She is willing to serve a new term if you should wish to reappoint her. The attorney's opinion concerning this appointment is attached. Citizen Advisory Council for Police Department The three year terms of Hilda Ems, Lisa Morton, and Richard Pride will expire April, 1995. All are willing to serve new terms if you should wish to reappoint them. General Employees' Retirement Trust Fund Board of Trustees The appointment of a member to replace Mickey Shiver on this board was tabled to this meeting on February 21, 1995. No applications have been received. Member listings for the Recreation Advisory Board and Citizen Advisory Council are attached. Rosenthal, Esq., City Attorney KL DATE: February 8, 1995 RE: City Employee as Member of Code Enforcement Board and Parks and Recreation Advisory Board This is in response to your inquiry regarding whether an individual employed by the City of Ocoee as a part-time receptionist/clerical worker may serve as a member on both the Code Enforcement Board and the Parks and Recreation Advisory Board. In this regard, I have reviewed applicable provisions of the Florida Statutes (and case law interpreting such provisions), the Code of Ordinances of the City of Ocoee, and the Administrative Rules of the Code Enforcement Board. Please note that neither the Code Enforcement Board nor the Parks and Recreation Advisory Board have adopted by-laws which would be applicable in this matter. The provisions of the City Code and the Administrative Rules do not contain any specific provisions prohibiting City employees from (i) serving on either the Code Enforcement Board or the Parks and Recreation Advisory Board or (ii) serving as a member of both Boards. Chapter 112, Florida Statutes, contains a Code of Ethics for public officers and employees. While such Code of Ethics would apply to such individual, there is no applicable case law or authority interpreting the provisions of Chapter 112, Florida Statutes, which are directly on point with regard to this matter. In our opinion, an individual employed by the City as a part-time receptionist/clerical worker and serving as a member of both the Code Enforcement Board and Parks and Recreation Advisory Board is not prohibited from doing so under the City Code or Ellis Shapiro, City Manager February 8, 1995 Page 2 the Administrative Rules and would not violate the Code of Ethics set forth in Chapter 112 provided the guidelines set forth herein are followed. First, in the scope of such individual's employment, he/she should not be required to perform any duties relevant to such Boards. For example, the individual should not (i) type staff reports, complaints, memoranda or other documents relevant to either Board or (ii) perform other tasks within City Departments (e.g., the Building Department) which may expose such individual to information relative to matters involving either Board. Second, the individual should not engage in any Sa parte communications as more particularly described in Rule 2.5(a) of the Administrative Rules. Finally, the individual should not be assigned to do work directly for the Building Department or Recreation Department. Please note that this opinion is not binding on the Florida Ethics Commission. The only way to obtain a binding determination would be to formally request an opinion from the Ethics Commission.
