Background Summary: Tomyn Boulevard on the west side of Maguire Road south of the Florida Turnpike runs west, and then turns south as it reaches SR 429 and extends roughly parallel to SR 429 as a continuous segment of pavement to running to Roberson Road; however, due to historical road alignments, the southern portion of this segment is known as Windermere Road. The name change occurs approximately 700 feet north of the Roberson Road intersection, as this is the historical location of the change in alignment and jurisdiction, but there is no physical element, such as an intersection with another road or a significant change in direction, to clearly mark the road name change at this location. South of Roberson Road, Windermere Road extends for another two miles, and then turns east to terminate at Maguire Road. State Road 429 in this area was completed in 2002, at which time it cut Windermere Road into two segments. Prior to the construction of State Road 429, Windermere Road north of Roberson Road was a straight, north-south road, extending to and terminating at Marshall Farms Road. The northern segment of Windermere Road is located in the City of Winter Garden on the west side of SR 429. There is a connecting street, Warrior Road, which passes under SR 429. The subject portion of the old roadway alignment remained under Orange County jurisdiction at the time the portion to the north became part of the City of Ocoee's street network. At a later time, the city assumed maintenance jurisdiction for the subject Windermere Road segment north of Roberson Road from Orange County. There is only one structure that will be impacted by the change in name from Windermere Road to Tomyn Boulevard: a communications tower addressed as 775 Windermere Road in unincorporated Orange County. This facility is located immediately north of the point of name change and the address was likely assigned prior to the road being bisected by SR 429. Issue: Should the City Commission approve staffs proposed name of Tomyn Boulevard for the approximately 700 foot segment of Windermere Road north of Roberson Road? Recommendation: Staff recommends the City Commission authorize the City to name the entire road between Maguire Road and Roberson Road as Tomyn Boulevard. Such an action will move the point of name change from Tomyn Boulevard to Windermere Road south to the Roberson Road intersection. There are currently two buildings addressed to Tomyn Boulevard between Maguire Road and Roberson Road: a Child Care Center at 860 Tomyn Boulevard and an assisted living facility at 1061 Tomyn Boulevard, both within the City of Ocoee. Staff will ask Orange County to change the street signs at the Roberson Road intersection and re-address the communications tower at 775 Windermere Road to reflect the adopted name change. WHEREAS, the name, "Windermere Road," is the legal name of a segment of that certain street in the City of Ocoee, Florida, located between Roberson Road and extending to a point approximately 700 feet north of the north right-of-way line of Roberson Road, as generally depicted on Exhibit"A" attached hereto and by this reference made a part hereof; and WHEREAS, the name, "Tomyn Boulevard," is the legal name of a portion of that certain street in the City of Ocoee, Florida, located between approximately 700 feet north of Roberson Road and Maguire Road, as generally depicted on Exhibit"A"; and WHEREAS, the City desires to change the name of Windermere Road, north of Roberson Road, to Tomyn Boulevard as an aid to navigation by the motoring public and to more efficiently address adjacent properties. NOW, THEREFORE,BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA,AS FOLLOWS: Section 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. Section 2. Renaming of Windermere Road. The roadway segment presently called Windermere Road, as described above, is hereby renamed and designated as "Tomyn Boulevard," as generally depicted on Exhibit"A". Section 3. Further Acts; Notice. The City Commission of the City of Ocoee hereby authorizes the Mayor, the City Clerk, and other city staff to execute any documents and take such other actions as may be necessary to effectuate the designations referenced in Sections, above. Without limiting the forgoing, the City Clerk is hereby directed to provide notice of the adoption of this resolution to all affected property owners, the United State Postal Service, the Orange County Property Appraiser's Office, the Orange County Tax Collector's Office, Orange County Emergency Services, and other relevant entities. Section 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
