HomeMy WebLinkAbout06-26-2001 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JUNE 26, 2001 CALL TO ORDER Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers at City Hall. Chairman Linebarier led the Pledge of Allegiance to the Flag and Vice-Chairman Lenko led the Invocation. The roll was called and a quorum declared present. PRESENT: Chairman Linebarier, Vice-Chairman Lenko, Members Chancey, Godek, Konicek, Skiles, and Solomon. Also present were Attorney Feeney, Code Enforcement Supervisor Simon, Code Enforcement Officers Loeffler and Siegrist, Building Clerk Ramos, and Administrative Assistant II Maxwell. ABSENT: Member Henderson, who was excused. Member Ellison, who was un-excused. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. The consent agenda consisted of approval of Items A, B, & C. A. Minutes of the Code Enforcement Board Regular Meeting held on Tuesday, May 22, 2001. B. Order of Dismissal-None Vice-Chairman Lenko, seconded by Member Konicek, moved to approve the Consent Agenda as presented. Motion carried 7-0. Chairman Linebarier read for the record the Memorandum of Voting Conflict for Public Officers filed by Vice-Chairman Lenko for Code Enforcement Board Meeting held May 22, 2001. COMMENTS FROM CITIZENS Richard Tomaino, 209 Franklin Street, Ocoee, stated some neighbors in the area have numerous code violations. Mr. Tomaino stated he feels someone from the city should notify these residents they are violating codes and get the violations resolved. Chairman Linebarier advised Mr. Tomaino to contact Code Enforcement Supervisor Simon on Wednesday morning. Code Enforcement Board Minutes June 26, 2001 (sr John Morton, 220 Lee Street, Ocoee, stated there is a "crack house" next door and the grass is approximately 4' high along with piles of trash and junk. Chairman Linebarier advised Mr. Morton that Code Enforcement Supervisor Simon would be contacting him regarding the code violations in his neighborhood and the "illegal activities" are a matter for the police department. HEARINGS OF STATEMENTS OF VIOLATIONS PURSUANT TO THE HEARING RULES ADOPTED BY THIS BOARD ON JUNE 27,1995,VARIOUS DOCUMENTS ARE USED BY THE CODE ENFORCEMENT OFFICERS IN EACH CASE AND ARE REPORTED IN THE CASE TESTIMONY GIVEN BY THE CODE ENFORCEMENT OFFICER. IN THESE MINUTES THE TITLES TO THOSE DOCUMENTS WILL BE ABBREVIATED AS FOLLOWS: CS-CONTINUED STAY; FS-FEES STAYED; NOCV-NOTICE OF CODE VIOLATION; NOH - NOTICE OF HEARING; SOV - STATEMENT OF VIOLATION (S); OOC - ORDER OF CONTINUANCE; CO - COMPLIANCE ORDER;ONC-ORDER OF NON-COMPLIANCE;OIF/L-ORDER IMPOSING FINE/LIEN;AOC-AFFIDAVIT OF COMPLIANCE; ATF-APPLICATION TO FORECLOSE; RFR-REQUEST FOR REHEARING; ROF-REDUCTION OF FINE;AONC-AFFADAVIT OF NON-COMPLIANCE;PDFS-PER DAY FINE SUSPENDED,AND POS-PROOF OF SERVICE. Vice-Chairman Lenko, seconded by Member Skiles, moved to consider Case No. 01-017 as the next item on the Agenda. Motion carried 7-0. Building Clerk Ramos administered the oath to Code Enforcement Supervisor Simon and Code Enforcement Officers Loeffler and Siegrist. HEARINGS ON STATEMENT OF VIOLATONS PURSUANT TO NOTICES OF HEARINGS Case No. 01-017 - Troy A. Deman & Susan P. Deman 1214 Blue Spring Court Officer Siegrist Violation Cited: 108-23 E (1&2) 04-12-01 NOCV Re-inspection Date: 06-04-01 06-06-01 SOV 06-06-01 NOH Meeting Date: 06-26-01 06-06-01 POS Certified Mail 06-15-01 SOV 06-15-01 POS Certified Mail Observation: Did not schedule a Minimum Standards re-inspection to verify compliance. Code Enforcement Officer Siegrist, having been sworn, gave a brief history of the Case, presented exhibits, and stated as of June 26, 2001, the property is in non-compliance. Respondents, Troy A. & Susan P. Deman, having been sworn, stated the house is being sold to the renters and the soon to be new owners have gotten a construction loan, which construction repairs include all necessary repairs as well as a new roof. Discussion ensued. Vice-Chairman Lenko, seconded by Member Godek, moved to find the Respondents in violation of Sections 108-23 E (1 & 2) as May 28, 2001, but to give until July 10, 2001, to comply or forfeit$100 a day. Code Enforcement Officer Loeffler, having been sworn, presented exhibits, gave a brief history of the Case, and stated as of June 26, 2001, the property is in compliance. Vice-Chairman Lenko, seconded by Member Skiles, moved to find the Respondent in violation of Sections 115-3; 108-35; 115-5; 108-23 M(1&2); 108-23 N(1), and 108-23 J, as of May 26, 2001, but in compliance as of June 26, 2001, and no fine or penalty be imposed. Motion carried 7-0. Vice-Chairman Lenko, seconded by Member Konicek, moved to find the Respondents in Case No.01-016 in violation of Sections 108-12 D; 108-22;NEC 110-12 A; SPC 606.3.4.1 as of May 25, 2001, but in compliance as of June 5, 2001, and no fine or penalty be imposed. Vice-Chairman Lenko, seconded by Member Konicek moved to find the Respondents in Case Nos. 01-018 and 01-019, in violation of Sections 108-22; 115-3; 143-7 B(1), and LDC 4-5 M(7)(d) as of June 5, 2001, but in compliance as of June 26, 2001, and no fine or penalty be imposed. Motion carried 7-0. Recess 8:40 p.m. - 8:50 p.m. Chairman Linebarier introduced Mayor Vandergrift and Mayor Vandergrift thanked the Code Enforcement Board and city personnel for the great job they do. Case No. 01-020 - Edgardo & Natalie A. Caruso 409 Little Spring Hill Road Supervisor Simon Violation Cited: 108-23 I; 108-23 Q 05-02-01 NOCV Re-Inspection Date: 06-14-01 06-15-01 SOV 06-15-01 NOH Meeting Date: 06-26-01 06-15-01 POS Certified Mail 06-15-01 POS Posting Observation: Yard is overgrown, dilapidated fence, and broken windows. Code Enforcement Supervisor Simon , having been sworn, stated the City of Ocoee dismissed this Case. Vice-Chairman Lenko, seconded by Member Solomon, moved to dismiss Case No. 01-020 at the request of the city. Motion carried 7-0. Vice-Chairman Lenko, seconded by Member Chancey, moved to find the Respondents in violation of Sections 108-23 E(2); 108-23 J; 108-35; 115-5 as of June 14, 2001, but to give until July 3, 2001, to comply or forfeit$250 per day. Motion carried 7-0. Chairman Linebarier asked if Order Imposing Fine and Lien for Case No. 01-007 has been imposed. Code Enforcement Supervisor Simon stated she would check into the Order Imposing Fine and Lien. OTHER BUSINESS Case No. 01-014 -Peter A. Giarrusso 2011 Lady Avenue Officer Siegrist Violation Cited: 108-19 A; NEC 110-12 A; NEC 370-25 05-02-01 NOCV Re-Inspection Date: 05-14-01 05-15-01 SOV 05-15-01 NOH Meeting Date: 05-22-01 05-15-01 POS Certified Mail 05-22-01 CO Given until May 29, 2001 or be fined $100 per day. 05-29-01 AOC Observation: Did not schedule a Minimum Standards re-inspection to verify compliance. Chairman Linebarier stated that Case No. 01-014 is in compliance. ELECTIONS Vice-Chairman Lenko, seconded by Member Konicek, moved to re-nominate John Linebarier as Chairman for the upcoming year. Motion carried 7-0. Member Godek, seconded by Member Chancey, moved to amend the motion to retain the current Officers for the next year. Motion carried 7-0. L 5 Code Enforcement Board Minutes June 26, 2001 L COMMENTS Building Clerk Ramos -None Code Enforcement Supervisor Simon - Advised that funding for conferences was not available this year but funds may be a part of her budget next year and asked for an approximate count of those wishing to attend next year. Code Enforcement Officer Siegrist—None Code Enforcement Officer Loeffler-None Attorney Feeney—None Chairman Linebarier - Said he was glad to have Mr. Feeney back and he missed his smiling face when he is not here. Vice-Chairman Lenko - Said it's good to have Mr. Feeney back. She said she enjoyed the conference in Daytona Beach and congratulated Supervisor Simon on her re-election as 2°d Vice-President of F.A.C.E. Asked if it would be a possible to get Bob Hamiliton's training packet for new board members. Supervisor Simon stated it would be no problem for new members to get a packet.
