Johnson "ave." and Mavor Vanderl!rift "ave." Motion carried 5-0. VACATION APPLICATION 5' UTILITY EASEMENT ABUTTING LOT 40, LAKE OLYMPIA-LAKE VILLAGE SUBDIVISION. (Continued from October 18, 1994 and November 1, 1994) and '-' RESOLUTION NO. 94-29, ABANDONING AND VACATING 5' UTILITY EASEMENT ABUTTING LOT 40, LAKE OLYMPIA-LAKE VILLAGE SUBDIVISION. (Continued from October 18, 1994 and November 1, 1994) This resolution was presented by title only. City Attorney Rosenthal explained that adopting the resolution vacating this easement would not establish a precedent because of the particular circumstances surrounding the issue, i.e., the retaining wall built within the City easement was the only solution to a problem at the time and it was done with the Building Department being involved and permits issued. Leaving the easement in place poses a potential title problem with respect to the home, and as there are no existing easements within this platted easement, Mr. Rosenthal recommended adoption of the resolution vacating the easement. The public hearing was opened. As no one wished to speak the public hearing was closed. '-' 3 Ocoee City Commission Regular Meeting ~ November 15, 1994 OTHER BUSINESS RESOLUTION NO. 94-32, ADOPTING ADDITIONAL CONCURRENCY APPLICATION FORMS FOR LAND DEVELOPMENT CODE. This resolution was presented by title only. Concurrency Analyst Resnik explained that the forms are designed to carry out the adopted Code and replace the original single all-purpose form which was difficult to use. Commissioner Combs. seconded bv Commissioner Johnson. moved to adoot Resolution No. 94-32. adootinl! additional concurrency aoolication forms for the Land Develooment Code. Motion carried 5-0. OCOEE MUNICIPAL COMPLEX - APPROVE SUBSTANTIAL COMPLETION DATE. Administrative Services Director Beamer presented the staff report. Motion carried 5-0. ~ DISCUSSION RE: PROPOSED ENCLAVE LEGISLATION POLICY - FLORIDA LEAGUE OF CITIES. City Manager Shapiro said that he had presented Mayor Vandergrift's proposal regarding annexation of land within an enclave to Ms. Diane Salz, a staff member of the Florida League of Cities, and she had requested a memorandum to her Committee for possible review at the Legislative Session beginning November 17, 1994. EMERGENCY ITEM: CLOSURE OF ROADS FOR CHRISTMAS PARADE Mavor Vanderl!rift. seconded bv Commissioner Johnson. moved to aoorove the closure of certain roads. as listed in the memorandum dated November 15. 1994 from Police Chief Mark. for the Christmas Parade to be held December 3. 1994. Motion carried 5-0. APPOINTMENTS TO BOARDS PD CITIZENS ADVISORY COUNCIL. Commissioner Johnson. seconded bv Commissioner Combs. moved to apooint Thomas A. Hendrix to serve a three vear term on the Police Deoartment Citizens Advisory Council. Motion carried 5-0. STAFF REPORTS There were no staff reports at this time. '--' 4 Ocoee City Commission Regular Meeting ~ November 15, 1994 '-' '-'" COMMENTS FROM COMMISSIONERS Commissioner Gleason: 1) Announced that volunteers are invited to bring their tools and help build the playground at Ocoee Elementary School on Sunday, November 20 at 8:00 a.m. 2) Asked about the speed limit and children playinl! signs that had been requested for Sleepy Harbour Drive. 3) Said that, although the Orange County Mosquito Control truck did show up and spray, they are needed again. 4) Asked that consideration be given to diverting water into the retention pond at Orlando A venue/Sleepy Harbour Drive to keep it from going directly into the lake from the road, as that pond stays dry even during heavy rainfall. City Manager Shapiro will respond in writing. 5) Expressed his appreciation for the opportunity to work with this Commission and noted that this is the last meeting for at least one member of the Commission. Commissioner Combs: 1) Thanked the Commissioners he has served with over the last 6 years. 2) Reminded citizens to vote on November 29 at the community center. Commissioner Foster: 1) Announced that at the Recreation Advisory Board meeting a Santa Phone Bank was discussed and Commissioners may be called on to help man the phone. 2) Bowl-a-thon is scheduled in approximately 2 months to benefit the Big Orange Games. 3) Sysco Thanksgiving Dinners will be distributed from the community center on November 23 from 1 :00 - 6:00 p.m. 4) Ocoee Historical Commission will hold Arts & Crafts sales on November 26 at the Withers-Maguire House. Commissioner Johnson: 1) Asked for an update on the Amber Ridge situation. City Manager Shapiro advised that November 17 there will be a meeting in the afternoon with the builders. developers. attorneys and engineers to review the issues brought up in PEC's memo. then a recommendation will go to Commission for action. Amber Ridge Homeowners' Association has asked for parking signs. Have the lights been ordered for Amber Ridge? Yes. Expressed appreciation to City Clerk Grafton for putting together the Veterans' Day program. Said he takes pride in working for the City and he appreciates the endorsement of the citizens. 2) 3) 4) 5) 5 Ocoee City Commission Regular Meeting '-'" November 15, 1994 Mayor Vander&rift: 1) Noting the invitation to participate in the Citrus Bowl parade, he asked that someone in Ocoee prepare a float representing the City for that parade. 2) Expressed appreciation for the Veterans' Day program also. 3) Reported a broken sidewalk behind the bleachers near the equipment room at the major league field western stand.
