MINUTES OF THE CITY OF OCOEE
CODE ENFORCEMENT BOARD MEETING
JANUARY 28,2003
CALL TO ORDER
Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to
order at 7:32 p.m. in the Commission Chambers at City Hall. Chairman Linebarier led the
Pledge of Allegiance to the Flag and Member Henderson led the Invocation. The roll was
called and a quorum declared present.
PRESENT: Chairman Linebarier, Vice-Chairman Lenko, Members Chancey, Donenfeld,
Henderson, and Stanley. Also present were Enforcement Officers Loeffler,
Siegrist, and Simon, Permitting Clerk Ramos, Attorney Sneed, and
Administrative Assistant III Maxwell.
ABSENT: Member Konicek, Godek, and Sidles were excused.
CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS
UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE
BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED
SEPARATELY.

Steve Amburgey, representative for the property owners, having been sworn, stated the
current property owners purchased the property from the V.A. and were unaware of the lien on
the property at the time of closing.
Chairman Linebarier stated for the record there was documentation from the property
owners giving Mr.Amburgey power-of-attorney in Case No. 99-142.
Vice-Chairman Lenko, seconded by Member Donenfeld, moved in Case No. 99-142 to

reduce the fine to $200 if paid within thirty days.
Chairman Linebarier, seconded by Vice-Chairman Lenko, moved to amend the motion in
Case No. 99-142 to reduce the fine to $500 if paid within thirty days. Motion failed 3-3 with
Members Chancey, Donenfeld, and Stanley voting no.
The original motion carried 6-0.

concerns with unattended tires at location.
Code Enforcement Officer Loeffler, having been sworn, presented exhibits, gave a detailed
history of the case, and stated the property is in non-compliance.
Respondent Gilbert McCoy, having been sworn, stated he recently purchased the property
and the tires have been on the property for years and he requested a six-month extension to
dispose of the tires.
Vice-Chairman Lenko, seconded by Member Henderson, moved in Case No. 02-063 to find
the Respondent in violation of Sections 108-35, 115-3 and 115-5 as of September 12, 2002,
but to give until February 25, 2003, to comply or impose fine of$150 per day.
Member Donenfeld, seconded by Member Stanley, moved in Case No. 02-063 to amend the
original motion to give the Respondent until March 25, 2003, to comply or impose fine of
$150 per day. Motion failed 3-3 with Members Chancey, Stanley, and Donenfeld voting no.
Vice-Chairman Lenko, seconded by Member Chancey, moved in Case No. 02-063 to find the
Respondent in violation of Sections 108-35, 115-3, and 115-5 as of September 12, 2002, but to
give until March 14, 2003, to comply or impose fine of$100 per day. Motion carried 6-0.
Attorney Sneed advised the Respondent to disclose the Code Enforcement Board action to all
prospective buyers of the property.
