HomeMy WebLinkAbout08-28-2001 Minutes MINUTES OF THE CITY OF OCOEE ,, CODE ENFORCEMENT BOARD MEETING AUGUST 28, 2001 CALL TO ORDER Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers at City Hall. Chairman Linebarier led the Pledge of Allegiance to the Flag and Member Henderson led the Invocation. The roll was called and a quorum declared present. PRESENT: Chairman Linebarier, Vice-Chairman Lenko, Members Chancey, Konicek, Henderson, Skiles, and Solomon. Also present were Attorney Feeney, Code Enforcement Officers Loeffler and Siegrist, Building Clerk Ramos, and Administrative Assistant II Maxwell. ABSENT: Members Godek and Code Enforcement Supervisor Simon,who were excused. Chairman Linebarier announced that Former City Manager Ellis Shapiro passed away this morning, at approximately 3:30 a.m. Visitation will be at Woodlawn Funeral Home Friday, August 31 from 12:00 p.m. to 2:00 p.m.. A Memorial Service will follow immediately at 2:00 p.m. The family requests in lieu of flowers donations be made to the Ellis Shapiro Family Fund, P.O. Box 307, Ocoee, FL 34761 Chairman Linebarier asked everyone to rise to observe a moment of silence for Mr. Shapiro. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. Vice-Chairman Lenko, seconded by Member Konicek, moved to consider Case No. 01-039, as the next item on the Agenda. Motion carried 7-0. Chairman Linebarier introduced Mr. Donenfeld, who expressed an interest in being on the Code Enforcement Board. Building Clerk Ramos administered the oath to Code Enforcement Officers Loeffler and Siegrist. HEARINGS ON STATEMENT OF VIOLATONS PURSUANT TO NOTICES OF HEARINGS Case No. 01-039 - Karrie L. Owens 2009 Joan Lee Lane Officer Loeffler Violation Cited: 165-3 08-17-01 NOCV Re-Inspection Date: 08-16-01 08-17-01 SOV 08-17-01 NOH Meeting Date: 08-28-01 08-17-01 POS Hand Delivery Observation: Brown G.M.Cadillac in front yard,no tag;tall weed growth under vehicle. Code Enforcement Officer Loeffler, having been sworn, gave a brief history of the Case, presented exhibits and stated the property is in non-compliance. Respondent, Karrie Owens, having been sworn, stated parts for the vehicle have been ordered and her husband will repair the vehicle when he gets back into town. Ms. Owens further stated that it is her property and she is not bothering anyone with the vehicle or weeds. Code Enforcement Officer Loeffler advised Ms. Owens that she will be cited for the vehicle sitting in her rear yard. Vice-Chairman Lenko asked Code Enforcement Officer Loeffler what the previous case number and vehicle involved was. Code Enforcement Officer Loeffler stated the previous case was Case No. 00-062 and involved a blue Cadillac, which is now parked in the rear yard. Discussion ensued. L 2 Code Enforcement Board Minutes August 28, 2001 L Vice-Chairman Lenko, seconded by Member Chancey, moved to find the Respondent in Case No. 01-039 in violation of Section 165-3, as a repeat offender, as of August 16, 2001, and is fined$25 per day until the violation is corrected. Motion carried 7-0. Chairman Linebarier advised Ms. Owens to notify Code Enforcement when the violations are corrected. Discussion ensued. Case No. 01-035 -James & Eugenia Smith 413 Caballero Road Officer Loeffler Violation Cited: 115-5; 165-3 07-13-01 NOCV Re-Inspection Date: 07-25-01 08-03-01 SOV 08-03-01 NOH Meeting Date: 08-28-01 08-03-01 POS Certified Mail Observation: One yellow Ford truck, no tag, parked in/on grass, tall weeds and grass under same. Code Enforcement Officer Loeffler,having been sworn, gave a brief history of the Case, presented exhibits, and stated the property is in non-compliance. Member Solomon, seconded by Member Henderson, moved to find the Respondents in Case No. 01-035, in violation of Section 115-5 and 165-3, as of July 23, 2001, but to give until September 04, 2001, to comply or be fined$50 a day. Motion carried 6-1 with Vice- Chairman Lenko voting no. Member Solomon, seconded by Member Henderson, moved to amend the motion to find the Respondents in Case No. 01-035, in violation of Section 115-5 and 165-3, as of July 23, 2001, but to give until September 11, 2001, to comply or be fined$50 a day. Motion carried 7-0. Member Skiles, seconded by Vice-Chairman Lenko, moved to find the Respondents in Case No. 01-036, in violation of Section LDC 6-4 H(5)(a) as of July 28, 2001, but in compliance as of August 22, 2001, and no fine or penalty imposed. Motion carried 6- 1 with Member Skiles voting no.
